About this opportunity

The Department of Energy's National Energy Technology Laboratory (NETL) has issued a Special Notice announcing its intent to sole source a maintenance agreement renewal for a Dionex Ion Chromatography Instrument System manufactured by Thermo Electron. The notice, posted on February 13, 2025, with a response deadline of February 28, 2025, outlines NETL's plan to award a purchase order directly to Thermo Electron. This procurement falls under Federal Acquisition Regulation (FAR) Part 13 for Simplified Acquisition Procedures. NETL has determined that Thermo Electron is the only authorized service provider capable of maintaining this specialized scientific equipment. The agency's decision is based on Thermo Electron being the original equipment manufacturer requiring exact replacement parts to ensure reliable instrument operation.

Contractors interested in challenging the sole source determination must submit written evidence of their capability to meet NETL's requirements by 1:00 PM ET on February 28, 2025, directly to the purchasing agent, Rebekah Parks, via email at rebekah.parks@netl.doe.gov. The Special Notice emphasizes that telephone responses will not be accepted, and the government retains sole discretion in determining whether to compete the requirement based on received responses. The maintenance agreement falls under the NAICS category 811210 for Electronic and Precision Equipment Repair and Maintenance, with a specific Product Service Code (PSC) of J066 for maintenance and repair of laboratory equipment. While the opportunity is not a formal request for quote or proposal, potential contractors must provide comprehensive evidence demonstrating their ability to fulfill NETL's specific maintenance requirements for the Dionex Ion Chromatography Instrument System.

Notice text

Notice of Intent to Sole Source the renewal of the Thermo Electron Maintenance Agreement for the NETL Dionex Ion Chromatography Instrument System.
In accordance with Federal Acquisition Regulation (FAR) Part 13, Simplified Acquisition Procedures, the Department of Energy (DOE), National Energy Technology Laboratory (NETL) intends to award a purchase order on a sole source basis to Thermo Electron to purchase a Maintenance Agreement for the NETL Dionex Ion Chromatography Instrument System. NETL requires the maintenance renewal from Thermo Electron as they are the original equipment manufacturer of the instrument covered by the maintenance agreement and exact replacement parts must be utilized to continue reliable operation of the manufacturer’s unit. To assure the satisfactory operation of the equipment, the replacement parts must be obtained from the original equipment manufacturer, as Thermo Electron is the only authorized service provider for Thermo Electron equipment. This is considered a sole source to Thermo Electron as to the best of the NETL’s knowledge, based on market research conducted, Thermo Electron is the only known source that can offer the maintenance agreement for this instrument. No known potential alternate sources exist which could satisfy NETL's requirement.

This notice of intent is not a request for quote/proposal. Any interested party that believes it can meet the NETL requirement described herein may identify themselves and must provide evidence of their capability to fulfill the requirement being requested by 1:00 PM ET on February 28, 2025. Responses must be submitted in writing to the purchasing agent, Rebekah Parks, via email at rebekah.parks@netl.doe.gov no later than the time and date noted above. Telephone responses and requests will not be received.

A determination by the Government not to compete this requirement based on responses to this notice is solely within the discretion of the Government. Information received will be considered solely for determining whether to conduct a competitive procurement.
