PHMSA may consider requests for performance period extensions on a case-by-case basis with at least 30 days' notice.
Applicants must address one or more of nine statutory elements of effective damage prevention programs: enhanced communication between operators and excavators; stakeholder partnership and support; operator use of performance measures for locators; employee training partnerships; public education; enforcement agency dispute resolution; fair and consistent enforcement; technology improvements to the locating process; and data analysis for continuous program improvement. Applications must include a detailed project narrative addressing each element pursued, a comprehensive budget by cost category, and a Governor's letter designating the applicant as state authority.
Merit evaluation weighs relevance to the nine elements most heavily, followed by costs, tangible results, and realistic schedules, then demonstrated state commitment to damage prevention. Unallowable costs include lobbying, litigation, regulatory compliance programs for operators, construction, membership dues, conference sponsorships, One-Call Center operations, research and development, and pre-award costs unless explicitly approved.
