About this opportunity

The State of Utah Division of Purchasing is issuing a Notice of Intent to Award a Contract Without Engaging in a Standard Procurement Process for contract number 216351, Amendment 1, which represents a funds increase to an existing software licensing agreement with NCS Pearson Inc. for psychological assessment tools. The Department of Human Services (DHS) is procuring Q-Interactive and Q-Global subscription services, which are comprehensive web-based tools used to administer psychological assessments in mental health settings. The procurement covers three primary service categories: Q-Interactive Licensing (23 licenses), Q-Interactive Assessment Usage, and Q-Global Subscription services. The original contract was established under solicitation number NH21-3 as a sole source procurement with an initial five-year term running from November 2020 through October 2025, and this amendment exercise adds a five-year renewal option extending through October 2030. The procurement unit is justified in awarding without competition based on sole source availability, transitional costs considerations, or circumstances making standard procurement impractical and not in the best interest of the state. The due date for any challenges to this non-competitive award determination is March 12, 2026, providing a seven-day posting period for interested vendors to submit detailed challenges with supporting documentation demonstrating capability to provide comparable or superior products meeting specifications.

The incumbent contractor for this procurement is NCS Pearson Inc., and the award is contingent upon this vendor's continued ability to provide the specialized psychological assessment software and services. The original contract value was $97,550.00 for the five-year initial period, with annual pricing increases across all service categories, ranging from $6,325.00 to $7,118.84 for Q-Interactive Licensing alone. This amendment seeks to increase total contract funding by $95,462.00, bringing the combined contract value to $192,112.00, representing a 169.9% percent increase from the original contract amount to cover the five-year renewal period. The five optional renewal years are valued at $94,084.52, with the combined ten-year total reaching $175,242.66 for the full initial and renewal terms. All responding vendors must certify compliance with Utah Code 63G-27 et seq., specifically attesting that they are not engaged in economic boycotts or boycotts of the State of Israel and will not engage in such boycotts during the contract term. The Division of Purchasing may award this contract without competition if no valid challenges are received by the March 12, 2026 deadline, or may proceed with the award despite competing vendors if the justification basis is transitional costs or impracticability rather than sole source.

NOTICE OF INTENT TO AWARD A CONTRACT WITHOUT ENGAGING IN A STANDARD PROCUREMENT PROCESS The Division of Purchasing is publishing this notice pursuant to the Utah Procurement Code. The Conducting Procurement Unit submitted this form to the Division of Purchasing claiming that it intends to award a contract without competition if it is determined by the Division of Purchasing, in writing, that: - there is only one source for the procurement item; - transitional costs are a significant consideration in selecting a procurement item; or - the award of a contract is under circumstances, described in rules adopted by the applicable rulemaking authority, that make awarding the contract through a standard procurement process impractical and not in the best interest of the procurement unit. In the Files section the Conducting Procurement Unit has identified its justification for wanting to award a contract without engaging in standard procurement process. You MUST read all of the documentation in the Files.
