(a) Definition. “Small business concern,” as used in this clause, means a concern, including its affiliates, that is independently owned and operated, not dominant in the field of operation in which it is bidding on Government contracts, and qualified as a small business under the size standards in this solicitation.
(b) Applicability. This clause applies only to—

(1) Offers are solicited only from small business concerns. Offers received from concerns that are not small business concerns shall be considered nonresponsive and will be rejected.
(2) Any award resulting from this solicitation will be made to a small business concern.
(d) Agreement.
(1) For a contract or an order at or below the simplified acquisition threshold, a small business concern may provide the end item of any firm. For a contract or an order exceeding the simplified acquisition threshold, unless the Small Business Administration has waived the requirements of paragraphs (d)(1)(i) through (iii) of this clause in accordance with 13 CFR 121.1204, a small business concern that provides an end item it did not manufacture, process, or produce, shall—

(3) Paragraphs (d)(1) through (2) of this clause do not apply to construction or service contracts.
(End of clause)
52.222-19 Child Labor—Cooperation with Authorities and Remedies. (DEVIATION 2020-O0019)

(1) Israel, and the anticipated value of the acquisition is $50,000 or more;
(2) Mexico, and the anticipated value of the acquisition is $83,099 or more; or

(b) Cooperation with Authorities. To enforce the laws prohibiting the manufacture or importation of products mined, produced, or manufactured by forced or indentured child labor, authorized officials may need to conduct investigations to determine whether forced or indentured child labor was used to mine, produce, or manufacture any product furnished under this contract. If the solicitation includes the provision 52.222-18, Certification Regarding Knowledge of Child Labor for Listed End Products, or the equivalent at 52.212-3(i), the Contractor agrees to cooperate fully with authorized officials of the contracting agency, the Department of the Treasury, or the Department of Justice by providing reasonable access to records, documents, persons, or premises upon reasonable request by the authorized officials.

The purpose of this amendment 05 to W52P1J-21-Q-PT76 is to answer the following question:
Question 1) Will the Government be providing CAD files associated with the drawings, formatted in Millimeters in ( STEP / STL ) File Formats?
Answer: No. The drawings currently provided as attachments to this solicitation are the only versions of the drawings available.
W52P1J-21-Q-PT76 Amendment 06, August 26, 2021
The purpose of this amendment 06 to W52P1J-21-Q-PT76 is to remove the injection molding parameters requirement, and answer the following questions:
Item 1) The injection molding parameters requirement, item d) under the heading *Molds, is not required and removed.
Question 2) The drawings call out for different materials, is the intent to have all four parts to be made from the plastic from drawing 3864AS110? Or are you going to provide another materials spec?
Answer: If the drawing calls out a specific material, use that material to mold that specific part. If additional drawings are needed, vendor should raise that issue. The material drawing should be listed on the part drawing. Some part drawings list a material by another means, such as an ASTM in lieu of a drawing number. So, if a material specification is needed, a specific request must be made for the particular specification which is needed.
Question 3) Can the government ensure availability of the required material?
Answer: No. The contractor is responsible for finding the material and determining the lead time to get the material.
Question 4) How many cavities should each mold have?
Answer: This is a business decision for each vendor to make for itself. Vendors should decide on the number of cavities based upon what would work with their equipment and what would be cost effective for their company.
Question 5) What is the projected future requirement for the quantity of parts?
Answer: Any projected future requirement is unavailable. The quantity listed in this solicitation is the only current required quantity.

The lot number shall contain identification of manufacturer, date of production and should be exclusive to each production run. (i.e. CRA21E001-001, Crane Army, manufactured May 2021, lot 1). Is the lot number marking required on each part or on the box?
Answer: Lot number is required on the box
Question 2) 10 FAT samples are required per cavity. Please confirm FAT dimensional inspections are to be performed by the government – the deliverable is only the samples, not inspection data.
Answer: FAT will be inspected by Government based on drawing requirements
Question 3) Drawings are marked distribution statement D. From this we infer that the molds must be made in the US unless the government intends to permit distribution of the drawings overseas. Please confirm.
Answer: Buy American applies to this requirement
Question 4) We request an extension of the proposal submittal date of 1 week from the time the answers to the above questions are received.
Answer: There will be no extensions to the closing date.

(a) Definition. “Small business concern,” as used in this clause, means a concern, including its affiliates, that is independently owned and operated, not dominant in the field of operation in which it is bidding on Government contracts, and qualified as a small business under the size standards in this solicitation.
(b) Applicability. This clause applies only to—
(1) Contracts that have been totally set aside for small business concerns; and
(2) Orders set aside for small business concerns under multiple-award contracts as described in 8.405-5 and 16.505(b)(2)(i)(F).
(c) General.

(2) For contracts or orders for multiple end items, at least 50 percent of the total value of the contract or order shall be manufactured, processed, or produced in the United States or its outlying areas by small business concerns.
(3) Paragraphs (d)(1) through (2) of this clause do not apply to construction or service contracts.
(End of clause)
52.222-19 Child Labor—Cooperation with Authorities and Remedies. (DEVIATION 2020-O0019)

(c) Violations. The Government may impose remedies set forth in paragraph (d) for the following violations:
(1) The Contractor has submitted a false certification regarding knowledge of the use of forced or indentured child labor for listed end products.

Answer: No. The drawings currently provided as attachments to this solicitation are the only versions of the drawings available.
W52P1J-21-Q-PT76 Amendment 06, August 26, 2021

(i) Provide an end item that a small business has manufactured, processed, or produced in the United States or its outlying areas;
(ii) Be primarily engaged in the retail or wholesale trade and normally sell the type of item being supplied; and
(iii) Take ownership or possession of the item(s) with its personnel, equipment, or facilities in a manner consistent with industry practice; for example, providing storage, transportation, or delivery.

(1) Israel, and the anticipated value of the acquisition is $50,000 or more;
(2) Mexico, and the anticipated value of the acquisition is $83,099 or more; or
(3) Armenia, Aruba, Australia, Austria, Belgium, Bulgaria, Canada, Croatia,
Cyprus, Czech Republic, Denmark, Estonia, Finland, France, Germany, Greece, Hong Kong, Hungary, Iceland, Ireland, Italy, Japan, Korea, Latvia, Liechtenstein, Lithuania, Luxembourg, Malta, Moldova, Montenegro, Netherlands, New Zealand, Norway, Poland, Portugal, Romania, Singapore, Slovak Republic, Slovenia, Spain, Sweden, Switzerland, Taiwan, Ukraine, or the United Kingdom and the anticipated value of the acquisition is $182,000 or more.
(c) Violations. The Government may impose remedies set forth in paragraph (d) for the following violations:
(1) The Contractor has submitted a false certification regarding knowledge of the use of forced or indentured child labor for listed end products.
(2) The Contractor has failed to cooperate, if required, in accordance with paragraph (b) of this clause, with an investigation of the use of forced or indentured child labor by an Inspector General, Attorney General, or the Secretary of the Treasury.
(3) The Contractor uses forced or indentured child labor in its mining, production, or manufacturing processes.
(4) The Contractor has furnished under the contract end products or components that have been mined, produced, or manufactured wholly or in part by forced or indentured child labor. (The Government will not pursue remedies at paragraph (d)(2) or paragraph (d)(3) of this clause unless sufficient evidence indicates that the Contractor knew of the violation.)

(1) The Contracting Officer may terminate the contract.
(2) The suspending official may suspend the Contractor in accordance with procedures in FAR Subpart 9.4.
(3) The debarring official may debar the Contractor for a period not to exceed 3 years in accordance with the procedures in FAR Subpart 9.4.

(b) Applicability. This clause applies only to—
(1) Contracts that have been totally set aside for small business concerns; and
(2) Orders set aside for small business concerns under multiple-award contracts as described in 8.405-5 and 16.505(b)(2)(i)(F).
(c) General.
(i) Provide an end item that a small business has manufactured, processed, or produced in the United States or its outlying areas;

(1) Israel, and the anticipated value of the acquisition is $50,000 or more;
(2) Mexico, and the anticipated value of the acquisition is $83,099 or more; or
(3) Armenia, Aruba, Australia, Austria, Belgium, Bulgaria, Canada, Croatia,
Cyprus, Czech Republic, Denmark, Estonia, Finland, France, Germany, Greece, Hong Kong, Hungary, Iceland, Ireland, Italy, Japan, Korea, Latvia, Liechtenstein, Lithuania, Luxembourg, Malta, Moldova, Montenegro, Netherlands, New Zealand, Norway, Poland, Portugal, Romania, Singapore, Slovak Republic, Slovenia, Spain, Sweden, Switzerland, Taiwan, Ukraine, or the United Kingdom and the anticipated value of the acquisition is $182,000 or more.
