About this opportunity
The Millennium Challenge Corporation (MCC) seeks to engage a contractor to provide legal advisory services in support of MCC's review, negotiation, implementation, oversight, and closeout of development programs in eligible partner countries. The contractor will advise on matters such as compact development and negotiation, selection and management of local counsel, and resolution of legal issues that arise during program implementation and closeout. Proposals will be evaluated based on technical capability including management approach, transition plan and staffing plan, as well as technical approach and past performance. Price will also be considered. Proposals are due by April 30, 2021 with questions due by May 18, 2021.
The solicitation is not set aside and contemplates a single-award, time-and-materials contract with one base year and four option years. The incumbent contractor is Hunton Andrews Kurth LLP. Services will be performed both on-site and off-site in eligible partner countries where MCC operates programs. The estimated labor hours for the prime contractor are 3,940 hours annually. Evaluation criteria include technical capability, past performance, and price.

This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6 and Subpart 13.5, as supplemented with additional information included in this notice.
The Millennium Challenge Corporation (MCC) is a U.S. Government corporation that works with developing countries to promote sustainable economic growth to reduce poverty. Since its establishment in 2004, MCC has deployed more than $10 billion in development grants through compact and threshold programs across 40+ countries. This announcement constitutes the only solicitation; quotes are being requested and a separate solicitation will not be issued.
(i) The solicitation number is 95332421Q0022. This solicitation is issued as a request for quotations (RFQ).
(ii) The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2021-05 (effective March 10, 2021).
(iii) This solicitation is not a set aside.
(iv) Contract line item number(s) and items, quantities and units of measure are included in Section B of the solicitation.
(v) The Millennium Challenge Corporation (MCC) requires a contractor to perform legal advisory services to support MCC’s review, negotiation, implementation, oversight, and closeout of MCC-funded programs with selected eligible countries (see https://www.mcc.gov/where-we-work for the list of countries in which MCC operates). This includes both country-specific legal advisory services, as well as legal advisory services in support of MCC’s overall operations.
(vi) Dates and places of delivery are included in the solicitation document. Acceptance is at the Government location and all deliveries are FOB destination, if applicable.
(vii) The provision at FAR 52.212-1, Instructions to Offerors – Commercial Items applies to this acquisition. Addenda are included in the solicitation.
(viii) The provision at FAR 52.212-2, Evaluation – Commercial Items applies to this acquisition. The following evaluation criteria are hereby included in paragraph (a) of the provision:

(xi) The clause at FAR 52.212-5, Contract Terms and Conditions Required to Implement Statutes or Executive Orders – Commercial Items, applies to this acquisition. See Section I for the additional FAR clauses that are applicable to this acquisition.
(xii) The contracting officer has determined that additional terms and conditions (MCC-specific clauses) are necessary for this acquisition. However, the terms and conditions are consistent with customary commercial practices.
