WMR001 Hazardous/Universal, Medical, and Electronic Waste Disposal and Emergency Response - Request for Response

This is a Request for Response (RFR) document issued by the Commonwealth of Massachusetts Operational Services Division (OSD) for the reopening of Statewide Contract WMR001, which establishes multiple-award contracts for hazardous waste, medical waste, electronic waste, and emergency response services. The procurement encompasses nine service categories: hazardous waste collection and disposal, household hazardous waste collection events, mercury-containing products and batteries collection and disposal, sharps collection and disposal, medical/infectious waste collection and disposal, pharmaceutical waste collection and disposal, electronic waste collection and recycling, tank collection and disposal, and emergency response services with immediate response actions. Bidders may respond to one or more categories. The initial release date was March 18, 2025, with the reopen announced September 10, 2025. The Bidders Conference was held March 26, 2025, with a recording available for reopening participants. Questions must be submitted by September 29, 2025, with official answers published by October 3, 2025. The bid amendment deadline is October 6, 2025, and quotes are due November 5, 2025, at 2:00 PM. Notification of apparent successful bidders is estimated for December 5, 2025, with an estimated contract start date of December 15, 2025. The contract has a five-year term from July 1, 2025, through June 30, 2030, with no renewal options, although performance and payment obligations may extend up to one year beyond termination for agreements executed during the contract period.

The estimated contract value is $32 million, based on historical analysis of vendor sales reports from FY2021 through FY2024 under the prior contract FAC110. The Strategic Sourcing Team intends to award a minimum of three bidders per category for the initial solicitation, with no minimum for the reopening. Bidders must make a minimum 1% Supplier Diversity Plan commitment, with at least 25% of evaluation points allocated to supplier diversity initiatives. No surcharges for transportation, fuel, energy, or insurance are permitted throughout the contract duration. All awarded contractors must maintain commercial general liability insurance of at least $1 million per occurrence and $3 million aggregate, with $5 million excess/umbrella coverage, and name the Commonwealth as an additional insured. Bidders must demonstrate at least three years of industry experience and provide a Certificate of Good Standing from the Massachusetts Department of Revenue. Contractors must comply with prevailing wage requirements for applicable construction services and submit to a 1% statewide contract administration fee based on total dollar amounts received from eligible entities. Pricing must remain firm for 90 days from submission, with increases limited to once annually and requiring four months' notice. All contractors are required to submit quarterly sales, supplier diversity expenditure, and environmentally preferable products reports. Category 2 bidders must provide two pricing plans (per-load and per-unit) for a two-year period at bid submission, with subsequent annual pricing due 12 months in advance for each contract year.

REQUEST FOR RESPONSE WMR001 - Hazardous/Universal, Medical, and Electronic Waste Disposal and Emergency Response

Table of Contents Page iv Document Sensitivity Level: High during development; Low once published.

INTRODUCTION AND BID OVERVIEW

Summary Description of Procurement The Commonwealth of Massachusetts and the WMR001 Strategic Sourcing Team (SST) are reopening Statewide Contract WMR001 to solicit additional Bidders for the acquisition of Hazardous/Universal, Medical, and Electronic Waste Disposal and Emergency Response services. Any new awards resulting from this contract reopening will be added to WMR001, The resulting Contract will serve as the primary Statewide Contract used by Executive Agencies of the Commonwealth for the goods and services covered by the Contract. WMR001 replaced The resulting Contract will replace Statewide Contract # FAC110. The Contract will also be available for use by other Eligible Entities.

The purpose of this procurement is to establish contract(s) with qualified companies that provide waste management services: (1) in accordance with all applicable federal and state regulations; (2) in a manner that will provide the best value in waste management services for State Agencies; and (3) which will minimize the State’s and the Contractor’s liability related to waste transportation, management and disposal.

Bidders may bid in one or more of the categories represented in this RFR:

Category 1:Hazardous Waste Collection and Disposal
Category 2:Household Hazardous Waste (HHW) Collection Events
Category 3:Mercury-Containing Products and Batteries Collection and Disposal
Category 4:Sharps Collection and Disposal
Category 5:Medical/Infectious Waste Collection and Disposal
Category 6:Pharmaceutical Waste Collection and Disposal
Category 7:Electronic Waste (e-waste) Collection and Recycling
Category 8:Tank Collection and Disposal
Category 9:Emergency Response Services (ERS) and Immediate Response Action (IRA)

All nine categories are being reopened to add more vendors.

1.1 Introduction to Climate and Sustainability for Statewide Contracts The Commonwealth of Massachusetts is committed to prioritizing and promoting Environmentally Preferable Products and Services in state contracts with both vendors and buyers, and collaborating with businesses that embrace sustainable practices in their facilities and operations. Climate is a priority of the Commonwealth and awarded vendors will be required to provide additional reporting related to their business practices.

The Operational Services Division (OSD) is mandated through 801 CMR 21.06 (4) (e) and EO515 to promote Climate and Environmentally Preferable Products and Services and sustainable business practices. In support of EO604, EO594, Senate Bill 9: An Act Creating a Next Generation Roadmap for Massachusetts Climate Policy, and the Green Communities Act, and in its capacity as Massachusetts’ procurement agency, OSD plays a pivotal role in advancing climate-responsible purchasing. OSD is committed to partnering with our business community to offer more products and services that meet the goals of the Commonwealth.

To help OSD understand the climate and environmental practices, policies, and initiatives adopted by our Statewide Contractors, Bidders should make note of the enhanced RFR language in Section 5: Climate and Environmental Requirements. This section includes the following subsections:

· Climate and Environmental Practices Form: This form replaces the Environmental Practices Form. The form allows Bidders to communicate existing business practices that foster a sustainable approach to conducting their operations and reduce environment or public health impacts. No Bidder will be awarded a contract without completing this mandatory form. Bidders should review RFR Section 5: Climate and Environmental Practices Form for more information.

· Post-Award Climate and Environmental Vendor Reporting: Awarded vendors will be required to provide OSD with specific climate and environmental data to meet the goals of Executive Order EO604: Establishing the Office of Climate Innovation and Resilience within the Office of the Governor. This includes collaborating with OSD to assist vendors to understand and meet the reporting requirements. Bidders should review RFR Section 5.1.3: Post Award Climate and Environmental Vendor Reporting for more information.
