About this file
This is a Warranty Bond document for the City of Napa's Fire Station No. 3 Driveway Repair Project, involving the City of Napa (a California charter city), a contractor, and a surety company. The bond guarantees the contractor's work and subcontractors' performance for a one-year warranty period following the city's acceptance of the project. The warranty covers any defects in materials or workmanship discovered during this period, with the surety bound to the city for up to 15% of the final contract price.
The bond outlines specific obligations for the contractor, including repairing any discovered defects at their sole expense or reimbursing the city for any losses resulting from failure to make required repairs. The document specifies that any disputes will be governed by California law and heard in Napa County Superior Court, with the surety responsible for the city's attorney fees and costs. The bond includes provisions for notice to the surety and explicitly waives certain provisions of the California Civil Code, creating a comprehensive legal instrument to protect the city's interests in the driveway repair project.
