About this opportunity
The Utah Division of Purchasing is publishing a Notice of Intent to Award a Contract Without Engaging in a Standard Procurement Process for AM27-122 Water Supply to the Sevier River Water Users Association, with a public challenge period closing October 30, 2026. This is a sole-source procurement under Utah Procurement Code authority. The conducting procurement unit has determined that only one source exists because the vendor owns equipment in place, holds access to private property for maintenance and monitoring, carries liability for accidental water release, and possesses expertise to maintain unique equipment specific to the automated monitoring system on the Sevier River.
The scope covers goods and services for day-to-day regulation and maintenance of the automated monitoring system operating along the Sevier River, supporting the Division of Water Rights and Water Commissioners. Specific deliverables and technical requirements are detailed in the attached Scope of Work document.
The estimated contract value is $566,760 over a five-year term with no renewal options, with freight costs of $0.00 F.O.B. Destination Freight Prepaid. The anticipated contract is structured as an Agency Contract.
Interested and qualified vendors may submit written challenges to the sole-source designation during the public notice period, provided they submit detailed documentation demonstrating competing sources, comparable or superior products meeting specifications, equivalent proprietary items, and cost comparisons related to transitional expenses if applicable. All inquiries and challenges must be directed to the Division of Purchasing, not to the conducting procurement unit. If no valid challenges are received after the public notice period expires, the Division may award the contract without further competition.
All vendors must certify compliance with Utah Code 63G-27 et seq., confirming they are not engaged in economic boycotts or boycotts of the State of Israel and will not do so during contract performance.

NOTICE OF INTENT TO AWARD A CONTRACT WITHOUT ENGAGING IN A STANDARD PROCUREMENT PROCESS The Division of Purchasing is publishing this notice pursuant to the Utah Procurement Code. The Conducting Procurement Unit submitted this form to the Division of Purchasing claiming that it intends to award a contract without competition if it is determined by the Division of Purchasing, in writing, that: - there is only one source for the procurement item; - transitional costs are a significant consideration in selecting a procurement item; or - the award of a contract is under circumstances, described in rules adopted by the applicable rulemaking authority, that make awarding the contract through a standard procurement process impractical and not in the best interest of the procurement unit. In the Files section the Conducting Procurement Unit has identified its justification for wanting to award a contract without engaging in standard procurement process. You MUST read all of the documentation in the Files.
