About this opportunity

The Department of the Navy's Naval Facilities Engineering Command intends to award a sole-source contract modification to Tutor Perini Corporation-Nan Inc. A Joint Venture (TPC-NAN JV), valued at $19.6 million, for procurement and placement of additional armor stone to repair the Glass Breakwater at Apra Harbor, Guam. The action is justified under other than full and open competition.

The justification invokes 10 U.S.C. 3406(c) as implemented by FAR 16.507-6(b)(1), citing unusual and compelling urgency because providing a fair opportunity would result in unacceptable delays. The repairs address damage from Typhoon Sinlaku and must be completed before the peak 2026 typhoon season (late August through mid-November) to prevent catastrophic breakwater failure. The incumbent contractor is already mobilized and performing repairs from prior typhoon damage. The Contracting Officer determined the cost fair and reasonable based on an Independent Government Estimate and historically competitive rates from the existing contract. Future permanent restoration phases will be competed to the maximum extent practicable once the site is stabilized.

The modification is issued under contract N62742-22-D-1314, awarded October 12, 2024, and represents approximately three percent of that contract's total value. The period of performance is not expected to exceed one year, funded with fiscal year 2026 funds. Place of performance is Apra Harbor, Guam. No set-aside is used. The notice is classified under NAICS 237990 and PSC Y1ED.
