About this opportunity

This Pre-solicitation Notice is for an Indefinite Quantity Contract (IQC) or Long-Term Contract (LTC) for 23 National Stock Numbers (NSNs) of supplies from Eaton Corporation. The Defense Logistics Agency (DLA) Land and Maritime is considering this future solicitation and award. Since the Government does not possess complete unrestrictive technical data for these items, it intends to solicit and contract only with approved sources under the authority of 10 U.S.C. 3204(a)(1). Interested parties are encouraged to apply for source approval through DLA's Alternate Offer/Source Approval Request Program. The agency is requesting information from potential suppliers on their interest and capability to support an LTC, including maximum contract term, any quantity price breaks, and ability to provide cost or pricing data.

There is no set-aside designation for this procurement. Based on the Market Research Spreadsheet, the 23 NSNs fall under NAICS code 332996 - Fabricated Pipe and Pipe Fitting Manufacturing, and PSC code 4930-P - Lubrication And Fuel Dispensing Equipment. The Government is not using the policies contained in FAR Part 12, Acquisition of Commercial Items, but is open to receiving information on whether any of the items are considered commercial per FAR 2.101. Responses to the Market Survey Questionnaire and Market Research LTC Spreadsheet are due by October 4, 2024.

Notice text

This is a sources sought notice required when using only approved sources under the authority of 10 U.S.C. 3204(a)(1). DLA Land and Maritime is considering a future solicitation(s), and subsequent award, of an Indefinite Quantity Contract (IQC/LTC) for twenty-three (23) National Stock Numbers (NSNs) listed on the attached Market Research Spreadsheet.

This acquisition is for supplies for which the Government does not possess complete unrestrictive technical data; therefore, the Government intends to solicit and contract with only approved sources under the authority of 10 U.S.C. 3204(a)(1). Please provide any additional sources that may be able to manufacture these items. See attached Market Survey Questionnaire and Market Research LTC Spreadsheet for NSNs and approved sources. Please complete and return directly to the buyer.

Should a company wish to be reviewed and qualified as an “Approved Source”, they may submit an application package through the DLA Land and Maritime Alternate Offer/Source Approval Request (SAR) Program. A SAR package contains all technical data needed to demonstrate that the prospective contractor can competently manufacture the product to the same level of quality or better than the Original Equipment Manufacturer (OEM). The onus is on the contractor to document and demonstrate their product is equal to, or better, than the currently approved item which DLA Land and Maritime is procuring.

For further information, please reference the DLA Land Maritime web page shown below and click on the highlight: Alternate Offer/Source Approval Program for detailed explanation for the information and format necessary for a SAR and for the SAR approval process. http://www.landandmaritime.dla.mil/programs/altofferor/

Based upon market research, the Government is not using the policies contained in Part 12,
Acquisition of Commercial Items, in its solicitation for the described supplies or services. Interested persons may identify to the contracting officer their interest and capability to satisfy the Government’s requirement with a commercial item within 15 days of this notice. In order to make a commercial determination, we would need sufficient documentation to support commerciality.

1.    Published price lists (provide location of website).

2.    Unredacted commercial sales history (e.g. invoices showing sales to companies outside of Federal, State, or Local Government). The importance of un-redacted invoices is to assist in providing items have been sold commercially at like prices for like quantities.
