About this opportunity
The National Institute of Standards and Technology (NIST), specifically the Material Measurement Laboratory through the Office of Acquisition and Agreements Management, has published a Notice of Intent to Sole Source for comprehensive maintenance repair services on Thermo Fisher instruments. This Special Notice, posted on January 29, 2026, indicates NIST's intention to negotiate exclusively with Thermo Electron North America, LLC, a subsidiary of Thermo Fisher Scientific located in Rockford, Illinois. The sole source determination is based on NIST's assessment that Thermo Fisher Scientific holds proprietary rights to the equipment, maintains exclusive manufacturing and distribution authority, and possesses sole access to compatible parts, software, and technical support. No other authorized resellers or service providers exist in the marketplace for this equipment.
The maintenance agreement will cover more than 70 pieces of specialized laboratory equipment, including mass spectrometers, autosamplers, pumps, freezers, and various analytical detectors. The contractor must provide comprehensive service and maintenance on a scheduled and as-needed basis, including parts, labor, travel, unlimited on-site emergency service, and one preventive maintenance visit annually to ensure uninterrupted equipment performance within manufacturer specifications. The contract term consists of a one-year base period with four optional one-year renewal periods. The Special Notice deadline for submission is February 12, 2026, and interested parties should note that only Thermo Electron North America, LLC is eligible to participate in this sole source procurement due to the proprietary nature and manufacturer-specific requirements of the equipment.

Sole source determination is based on the following :
-NIST-owned equipment are commercial items that were manufactured by Thermo Fisher Scientific which is owned by Thermo Electron North America. Market Research has demonstrated and Thermo has asserted that they have proprietary rights to the existing equipment and are the sole manufacturer and distributor of the equipment. Thermo has no authorized resellers or service providers, therefore, only they can supply the required service and guarantee that the maintenance and parts will be fully compatible with and meet the original performance specifications for the equipment;
-Only Thermo has access to performance verified component parts, spare parts, software, technical support, and the latest firmware and software updates available for these systems;
-Thermo manages a staff of trained, certified field technicians/engineers. Thermo does not train and certify technicians outside of their own company; and
-The Government requires a service agreement for the primary purpose of securing on-site service for emergency repairs within 72 hours of notifying the Contractor of the issue.
