About this opportunity
The Department of Energy National Energy Technology Laboratory announced its intent to sole source a service agreement for an Apreo2-C Field Emission Scanning Electron Microscope and EDS UltraDry 60M to FEI Company (Thermo Fisher Scientific), with a response deadline of July 21, 2026. The notice is a justification for restricting competition to the original equipment manufacturer, as NETL asserts that FEI Company is the only authorized U.S. service provider capable of maintaining the specialized equipment and that no known alternate sources exist. The service agreement will provide continued maintenance coverage following warranty expiration, including replacement units and system upgrades necessary to keep the instruments operational. Interested parties that believe they can fulfill the requirement must provide evidence of their capability to do so by the July 21 deadline. This acquisition is conducted under the Revolutionary FAR Overhaul Part 12 commercial products and services framework.
Notice text
Notice of Intent to Sole Source FEI Company (Thermo Fisher Scientific) Service Agreement for the Apreo2-C Field Emission Scanning Electron Microscope and EDS UltraDry 60M (129 eV).
In accordance with Revolutionary FAR Overhaul (RFO) Part 12 - Acquisition of Commercial Products and Commercial Services,, the Department of Energy (DOE), National Energy Technology Laboratory (NETL) intends to negotiate and award a purchase order on a sole source basis to FEI Company (Thermo Fisher Scientific) to purchase the Service Agreement for the Apreo2-C Field Emission Scanning Electron Microscope and EDS UltraDry 60M (129 eV) to assure satisfactory operation of the existing NETL owned FEI Company (Thermo Fisher Scientific) Apreo2-C Field Emission Scanning Electron Microscope and EDS UltraDry 60M (129 eV) instruments. The service agreement ensures continued coverage following the warranty expiration. Use of the equipment (or software) and covers replacement units and upgrades of the system necessary to keep the units operable. FEI Company is a legal entity of Thermo Fisher Scientific and is the only authorized service provider for repair and maintenance in the United States for the Apreo 2C LoVac. The instrument must be properly maintained with the unique specifications in which only the OEM, Thermo Fisher Scientific, can maintain. This is considered a sole source to FEI Company (Thermo Fisher Scientific) because, to the best of the NETL’s knowledge, FEI Company (Thermo Fisher Scientific) is the only known source that can provide the maintenance support plans specific to the Apreo2-C Field Emission Scanning Electron Microscope. No known potential alternate sources exist which could satisfy NETL's requirements.
This notice of intent is not a request for quote/proposal. Any interested party that believes it is capable of meeting the NETL requirement described herein may identify themselves and must provide evidence of their capability to fulfill the requirement being requested by 5:00PM EDT on July 21, 2026. Responses must be submitted in writing to the Contract Specialist, Arturo Manantan via email at arturo.manantan@netl.doe.gov no later than the time and date noted above. Telephone responses and requests will not be received.
A determination by the Government not to compete this requirement based on responses to this notice is solely within the discretion of the Government. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement.
