Sole Source Justification and Approval Under FAR 13.501
1. Contracting Activity: U.S. Army Contracting Command, Aberdeen Proving Ground (ACC-APG), Huachuca Division, 2133 Cushing Street, Building 61801, Fort Huachuca, AZ 85613-7070. U.S. Army Contracting Command.
2. Description of Action: ACC-APG is seeking approval to award a firm fixed price contract to a Motorola-authorized service provider to support the Network Enterprise Center (NEC) at Fort Irwin, CA in management, operations, and maintenance of its existing Land Mobile Radio (LMR) system. Although, as explained below, market research has identified multiple sources approved by Motorola that can provide the required services, this Justification and Approval (J&A) is required because competition will be limited to only Motorola-authorized providers. This J&A, therefore, requests approval to award a contract on a brand name basis for a base year and two option years, plus the 6-month extension (52.217-8) of services, with a total value of $1,201,773.40. The Government projects award for 21 November 2022. The period of performance will be from 21 November 2022 through 20 November 2025. Fiscal Year 2023 Operations and Maintenance, Army funds will be used. For this requirement the NAICS code is 334220: Radio and Television Broadcasting and Wireless Communications Equipment Manufacturing. The size standard for these businesses is 1,250 employees. Based on market research described under Section 8 of this J&A, this will be a 100% set aside for small business.
3. Description of Supplies/Services: An LMR system is a line of site radio communications system intended for use by users in vehicles or on foot consisting of subscriber devices and system infrastructure that support those devices. LMR systems are used by emergency first responder organizations such as police, fire, and ambulance services, as well as non-first responder organizations such as Department/Directorate of Public Works Organizations. A trunked LMR system is a complex radio system that also consists of servers, routers, and switches. The LMR system includes radio frequency channels that use talk groups.
The seamless movement, installation, and integration of equipment during maintenance and outages is required on the Fort Irwin LMR System. Pursuant to this, the contractor will be a Motorola Premier Service Partner and will have expert level knowledge on the following systems and applications: Motorola Astro25 v7.11 LMR Systems, Motorola switching and router configuration methods and practices, Motorola v7.11 Unified Event Manager (UEM), Motorola v7.11 User Configuration Manager (UCM), Motorola v7.11 Zone Configuration Manager (ZCM), Motorola MCC 7500 Elite Admin and Elite Dispatch configurations and functionality. Furthermore, Motorola software is proprietary, owned and developed exclusively by Motorola. Until the Army provides an enterprise solution to upgrade the existing LMR systems nationwide, the Government shall maintain the current fielded legacy Motorola LMR system.
In 2014, the Government contracted with Motorola Corporation to install the Fort Irwin Land Mobile Radio Digital trunked Radio System to provide installation-wide First for Fiscal Year 2026. Therefore, Fort Irwin is dependent on the Defense Communications and Army Transmissions Systems (DCATS) program office, through the Network Enterprise Technology Command (NETCOM), for funding and replacement of its current LMR system. Fort Irwin does not have a projected date for upgrading the system. Maintenance must continue or the post will run the risk of no communication available for Emergency Medical Service (EMS) personnel.
2. Discontinue Maintenance: This is not a feasible option because without the LMR system maintenance, contract equipment would not get repaired and could endanger the safety of the Fort Irwin community. This would put the availability of communications with EMS personnel at high risk and would significantly reduce support for training exercises, family members, civilians & soldiers. Without factory-level support and repairs, the equipment would eventually become inoperable, thereby risking the availability of communications to EMS personnel.
The LMR system is the predominant public safety communication system on Fort Irwin and is relied upon all hours of the day by emergency personnel, law enforcement and others to minimize risks related to life, health and /or safety.
6. Efforts to Obtain Competition: In accordance with FAR Subpart 5.2 - Synopses of Proposed Contract Actions, the Government posted a sources sought notice at www.
Sam.gov from 13 June 2022 through 21 June 2022 that informed industry that the Government intended to issue a brand name, sole source to Motorola and that all responsible Motorola Authorized Service Provider sources were welcome to submit a bid, proposal, or quotation (as appropriate) that the agency shall consider. The results of that sources sought notice is discussed within this J&A at Section 8. Market Research.
7. Actions to Increase Competition: Fort Irwin is dependent on the Defense Communications and Army Transmissions Systems (DCATS) program office, through NETCOM. Replacement of the current Motorola LMR system is a resourcing decision by NETCOM, or higher Army organization. NEC Fort Irwin follows the direction of the Program Executive Office Enterprise (PEO) Information System for the LMR. The PEO maintains decision authority on whether and when to field a next generation LMR system and, as of yet, has not provided any update on deploying the next LMR system.
For the reasons stated in section 5 of this J&A, only competition among authorized Motorola Authorized Service Providers is acceptable. The approved brand name, sole source J&A will be posted along with the solicitation.
In an effort to ensure future efforts are competed to the maximum extent practicable, the Government will continue to conduct periodic and meaningful market research to determine if there are changes in the marketplace that would enable future competitive actions, such as the potential development of similar products and/or product support in the marketplace that provide the same functionality, whether Motorola releases ownership rights or increases the number of authorized service providers for its products, and review of the economic feasibility to procure a new LMR system. If it is determined that future requirements no longer require brand name compatibility, the
