About this opportunity
The Federal Housing Finance Agency (FHFA) is soliciting litigation and other legal advisory services from law firms to support its operations across multiple practice areas including banking law, securities law, bankruptcy law, real estate law, antitrust law, administrative law, corporate governance, insurance law, conservatorships and receiverships, insolvency law, artificial intelligence, and privacy law. Services will encompass litigation representation at state and federal levels, regulatory advice concerning Fannie Mae, Freddie Mac, Federal Home Loan Banks, and related entities, and legal advisory support as needed. The contract will be structured as an Indefinite Delivery, Indefinite Quantity (IDIQ) agreement with an anticipated award of multiple contracts (likely no more than five) and a five-year ordering period from May 4, 2026 through May 3, 2031. Evaluation will employ a two-phase process, with Phase I due on the date specified on the Contract Opportunities webpage (extended from the original February 6, 2026 deadline) requiring submission of a one-page cover and maximum eight-page narrative addressing legal experience and geographic capabilities, and Phase II requiring oral presentations, personnel qualifications, pricing, conflict of interest mitigation plans if applicable, and IT security compliance documentation. Technical evaluation factors (Legal Experience and Oral Presentation/Personnel Qualifications) are significantly more important than price, though price becomes more important when technical merit is relatively equal. Questions must be submitted by 11:00 a.m. Eastern on January 29, 2026, and the FHFA will issue Advisory Down-Select notices within two weeks of the offer due date.
This procurement carries no small business set-aside. Five incumbent contractors have been identified: Arnold & Porter Kaye Scholer LLP, Cadwalader Wickersham & Taft LLP, McKool Smith A Professional Corporation, Squire Patton Boggs LLP, and Duane Morris LLP. The maximum total contract value across all awards is $104,000,000 with a minimum guarantee of $1,000 per awardee. The estimated work spans five ordering periods with approximately 23,290 to 25,460 hours per ordering period across eight standardized labor categories (Senior Partner, Partner, Counsel, Senior Associate, Mid-Level Associate, Junior Associate, Staff Attorney, and Paralegal). Contractors must propose hourly rates for each labor category, travel costs, and other direct costs, with all labor rates including overhead and standard expenses. Place of performance is Washington, DC, with work anticipated to arise across any U.S. jurisdiction, though likely with some activity concentrated in the District of Columbia region. Contractors must maintain active bar membership, comply with FHFA's Controlled Unclassified Information protocols, complete HSPD-12 background investigations for facility access, and adhere to detailed invoicing requirements including 0.10-hour billing increments with timekeeper identification and labor category breakdowns.
