Questions MCC Response

1 Could MCC share the incumbent for this requirement, if applicable?

The incumbent is Hunton Andrews Kurth LLP (formerly Hunton & Williams LLP).

Is there a contractor that fulfilled the same or similar efforts? If yes, could you please provide the incumbent contract ID and the Contractor's name for the effort?

Yes. The incumbent contractor is Hunton Andrews Kurth LLP and the associated contract/task order number is 95332418D0016/ 95332418F0170.

Could you please tell me if the Combined Synopsis/Solicitation posted as solicitation number 95332421Q0022 will be a follow-on requirement to any work performed currently or in the past, or will this be a new requirement? If possible, can you please provide the most recent contract or task order number?

This is a follow-on requirement; see Question 2 for the contract/task order number.

Does MCC have an incumbent for this requirement? If so, please provide the contact number. See Question 2.

What commercial databases or research tools does OGC use for local laws or risk assessments?

MCC/OGC has a legal research database subscription for general legal research but we rely on local counsel and due diligence with partner governments to make local law determinations. We do not have a specific commercial database or research tool for risk assessments.

Does MCC have a forecast for travel to the foreign countries listed in the solicitation based on previous services by the incumbent or any other data?

We do not have a specific forecast. Based on the incumbent contract, we had two international trips, each involving one to two attorneys, and each for approximately one week, over the course of a five year period.

Travel costs are included in the $54,000.00 ODC estimate cited on page 10 of the solicitation (point #2 in the notes under the price tables); note that this lump sum estimate covers the five-year period of performance.

Will MCC allow price evaluation preference to be applied for HUBZone contractors in accordance with 13 CFR 126.613 and FAR 19.1307?

Yes, MCC will allow price evaluation preference to be applied for HUBZone contractors in accordance with FAR 19.1307. As such, the solicitation is hereby modified to incorporate FAR 52.219-4, Notice of Price Evaluation Preference for HUBZone Small Business Concerns (paragraph (b)(12)(i) under FAR 52.212-5 on page 33 of the RFQ).

How many labor hours were used previously by the incumbent contractor for each year?

We direct you to RFQ page 10, point #1, where we note "MCC anticipates the prime contractor level of effort [LOE] for this requirement to be approximately 3,940 hours across the five-year period of performance."

We expect the average annual labor hours for the prime contractor to be

approximately 788 hours. *Note :Theaforementionedestimatesdonot

solicitation.

How many contractor personnel were used previously by MCC to perform similar services on similar requirements?

This varied month-to-month depending on volume of work. However, the incumbent contractor typically had a core team of four staff members, which often increased based on work volume and legal specialties required. We refer you to RFQ Sections H.8 - H.10 for contractor personnel requirements.

What previous labor categories were listed by prior incumbents for similar requirements?

See Sections H.8 - H.10 of the solicitation for guidance on contractor personnel requirements; specifically, please see the key personnel qualification requirements in Section H.9 and the list of sample labor categories referenced in Section H.10. In accordance with the solicitation, all proposed labor categories must be accompanied by a job description, including the respective education and experience requirements (see point #3 on page 10 of the RFQ).

What other direct costs (ODCs) were associated with previous similar contracts?

Aside from local counsel subcontracts (which are considered ODCs), other direct costs have previously included: foreign language document translation, travel, photocopying and publication, CLE accreditation fees for trainings and presentations, and other miscellaneous expenses required to carry out the contract effort. See point #2 on page 10 of the RFQ for MCC's budget estimate for ODCs.
