About this opportunity

The Special Notice published by the Library of Congress announces its intent to award sole-source contracts to Kodak and ORWO for various motion picture film stocks. The Library of Congress requires these specialized film stocks to preserve films in its collection and protect them from deterioration.

The Notice provides advance public notification of the Library's intent to award two single-award, indefinite-delivery, indefinite-quantity contracts of a one base year and one option year in duration. The contracts are for amounts below the simplified acquisition threshold and are for the provision of black-and-white and color print, duplicating negative, master positive, and intermediate film stocks in 35mm gauge. While the Library will accept capability statements from other contractors, it is not obligated to change its procurement direction without sufficient cause. The Notice serves to both announce the sole-source determination and accomplish the public posting requirement of the justification and approval documentation in a single filing. No other notices or post-award documents will be issued related to this procurement.

Notice text

This is a public notice prepared in accordance with Federal Acquisition Regulation (FAR) 5.2 – Synopsis of Proposed Contract Actions.

The Library of Congress (LoC), Contracts and Grants Directorate (CGD), intends to issue two single-award, sole-source, firm-fixed-price (FFP) IDIQ contracts to: (1) Kodak (Eastman Kodak, 343 State St., Rochester, NY 14605) and (2) ORWO (Campbell Representation, 310 East Rd., West Stockbridge, MA 01266).

The period of performance for both intended contracts shall run as follows: one 12-month base year and one 12-month option year.  Both contracts are valued at amounts below the simplified acquisition threshold (defined as $250,000 and below), but above $25,000 (the public notice threshold). These supplies will consist of the following: (1) Black-and-white fine grain print film stock, 35mm gauge; (2) Black-and-white fine grain duplicating negative film stock, 35mm gauge; (3) Black-and-white fine grain master positive film stock, 35mm gauge; (4) Color-print film stock, 35mm gauge; and (5) Color-intermediate film stock, 35mm gauge.

This announcement constitutes the only public notice, proposals are not being requested from other parties, and a written solicitation will not be issued. This public notice accomplishes the following:

1.           Notice of the LoC’s intent to sole-source this requirement to the businesses listed herein;

2.           Synopsizing the requirements in accordance with the FAR; and

3.           Publicly posting the approved Justification and Approval (J&A) to the public in advance of the contract award rather than after award. As a result of this, a second posting of the J&A is not required after the award has been made.

As a result of this public posting, this shall be the only notice issued. A separate award notice and a separate J&A posting shall not be performed, as all public information is being accomplished via this public notice.

The following attachments are included in this notice:

Attachment 1: Statement of Work

Attachment 2: Sole-Source Justification and Approval (Redacted for Public Release)

No further notices shall be pursued at this time regarding this contracting action.

Finally, the Library of Congress shall accept capability statements from other prospective businesses and review them for potential changes to its procurement direction. The LoC is not, however, obligated to change directions in this procurement without ample evidence.
