About this opportunity
The Utah Department of Health and Human Services, Utah Public Health Laboratory (UPHL) is awarding a five-year agreement for rental and reagents for a Capillary 3 Dried Blood Spot (DBS) System to Sebia Inc. as a sole-source procurement without competitive bidding, with the Notice of Intent to Award posted October 19, 2026. This is a single-source award based on Sebia's proprietary capillary electrophoresis technology, FDA-cleared closed-system reagent formulations, and exclusive automated assay capabilities for newborn hemoglobinopathy screening that the Conducting Procurement Unit determined are not reasonably available from competing vendors.
The scope includes delivery and installation of two CAPILLARYS 3 DBS instruments with UPS systems and processing computers, instrument validation, standard two-day on-site training for up to two laboratory staff, preventative maintenance twice per calendar year, and forty-eight-hour emergency repair response for Monday–Friday service requests. The system screens for normal hemoglobins (Hb A, F) and abnormal hemoglobins (Hb S, C, E, D, Bart's) in newborns statewide. The contractor must supply all necessary reagents throughout the contract term and provide subject matter expertise as requested.
The estimated contract value is $1,099,680 over five years ($219,936 annually), with freight prepaid and F.O.B. destination. The initial term is five years with an option for DHHS to purchase the rental equipment at fair market value upon completion. Sebia will provide a twelve-month warranty from equipment completion of performance testing, followed by preferred service contract coverage at no additional charge. Annual reagent pricing adjusts not to exceed the greater of five percent or the Consumer Price Index change, with thirty days' notice. DHHS must commit to minimum annual reagent purchases; failure to reach ninety percent of the commitment allows Sebia to increase future pricing or invoice the shortfall. The agreement terminates for breach with thirty days' cure or for convenience after the initial term with thirty days' notice.
Interested vendors may challenge the sole-source determination by submitting documentation of competing sources or comparable products to the Division of Purchasing. All vendors must certify compliance with Utah Code 63G-27 regarding boycott prohibitions.
