About this opportunity
The State of Utah Department of Health and Human Services (DHHS) is seeking to amend an existing five-year contract with United Behavioral Health Inc. to provide mental health and substance use disorder services for Medicaid enrollees in Tooele County through a Notice of Intent to Award a Contract Without Engaging in a Standard Procurement Process. The contract, originally solicited as RS21-17 and effective from July 1, 2021, through June 30, 2026, requires the contractor to manage comprehensive behavioral health coverage, including service authorization processes, provider network management, and performance standards for timely care access. Key deliverables include maintaining adequate provider capacity, offering emergency services 24/7, providing initial service appointments within specified timeframes (one hour for emergencies, five business days for urgent care, and fifteen business days for non-urgent care), and implementing enrollment procedures and cultural competence protocols. The procurement is being conducted through a sole source procurement method, with a public comment period allowing vendors to challenge the award. The specific due date for responses is December 12, 2025, with the notice published on December 5, 2025.
The contract appears to have no specific set-aside designations or restrictions on responding organizations. The incumbent vendor is United Behavioral Health Inc., which will continue to provide services under an amended contract. The proposed amendment increases the contract value by $9,636,934, raising the total from $44,615,036 to $54,251,970, representing a 50.70 percent increase from the original $36,000,000 contract total. The contract is structured as a risk-based capitation arrangement with fixed monthly per-enrollee payments, requiring the contractor to maintain comprehensive operational standards including fraud prevention, program integrity, provider credentialing, and data security protocols. Vendors must comply with Utah Code 63G-27 regarding economic boycotts and boycotts of the State of Israel. The Department of Health and Human Services retains the authority to impose corrective action plans, suspend capitation payments, or terminate the contract for non-compliance, with the current contract automatically terminating on June 30, 2026, unless renewed through a separate procurement process.

NOTICE OF INTENT TO AWARD A CONTRACT WITHOUT ENGAGING IN A STANDARD PROCUREMENT PROCESS The Division of Purchasing is publishing this notice pursuant to the Utah Procurement Code. The Conducting Procurement Unit submitted this form to the Division of Purchasing claiming that it intends to award a contract without competition if it is determined by the Division of Purchasing, in writing, that: - there is only one source for the procurement item; - transitional costs are a significant consideration in selecting a procurement item; or - the award of a contract is under circumstances, described in rules adopted by the applicable rulemaking authority, that make awarding the contract through a standard procurement process impractical and not in the best interest of the procurement unit. In the Files section the Conducting Procurement Unit has identified its justification for wanting to award a contract without engaging in standard procurement process. You MUST read all of the documentation in the Files.
