About this opportunity
The Massachusetts Department of Transportation (MassDOT) Highway Division, Right of Way Bureau is issuing a Request for Response (RFR) to procure expert cost estimators and movers to provide specialized services for persons and businesses displaced by eminent domain takings throughout the Commonwealth. The contractor will deliver detailed cost reporting on special property items, conduct fair market value assessments and moving cost estimates, verify existing estimates, prepare personal property inventories, and determine in-place values and moving costs for signage entitled to relocation benefits. Prospective contractors must demonstrate a minimum of five years of specialized experience in the field, provide evidence of expert qualification as defined by Massachusetts Superior Court standards, devote at least 50 percent of work time to the field, and submit a Certificate of Financial Good Standing from the Department of Revenue. Required submissions include a letter of interest, Disclosure of Contractual Relationship Form, consultant resumes, Prompt Payment Discount Form, Certificate of Good Standing, and three letters of reference from institutional accounts or largest customers. The contract will commence on July 1, 2024, and terminate on June 30, 2029, with an initial five-year term and one optional renewal of up to four years for a maximum contract duration of nine years. Questions must be submitted through COMMBUYS by January 2, 2029, with official answers published by January 4, 2029, and the bid opening date and quote submission deadline is January 17, 2029, at 2:00 PM Eastern Time, with no late bids accepted. Compensation is set at $100.00 per hour for site visits, research, and estimate preparation, and $800.00 per day ($400.00 per half day) for testimony in judicial or administrative proceedings, with prices remaining firm for the first contract year and any subsequent increases limited to once annually with documented industry data justification.
This procurement is designated as a Small Business Purchasing Program (SBPP) procurement, with SBPP participants meeting Commonwealth criteria receiving award preference if they meet best value criteria. There is no target maximum number of contractors to be awarded; MassDOT may award more or fewer contracts based on best value determination. The estimated contract value is $250,000, and all contractors must provide early payment discounts for payments issued within 10, 15, 20, and 30 days from invoice receipt unless they can demonstrate undue hardship. All contract payments are processed through Electronic Funds Transfer (EFT) within a standard 45-day payment cycle, with accelerated payment options available only when accompanied by prompt payment discounts. Contractors must comply with all applicable Massachusetts General Laws, federal regulations, and MassDOT-specific policies, including provisions related to debarment, tax law compliance, data security, anti-discrimination laws, and executive orders addressing undocumented workers and anti-boycott provisions. All contracts are subject to appropriation and funding availability, with payments subject to intercept for outstanding Commonwealth debts, and contractors must maintain public records access for six years following final payment for audit and compliance purposes.
