About this opportunity
This solicitation seeks continued operation and maintenance of the National Institute on Alcohol Abuse and Alcoholism Alcohol Policy Information System. The National Institute of Child Health and Human Development, on behalf of NIAAA, will award a cost plus fixed fee term level-of-effort contract to maintain the public website, associated data repositories, and perform legal research and policy analysis. The contractor must provide reliable and timely information on alcohol and cannabis policies adopted by U.S. state and federal governments. The contract consists of a one year base period and four one-year option periods. Proposals are due by September 7, 2022 and submitted through the NIH electronic submission system.
This is a 100% set-aside for small businesses with less than 1,000 employees and NAICS 541611/PSC R499. The incumbent contractor is The CDM Group, Incorporated. The potential value is five years from January 1, 2023 to December 31, 2027. The awardee cannot subcontract over 50% of the contract funds to other than similarly small businesses. Work will be performed in the Washington D.C. metropolitan area.

This Solicitation is issued by the NICHD Office of Acquisitions on behalf of the National Institute on Alcohol Abuse and Alcoholism (NIAAA).
This acquisition is being competed as a 100% Set-Aside for Small Business concerns whereby only Small Business concerns will be eligible for award. The small business size standard for the associated NAICS is 1,000 employees.
A small business ¿concern¿, as defined by FAR 19.001, means any business entity organized for profit (even if its ownership is in the hands of a nonprofit entity) with a place of business located in the United States or its outlying areas and that makes a significant contribution to the U.S. economy through payment of taxes and/or use of American products, material and/or labor, etc. "Concern" includes but is not limited to an individual, partnership, corporation, joint venture, association, or cooperative. For more information, see 13 CFR 121.105.
Additionally, for acquisitions conducted under a 100% Small Business Set-Aside, per FAR 19.505(b)(1)(i), ¿Limitations on Subcontracting¿, the concern [small business prime contractor] will not pay more than 50 percent of the amount paid by the Government for contract performance to subcontractors that are not similarly situated entities [e.g. also small businesses]. Any work that a similarly situated entity further subcontracts will count towards the concern's 50 percent subcontract amount that cannot be exceeded.
In other words, for acquisitions conducted under 100% small business set-asides, the small business prime contractor cannot function as a ¿pass-though¿ entity where the majority of the contract expenditures are going to ¿other than¿ small business concerns.
This acquisition represents a follow-on requirement to the active NIAAA Alcohol Policy Information System (APIS) contract, HHSN275201800002C, with The CDM Group, Incorporated.
The purpose of this acquisition is to provide continued operation and maintenance of the NIAAA Alcohol Policy Information System (APIS), including the public web site at http://alcoholpolicy.niaaa.nih.gov and the associated data structures and repositories. In addition to maintaining and updating the public website, the contractor performs legal research, synthesis and analysis to provide detailed, reliable, and timely information on alcohol-related policies as well as cannabis policies adopted by governments at the State and Federal levels in the United States. The purpose of APIS is to provide researchers with accurate information so they can conduct studies of the effects of specific changes in these policies. Intended primarily as a tool for researchers, APIS features compilations and analyses of alcohol and cannabis statutes and regulations. APIS is designed to simplify the process of ascertaining the state of the law for studies of the effects and effectiveness of alcohol and cannabis policies.
The NIAAA anticipates awarding one (1) cost plus fixed fee term level-of effort contract with a base period of one year plus four successive 12-month term options for a total potential period of performance of five years if all term options are exercised. It is anticipated that the award will be made on or around December 15, 2022, with an effective start date of January 1, 2023.
