About this opportunity
The City of Midland, Texas is requesting proposals for turnkey arsenic pretreatment services at the City-owned T-Bar Wellfield under RFP 27000830, with proposals due December 9, 2026 at 2:00 p.m. and a mandatory pre-proposal conference and site visit on November 4, 2026 at 12215 CR 101, Kermit, Texas.
A local-vendor preference under Texas Local Government Code 271.9051 allows the City Council to award to local bidders (with principal place of business in Midland) whose bids are within five percent of the lowest bid from non-local bidders, provided the City determines in writing that the local bidder offers the best combination of price and economic development opportunities. Bidders must submit an Affidavit of Eligibility to qualify for this preference.
The scope is complete lifecycle turnkey arsenic pretreatment services, including design, permitting, equipment, structures, piping, electrical infrastructure, controls, instrumentation, labor, treatment media and chemicals, testing, operation, maintenance, residual management, and site restoration. The contractor shall own, operate, and maintain the system throughout the contract term. The system must treat groundwater at 5.0 million gallons per day during winter conditions and 12.0 million gallons per day during summer conditions. The contractor must guarantee treated-water arsenic at or below 0.005 mg/L (contractual maximum 0.008 mg/L, automatic isolation threshold at 0.010 mg/L). All iron or steel products must be produced in the United States.
The initial contract term is ten years with two optional five-year renewal periods exercisable at the City's sole discretion, providing a maximum potential term of twenty years. Pricing must be structured as an all-inclusive service contract with no upfront capital cost to the City, expressed as dollars per 1,000 gallons of accepted treated water. Year 1 unit price remains firm for twenty-four months following Commercial Operation Date, then escalates annually based on the Consumer Price Index for the Dallas–Fort Worth SMA, capped at 75% of the CPI increase rate. The proposal must include a ten-year price schedule and optional buyout values at years 10, 15, and 20. The contractor bears complete responsibility for all waste streams, including characterization, transportation, and lawful disposition.
Evaluation is weighted as follows: arsenic treatment performance (30 points), evaluated annual cost and long-term value (25 points), reliability and service availability (15 points), residuals management (10 points), qualifications and experience (10 points), implementation and site integration (5 points), and chemical and energy efficiency (5 points). The City reserves the right to select the proposal providing the best overall value rather than the lowest cost.
The City anticipates contract award in January 2027 with a Notice to Proceed on January 1, 2027. Contractors must commence work within fifteen days of written notice. Written questions and clarifications are due November 18, 2026, with a final addendum issued by November 30, 2026. Conflict of Interest Questionnaire filings are required under Texas Local Government Code Chapter 176 within seven business days of becoming aware of facts requiring disclosure. Required insurance includes Commercial General Liability of $1 million per person/$1 million per occurrence, Business Automobile Liability of $250,000 combined single limit, Workers' Compensation at statutory limits, and Employers' Liability of $500,000 per accident. The City retains the right to terminate at will upon 180 days' written notice.
