About this opportunity

The Department of Justice seeks a single law firm or solo practitioner to provide private counsel debt collection services for the United States District Court for the Northern District of Texas, with proposals due July 1, 2026 at 10:00 a.m. ET. The procurement is set-aside for total small business.

Place of performance is within counties comprising the Northern District of Texas, with litigation filed in Federal District Court unless foreclosures are determined more efficient in state or local courts. The contractor must be licensed to practice in the federal jurisdiction and capable of appearing in Federal District Court for the Northern District of Texas.

The contract covers approximately 300 currently referred cases valued at approximately $10.2 million in total unsecured debts, with 86% post-judgment claims and an average case age of 11 years. Performance runs five years from November 21, 2026 through November 20, 2031, with a six-month optional extension. Compensation includes contingency fees for unsecured debt collection (percentage of amounts collected), flat fees for foreclosure, deed in lieu of foreclosure, and eviction actions, hourly rates for attorneys and paralegals across various debt types, and reimbursable direct costs for service of process, filing fees, publication, appraisals, title searches, and title insurance.

All proposed attorneys must provide current proof of bar admission and good standing in their state, plus evidence of admission or pending admission to Federal District Court. Contractors must use the Government's Consolidated Debt Collection System and comply with the Fair Debt Collection Practices Act, Federal Debt Collection Procedures Act, and Federal Claims Collection Standards. All contractor personnel require favorable background investigations prior to commencing work. Key personnel (lead attorney and paralegal) cannot be replaced without written Contracting Officer approval. Subcontracting is prohibited except as expressly approved in advance by the Contracting Officer, Assistant U.S. Attorney, and Contracting Officer's Representative.

Evaluation employs two phases: Phase One assesses SAM registration and attorney credentials (Go/No-Go); Phase Two evaluates technical qualifications, past performance, and price, with non-price factors weighted as significantly more important than price. Proposals must include technical, past performance, and price components, with three client references from the past three years performing the same or similar work. The NAICS code is 541110, Offices of Lawyers. Amendment 0001 issued June 23, 2026 provides answers to solicitation questions; offerors must acknowledge receipt of the amendment.
