About this file

This document is a Justification and Approval for Other Than Full and Open Competition (JOTFOC) for a federal contract opportunity. The Bureau of Reclamation requires the State of California Department of Water Resources (DWR) to provide support in the collection of data and maintenance of its Hydromet stations and snow courses. The anticipated base and four option-year contract will be Firm-Fixed Price with a total estimated value of $1,924,668. The JOTFOC justifies the sole source award to DWR based on their unique qualifications, as they have maintained the Hydromet and snow courses for over 30 years and are co-located with Reclamation's stations, enabling efficient data sharing and responsiveness. An intent to sole source notice was posted on SAM.gov, but no other interested sources were identified. The Contracting Officer will determine the prices are fair and reasonable using simplified acquisition procedures.

JUSTIFICATION AND APPROVAL FOR OTHER THAN FULL AND OPEN

COMPETITION

In accordance with FAR 6.302 or FAR 13.501(a), the proposed contractual action is pursuant to the statutory authority identified in paragraph 4. This template is required for actions over the Simplified Acquisition Threshold (unless the procurement is acquired as a limited source IAW FAR 8.405-6 or is an Exception to Fair Opportunity IAW FAR 16.505(b)(2)).

1. Agency and Contracting Activity (FAR 6.303-2(b)(1)). U.S. Department of the Interior, Bureau of Reclamation, Acquisitions Services, Supplies and Service Branch.

2. Nature/Description of Action (FAR 6.303-2(b)(2)). The Bureau of Reclamation requires the State of California Department of Water Resources (DWR) support in the collection of data and the maintenance of its Hydromet stations and snow courses. The anticipated base and four option-year contract will be Firm-Fixed Price.

3. Description of Supplies/Services (FAR 6.303-2(b)(3)). Reclamation requires the support of the gathering and correlating information and data pertinent to the annual forecasts of seasonal water supply, which includes the maintenance of snow courses and Hydromet stations. In addition, Reclamation requires the support to coordinate with Federal agencies and others in performing such work and obtaining data provided by those stations. The anticipated dollar value of this contract will be $1,924,668.00. The costs cover a base year and four 1-year option periods.

5. Demonstration of Contractor’s Unique Qualifications (FAR 6.303-2(b)(5)).

The DWR is uniquely qualified to fulfill the requirements of this contract. DWR has maintained the hydromet and snow courses for over 30 years. Reclamation owns various hydromet gage stations which are co-located upstream with state owned stations that help measure and gather data for water flow. The data gathered from these stations is shared with State, and Federal agencies as well as the public. The State and Federal agencies are co-located at the Joint Operations Center in Sacramento, and having these agencies co-located, makes for efficiency in the sharing of data and responsiveness from the agencies during times of emergency management, such as during flood control season. The State requires the data have the ability to be queried on the State’s website. Reclamation is not currently able to receive the transmitted data in a format that will cross over into the States’ required database; therefore, DWR gets the data transmitted directly from Reclamation stations, and converts it into the format necessary to meet the requirement.

As a result, Reclamation utilizes the expertise of the State for servicing their stations, which ensures accurate data for both the State and Federal entities. Reclamation does not currently have the ability to perform this work in-house, nor the ability to convert the transmitted data into the required format. Allowing the State perform these functions ensures Reclamation will properly meet their data submission requirement in a timely and cost effective manner.

6. Description of efforts made to maximize competition (FAR 6.303-2(b)(6)).

Since Reclamation’s hydromet stations are co-located with the State’s stations, and the State collects the data and maintains the stations, no other entity can provide Reclamation with the water flow data. An intent to sole source notice was posted on SAM.gov on 2/23/2024 and closed on 03/06/2024. The notice requested firms to provide evidence demonstrating ability to meet the stated requirement.

7. Determination of Fair and Reasonable Cost (FAR 6.303-2(b)(7)).

The contractor's proposed prices will be evaluated in accordance with the techniques listed in FAR 13.106-3(a)(2)(ii) & (iii) in order for the Contracting Officer to determine the prices are fair and reasonable.

8. Description of Market Research Conducted (FAR 6.303-2(b)(8)).

An Intent to Sole Source was posted on SAM.gov on 02/23/2024 and closed on 03/06/2024, in order to allow potential contractors an opportunity to demonstrate their interest. No responses were received. Furthermore, the Central Valley Operations Office examined the possibility of funding a hydrologic engineering position to manage the hydromet activities. Upon closer examination of costs for training, equipment and vehicles that would need to be purchased, it was determined that the cost savings were greater in having DWR conduct the hydromet activities. They have been maintaining the hydromet stations and collecting the data for the past 30 years.

9. Any Other Supporting Facts (FAR 6.303-2(b)(9)). N/A.

10. Listing of Interested Sources (FAR 6.303-2(b)(10)). State of California Department of Water Resources, Division of Flood Management, California Data Exchange Center, Sacramento, CA.

11. Actions Taken to Remove Barriers to Competition (FAR 6.303-2(b)(11)). An intent to sole source notice was posted to SAM.gov in an attempt to identify potential sources for this and future requirements.
