E.2 52.212-2 EVALUATION COMMERCIAL ITEMS (OCT 2014)
The provision at 52.212-2, Evaluation -- Commercial Items, will be used. The comparative evaluation procedures will be used in accordance with FAR 13.106-2(b)(3).
The Government will award a Firm-Fixed Price contract to the responsible quoter using a comparative evaluation. The comparative evaluation will be performed in accordance with FAR 13.106-2(b)(3). The government reserves the right to select a quotation that provides benefit to the government that exceeds the minimum but is not required to do so. Quoters are advised that quotation may exceed the requirements, but the government is not requesting or accepting alternate quotes; each response must respond to the solicitation requirement, Statement of Need (SON) the RFQ. Quoters shall submit letter of authorization from the Original Equipment manufacturer.
The government will apply the following comparative evaluation process as the basis for award:
Assess the direct comparison of one quote with another using a uniform and fair approach to determine which quote provides the government what it needs, where and when in accordance with the SON and RFQ.
Factors: Technical, Past Performance, Delivery/installation, and Price
1. Technical: Shall meet specifications stated in SON and RFQ, shall submit authorization letter from EOM. LOS form signed/applicable boxes must be checked and past performance.
2. Performance: Must submit 3 past performance for the same or similar products/services provided to other government entities or private sectors.
3. Delivery/installation: All items to be delivered within 30 days of receipt of order.
4. Price: Most advantageous to the government, quoters must use the enclosed Price Schedule.
Once one quotation is found acceptable, it is compared to the remaining ones, and the best one is chosen for the best value to the government.
The Government intends to make award selection without clarification or discussion but may determine after evaluating submitted quotes that the elements stated in FAR 13.106-2(b) for evaluation procedures are necessary and conduct them as appropriate. The Government reserves the right to make no award if no quotes meet the requirements of this solicitation.
To be eligible for award offerors must be registered in System for Award Management (SAM) prior to submission of quote in accordance with the provision at 52.212-3, Offeror Representations and Certifications -- Commercial Items. SDVOSB s must be certified and verified in VetBiz prior to submission.
Note: Quotes received not conforming to the SON, RFQ, and evaluation criteria will not be evaluated or considered for award.

B.2 Statement of Need
1. BACKGROUND
The James A. Haley Veterans Hospital (JAHVH) Medical Center is located at 13000 Bruce B. Downs Boulevard in Tampa, Florida. The JAHVH is a tertiary care teaching hospital providing services and patient care to the veterans of Central Florida. The hospital also provides to veterans a full range of inpatient and outpatient care including medicinal, surgical, psychological, and neurological care. Due the expansion of the hospital, the need to purchase new storage racks is necessary to accommodate the high volume of disposable supplies used to help treat patients in the facility.
2. SCOPE
Contractor shall provide all necessary equipment, labor, supervision, tools, materials to install new Medical Supply Distribution Unit (MSDU) storage racks at James A. Haley s New Bed Tower building located at 13000 Bruce B. Downs, Tampa, FL. Shelves shall be installed and calibrated as specified with manufacturer s recommendations.

INSTALLATION

4. CONTRACTOR RESPONSIBILITIES
4.1. The vendor is required to manage and coordinate installation at the JAHVH with the VA POC.
4.2. On-site assembly and installation of items, and performance of services identified in this document shall take place during weekend hours from 0700 to 1900 (i.e.: 7:00am to 7:00pm Eastern Standard Time.)
4.3. During the entire duration of assembly and installation, the vendor shall have a competent representative on-site as the vendor s contact, and to serve as the interface between the vendor and James A. Haley VA Hospital.
4.4. On-site representative can be the installer. All instructions provided by VA point of contact to the representative will be binding as if given to the vendor s main contact. The VA point of contact may provide specific instructions, however, only the Contracting Officer may change the terms or conditions of the contract.
4.5. Contractor is 100% responsible for compliance with all Veterans Administration (VA), local, state, and federal environmental/occupational safety laws, rules and regulations safety requirements (e.g., hard hats, safety vests).
4.6. The contractor must follow life safety codes and take necessary actions to avoid conditions that may be hazardous to health and safety of hospital personnel and patients.
4.7. The contractor is responsible for meeting all applicable OSHA and VA guidelines for safe working processes to include all upgrades/updates. All work for the duration of the contract must be performed by factory certified technicians.
4.8. The project may be an active construction site during delivery and unpacking of equipment.
4.9. The vendor shall assume responsibility for taking precautions for the vendor's (and associated subcontractors ) employees, agents, licensees, and permittees.
4.10. Contractor shall unload the equipment from the truck and deliver to specific areas designated by VA s point of contact.
4.11. Uncrating / unboxing the equipment shall be coordinated with P.O.C at the specific location.
4.12. The removal of waste and/or excess material shall be conducted through the loading dock area. It is the contractor s responsibly to dispose used crates or boxes and cleaning up areas.
4.13. Any damage to walls/floors upon delivery of equipment shall be repaired and return to its original condition at no charge to the government.
4.14. Contractor shall communicate through the VA P.O.C any required coordination requirements.
4.15. Contractor shall abide by all rules and regulations set forth by the JAHVH due to the Coronavirus (COVID-19) and have their own personal protective equipment (PPE) in use for the time they are on the JAHVH campus grounds.
5. Contractor Employee Identification:
5.1. Contractor employees must be clearly identified as contractors (not VA employees) when performing services under this contract. This includes visual (appearance), verbal (phone), and electronic (email).
5.2. The contractor must provide all employees with a contractor identification (ID) badge at the contractor s expense prior to performing work under this contract.
5.3. Contractor employees are required to display this badge at all times when performing services under this contract.
5.4. Employees released from service by the contractor must have their badge collected by the contractor.
5.5. All badges must contain an expiration date and photograph of the employee.
5.6. All contractor employees must also be required to wear VA issued badges and must display these badges at all times while in the performance of this contract and/or as instructed by the VA point of contact.
5.7. The contractor supervisor must ensure that all contractor employees display their VA issued badges.
5.8. The contractor supervisor must be responsible for managing all VA issued badges provided to contractor employees and immediately collect these badges from employees no longer working on the contract.
6. Contractor Employee Conduct:
6.1.The contractor is completely responsible for all actions and conduct of their employees.
6.2. Contractor employees must be well-groomed and neat in appearance.
6.3. Contract employees must be professional in attire and must not wear any offensive clothing. Contractor employees must conduct themselves in a socially acceptable manner appropriate for an office work environment.
6.4. Loudness, vulgarity, rudeness, or other similar offensive conduct by a contractor employee may be grounds for denying the employee further access to VA premises.
6.5. Contractor employees must not consume alcohol or illegal drugs during working hours or at any other time the employees are performing work under this contract.
7. WARRANTY OF EQUIPMENT: Government requirement for standard manufacturer industry warranty term.

VHA Supplemental Contract Requirements for Combatting COVID-19
Contractor employees who work in or travel to VHA locations must comply with the following:
Documentation requirements:
If fully vaccinated, contractors shall show proof of vaccination.
NOTE: Acceptable proof of vaccination includes a signed record of immunization from a health care provider or pharmacy, a copy of the COVID- 19 Vaccination Record Card (CDC Form MLS-319813 published on September 3, 2020), or a copy of medical records documenting the vaccination.
If unvaccinated, contractors shall show negative COVID-19 test results dated within three calendar days prior to desired entry date. Test must be approved by the Food and Drug Administration (FDA) for emergency use or full approval. This includes tests available by a doctor s order or an FDA approved over-the-counter test that includes an affiliated telehealth service.
Documentation cited in this section shall be digitally or physically maintained on each contractor employee while in a VA facility and is subject to inspection prior to entry to VA facilities and after entry for spot inspections by Contracting Officer Representatives (CORs) or other hospital personnel.
Documentation will not be collected by the VA; contractors shall, at all times, adhere to and ensure compliance with federal laws designed to protect contractor employee health information and personally identifiable information.
Contractor employees are subject to daily screening for COVID-19 and may be denied entry to VA facilities if they fail to pass screening protocols. As part of the screening process contractors may be asked screening questions found on the COVID-19 Screening Tool. Check regularly for updates.
Contractor employees who work away from VA locations, but who will have direct contact with VA patients shall self-screen utilizing the COVID-19 Screening Tool, in advance, each day that they will have direct patient contact and in accordance with their person or persons who coordinate COVID-19 workplace safety efforts at covered contractor workplaces. Contractors shall, always, adhere to and ensure compliance with federal laws designed to protect contractor employee health information and personally identifiable information.
Contractor must immediately notify their COR or Contracting Officer if contract performance is jeopardized due to contractor employees being denied entry into VA Facilities.
For indefinite delivery contracts: Contractor agrees to comply with VHA Supplemental Contract Requirements for any task or delivery orders issued prior to this modificationwhen performance has already commenced.
