52.217-5 Evaluation Of Options JUL 1990

The following have been modified:

FAR 52.212-1 ADDENDUM

Request for Quote (RFQ)

The U.S. Army has a requirement for Land Mobile Radio System Maintenance Support for the Network Enterprise Center (NEC) at Fort Irwin, CA.

This requirement is being procured as a firm fixed price, brand name only, 100% set aside for small business sources who have been approved by Motorola to provide the required maintenance services specified in the PWS incorporated in this solicitation.

Resulting contract will be for one base year, two option years (52.217-9) and the six month option to extend services (52.217-8).

This is a commercial item acquisition using FAR Part 12 and FAR Part 13.

FAR 52.212-1 INSTRUCTIONS TO OFFERORS-COMMERCIAL ITEMS - ADDENDUM

In addition to the requirements incorporated by reference at 52.212-1 below, Offeror’s quotes shall provide/include:

a. Please total all CLINs in your quote to show an overall final price. Include all shipping charges FOB Destination.

Include all applicable taxes.

b. Pursuant to 15.403-1(c)(3)(ii)(B) and (C) Prohibition on obtaining certified cost and pricing data, in order to make a fair and reasonable determination for this sole source acquisition, the contracting officer is requesting all Offerors to submit prices paid for the same or similar commercial items under comparable terms and conditions by both Government and commercial customers. This may take the form of redacted invoices that show the Offeror’s quoted price does not exceed the price paid by other customers for the same services in the marketplace. In other words, Offerors shall provide with their quote supporting documentation to show that the Government is paying no more than the Offeror’s most preferred pricing.

c. Please include the delivery lead-time.

d. Provide the following information with your offer:

Registered in SAM.GOV: Yes _____ No _____ TAX ID (US firms only):

CAGE Code:

UEI Number:

POC Name, Phone number, and E-mail address:

e. The Government will award a Firm Fixed-Price contract resulting from this solicitation, on an all or none basis to the lowest priced Offeror who meets all the terms and conditions of the solicitation. This requirement is for Land Mobile radio hardware/ software maintenance renewal of existing government owned equipment. Please reference clause 52.212-2 for further details.

f. This requirement will be paid using Wide Area Work Flow (WAWF).

g. Complete the following clauses (located below in Contract Clauses):

FAR clause 52.212-3 “Offeror Representations and Certifications” Commercial items. (This clause does not have to be completed if you are SAM.GOV registered, at (https://sam.gov/))

h. Offerors who submit a revision to the RFQ must identify when submitting to the POC, e.g. Revision 1, Revision 2, etc.

i. Offeror must provide proof of authorized Motorola partner to perform the LMR services contained in the PWS.

The Government will validate through Motorola the authenticity of the partner documentation submitted in response to the solicitation.

j. Non-compliance with any of the instructions in 52.212-1 or this Addendum to 52.212-1 may result in rejection of your offer. The Government intends to award based upon quotes as received.

k. Quote shall be good for minimum of 30 calendar days after close of solicitation.

l. Questions about the solicitation shall be submitted on or before 13 December 2022.

Additional Information:

1. Vendor invoicing shall not be submitted prior to proof of delivery that validates the items have been received and accepted by the Government.

2. Per DFARS 252.232-7003 – Electronic Submission of Payment Requests, the vendor shall submit combination payment requests (invoice and receiving report) using Wide Area Work Flow (WAWF). Receipt and Acceptance (WAWF-RA) or other methods authorized by the Contracting Officer. Failure to comply could result in delayed payment.

3. This solicitation includes the option to extend services (FAR 52.217-8). The evaluation will consider the possibility that the option can be exercised at any time during any contract performance period, and can be exercised in increments, so long as the total extension of performance (created by the exercise(s) of the option) does not exceed six months. The value of 52.217-8 per month will be determined at the time of award. The amount will be based on the last option year at the time of exercising 52.217-8. When exercised the amount will be adjusted to be relevant to the option year the contract is actually in. For comparison purposes, each Offeror’s option year cost will be divided equally by 12 months to determine an estimated monthly amount for the extension period. The monthly rate will then be multiplied by 6 to determine the estimated price for the 6-month extension period. The evaluation will therefore assume that the addition of the price or prices of any possible extension or extensions under FAR 52.217-8 to the total price for the basic requirement and the total price for the priced options has the same effect on the total price of all proposals relative to each other, and will not affect the ranking of proposals based on price, unless, after reviewing the proposals, the Government determines that there is a basis for finding otherwise. This evaluation will not obligate the Government to exercise any option under FAR 52.217-8.

52.212-2 EVALUATION--COMMERCIAL PRODUCTS AND COMMERCIAL SERVICES (NOV 2021)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

The Government will award a Firm Fixed-Price Contract on an all or none basis to the lowest priced technically acceptable offeror that meets all the terms and conditions of the solicitation and is determined to be fair and reasonably priced. In order to receive an award, the quote shall be technically acceptable and determined to be fair and reasonably priced.

All offerors shall be listed in terms of price, lowest to highest, and then the apparent lowest-priced offeror will be technically evaluated in terms of meeting all the terms and conditions of the solicitation. If the lowest-price offeror is evaluated as technically unacceptable, the next lowest-price offeror will be technically evaluated, continuing this process as necessary until the lowest priced technically acceptable offer is identified.

The lowest priced technically acceptable proposal will be evaluated to determine a fair and reasonable price. If the quote cannot be determined fair and reasonable based on the quotes as received, the Government reserves the right to reject the quote and continue the process to find the quote that is both technically acceptable and fair and reasonable in price.

(b) The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

(End of provision)
