About this file
This document is an amendment to Solicitation W91QVN24R0033 for wastewater and stormwater monitoring services at USAG Humphreys in the Republic of Korea. The amendment sets forth the following key details:
The solicitation is open to all sources, but the U.S.-ROK Status of Forces Agreement precludes the U.S. Government from granting contractor or technical representative status. All offerors, including U.S. sources, must obtain the requisite business licenses directly from the ROK government and comply with all applicable ROK laws and regulations. Proposals must be submitted in Korean Won (KW) currency only. The contracting officer will determine if offerors demonstrate the necessary authorization and capacity to perform the contract. All other terms and conditions of the solicitation remain unchanged.

The following items are applicable to this modification:
NOTICE TO OFFERORS
a. The purpose of this amendment is to add below.
All sources may submit a proposal as applicable. However, the Republic of Korea (ROK)-United States (U.S.) Status of Forces Agreement (SOFA), precludes the U.S. Government from granting Invited Contractor or Technical Representative Status to any offeror, for this requirement. All sources submitting a proposal, as applicable, including U.S. sources, must already have, or obtain the requisite business licenses directly from the ROK Government, and conduct business in accordance with all applicable ROK laws, including but not limited to, rules and policies regarding labor, taxation, and immigration. Any contractor not already doing business in Korea, must submit adequate verification in its initial proposal - that it has the requisite business licenses directly from the ROK Government to perform the contract and the capacity to conduct business in accordance with all applicable ROK laws, including but not limited to, rules and policies regarding labor, taxation, and immigration. If an initial proposal does not fully demonstrate this authorization and capacity, it will not be further considered for award.
Whether an offeror demonstrates this authorization and capacity shall be determined by the Contracting Officer.
“All offerors interested in competing for this requirement are required to submit their price proposal in Korean Won(KW) only. A proposal submitted in currency other than Korean Won will not be considered for award.”
b. All other terms and conditions remain unchanged.
