Summary of ITB S-29100-00007902: Wastewater Monitoring
This Invitation to Bid (ITB) is issued by the Oregon Department of Corrections (ODOC) Purchasing and Contracts Division to establish a price agreement for wastewater monitoring services at correctional facilities. The solicitation seeks bids from established manufacturers or authorized dealers to provide pathogen and narcotic testing services, hardware for sample collection including flow pace auto samplers for up to 12 institutions, sample collection kits, weekly sample collection with shipping, and data collection and delivery services. ODOC is implementing this program to establish baseline measurements of narcotics in wastewater systems across its correctional facilities to help evaluate the effectiveness of drug reduction strategies. The ITB was issued on October 12, 2023, with a deadline for clarification questions and modification requests by October 18, 2023, at 9:00 AM Pacific Time, and a bid closing date of October 27, 2023, at 9:00 AM Pacific Time. The initial contract term is two years from the effective date, with ODOC retaining the option to extend for additional two-year periods not to exceed a maximum of ten years total. Testing must cover 21 controlled substances and narcotics including morphine, heroin, cocaine, fentanyl, methamphetamine, THC, benzodiazepines, and related compounds. Delivery of goods and services is required within 30 calendar days of order and must be F.O.B. destination to one of twelve ODOC correctional facilities listed in Attachment A, with no deliveries permitted on weekends or state holidays.
The ITB specifies that ODOC has no historical spend data for this service and will award one or multiple price agreements to the lowest responsive responsible bidder or bidders based on responsiveness and responsibility criteria. Bidders must submit complete pricing for hardware, sample collection kits, per-sample testing costs, and monthly data delivery fees on the pricing form in Section 6. The pricing structure is firm for the initial two-year term and may be adjusted only once per term with supporting documentation and cost justification; however, price increases cannot result in higher profit margins than at the contract's inception. Contractor must maintain comprehensive insurance including commercial general liability of $1,000,000 per occurrence and $2,000,000 annual aggregate, and must provide a Certificate of Insurance within seven calendar days of award. All goods must be new, unused, and produced from current production components; gray market goods are prohibited. Bidders must provide three references from comparable contracts within the past 24 months and respond to responsibility inquiries regarding lawsuits, bankruptcy filings, administrative actions, and tax law compliance dating back five to 24 months. ODOC reserves the right to reject any or all bids, cancel the solicitation, and pursue single or multiple awards at its discretion.
