About this file

This is a Technical Proposal Template for the U.S. Department of Justice Private Counsel Debt Collection Program serving the Northern District of Texas under Solicitation No. 15JPSS26R00000067.

The template outlines submission requirements for private law firms competing to provide debt collection legal services to the federal government. Vendors must demonstrate substantial debt collection experience, including specific experience representing the U.S. as plaintiff in federal, state, and local court litigation for both secured and unsecured debts within the past three years. All proposed attorneys must provide resumes detailing their debt collection experience, be admitted to practice in federal district court, maintain good standing with state bars and federal courts, and disclose any disciplinary actions or sanctions. Firms must submit signed Standard Form 30, certificates of admission and good standing, letters of commitment for non-employed attorneys, and writing samples containing no more than five grammatical or mechanical errors. The proposal validity period is 180 days from submission date. Key evaluation areas include the firm's organizational structure, administrative capabilities for case management and DOJ system updates, detailed debt collection processes from intake through resolution, ability to handle volume increases without subcontracting, and remote case handling procedures if the office is not located in-district. Firms must certify that travel expenses are not authorized and subcontracting is prohibited unless expressly approved in the resulting contract.

DEBT COLLECTION EXPERIENCE

What types of debt collection has your firm, and each of the attorneys proposed to work on this contract, if awarded, done? How much of this was in the past three (3) years? (Specify the types of secured and unsecured debt, list clients and types of clients (Federal government, local governments, banks, etc.)) Also, be sure to specify whether the litigation was in federal, state, or local courts in the district. Indicate the length of experience obtained in federal, state, or local courts. Lastly, provide the level of experience your firm has with electronic case filing.

How many years of experience does each attorney who would work on these DOJ assigned cases have in debt collection work and distinguish the types of debt collection experiences with secured and unsecured. (List each attorney, types of debt, and the number of years’ experience.)

How much time has each attorney who would work on DOJ cases spent working on litigation related to debt collection during the past three (3) years. List any experience the proposed attorney(s) and/or firm has specifically in representing the U.S. as a plaintiff in litigation in debt collection matters within the federal district courts or state or local courts.

Specific experience by a firm or proposed attorney in representing the U.S. as the plaintiff in litigation for debt collection is a benefit to the Government. Specific experience in representing the U.S. as a plaintiff in litigation for unsecured debt collection in the district or state or local courts for secured matters is a greater benefit to the Government.

ATTORNEY QUALIFICATIONS

Resumes must be provided for all attorneys that are proposed to work under this contract, if awarded. Note any existing security clearances in the resumes. If individuals are not currently employed by the firm, please include signed letters of commitment.

Attorney
Resume Attached
Signed Letter of Commitment Attached (if not employed by firm)
Admitted to Federal District Court?
In good standing with the Federal District Court?
In good standing with the state bar?
*Disciplined or sanctioned by any court, bar association, or any Federal, state or local government agency?

*If yes, provide status of complaint, disposition thereof and copies of decisions rendered.

ADMINISTRATIVE OFFICE ATTRIBUTES

The Government requires the firm to perform administrative matters such as case management, regular system of record updates, invoicing, and responsiveness to DOJ inquiries in the performance of the contract.

Specifically, please describe how your office is organized. Please include number of attorneys, number of paralegals, and information regarding separate departments (billing, IT, etc.)? Provide any examples of administrative challenges or complexity in litigation, case management, and/or billing which the firm or attorney has performed well considering the challenges?

Describe in detail your firm’s debt collection process from case intake until resolution. Be sure to be specific as to how your firm will handle the initial assignment of cases including for example, how cases will be worked, who will be responsible for updating the DOJ system of record with notes and status of cases regularly. The Offeror’s response to this inquiry should reflect the office processes for handling unsecured debts or secured debts, or both according to the Offeror’s expertise.

Also, describe how your firm will handle an increase in the volume of cases assigned. Assume an increase in the first year and an increase in subsequent years. Describe the impact on staffing and/or workload assignments.

If you do not maintain an office in the district, describe specifically how cases will be handled from a remote location, considering that the Government will not consent to subcontracting and will not provide reimbursement for travel expenses. Include a statement certifying that travel expenses are not authorized, regardless of the number of trips, and that subcontracting is not authorized unless consent is granted in accordance with the “Subcontracting Restriction” contained within the contract.

QUALITY OF WRITING

“Is the writing sample, grammatically (e.g., proper sentence structure) and mechanically (e.g., punctuation) correct? Is the structure and format appropriate to the purpose of the document and is the document clearly written?

At a minimum, the writing sample(s) shall not have more than a total of five (5) grammatical and/or mechanical errors and the writing samples shall be well-chosen and relevant. Writing samples representing a total lack of writing skill (e.g., numerous grammatical and/or mechanical errors affecting the reader’s ability to understand the written material and/or incomplete, and/or unrelated/poorly chosen writing samples may result in a low rating.)
