About this opportunity
Alpine School District is pursuing a sole-source procurement for architectural design services from KMA Architects, specifically for the repeat use of existing elementary school design plans for a new school located on the Cold Springs property in Lehi, Utah. The procurement is being conducted under the Utah Procurement Code, with the district seeking to award a contract without standard competitive bidding based on three potential justifications: unique source availability, significant transitional costs, or impracticality of standard procurement processes. KMA Architects currently holds exclusive design rights to the architectural plans, which the district wants to re-use to maintain design consistency and reduce costs. The total procurement value is $1,350,000.00, to be executed through a purchase order. The notice was published on October 6, 2025, with responses and potential challenges due by October 13, 2025. Vendors are required to submit any challenges or alternative proposals electronically through the U3P procurement platform, with all communications directed exclusively to the designated procurement officer.
The procurement opportunity appears to have no specific set-aside designations or restrictions on respondent types, though vendors must meet comprehensive prerequisites outlined in the district's vendor documentation. Potential respondents must certify they are not engaged in economic boycotts, provide no forced labor products, and comply with anti-boycott provisions related to specific business activities. Alpine School District reserves the right to conduct background checks, require interviews or presentations, and disqualify vendors who do not meet mandatory minimum requirements. The district's standard terms and conditions include provisions for a one-year product warranty, F.O.B. destination delivery, 30-day invoice payment cycles, and specific legal protections under Utah's Government Records Access and Management Act (GRAMA). If no valid challenges are received during the public notice period, the district may award the contract to KMA Architects without further competitive bidding, effectively maintaining their sole-source status for this specific architectural design.

NOTICE OF INTENT TO AWARD A CONTRACT WITHOUT ENGAGING IN A STANDARD PROCUREMENT PROCESS Alpine School District, Purchasing Department publishes this notice pursuant to the Utah Procurement Code. The Conducting Procurement Unit submitted this form to the Purchasing Department claiming that it intends to award a contract without competition if it is determined by the Division of Purchasing, in writing, that: - there is only one source for the procurement item; - transitional costs are a significant consideration in selecting a procurement item; or - the award of a contract is under circumstances, described in rules adopted by the applicable rulemaking authority, that make awarding the contract through a standard procurement process impractical and not in the best interest of the procurement unit. In the Files section the Conducting Procurement Unit has identified its justification for wanting to award a contract without engaging in standard procurement process. You MUST read all of the documentation in the Files.
