About this file

This is a Worker Protection and Investment Certification Form required by the Commonwealth of Pennsylvania for contractors and grantees working on state contracts, including opportunities with the Pennsylvania Game Commission and Bureau of Law Enforcement. The form mandates that all contractors certify compliance with Pennsylvania's labor and workforce safety laws, encompassing thirteen specific statutory requirements including the Construction Workplace Misclassification Act, Employment of Minors Child Labor Act, Minimum Wage Act, Prevailing Wage Act, Equal Pay Law, and several others related to wage payment, workplace safety, and employee verification. Contractors must have a duly authorized official execute the certification under penalty of law, confirming the contractor's compliance status with all applicable Pennsylvania state labor and workplace safety regulations.

The certification carries significant legal consequences for non-compliance or false certification, including potential contract termination and three-year ineligibility to bid on future Commonwealth contracts under the debarment and suspension provisions of 62 Pa. C.S. 531. Contractors are required to immediately report any changes in their compliance status to the Purchasing Agency, and any false certification is subject to penalties under 18 Pa. C.S. 4904 for unsworn falsification to authorities. The form, designated BOP-2201, was published on February 7, 2022, and serves as a prerequisite certification document for the vehicle upfits contract opportunity with the Pennsylvania Game Commission's Bureau of Law Enforcement.
