52.212-2 EVALUATION--COMMERCIAL PRODUCTS AND COMMERCIAL SERVICES (NOV 2021)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

See below ADDENDUM to FAR 52.212-2 EVALUATION-COMMERCIAL ITEMS (OCT 2014)

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

ADDENDUM to FAR 52.212-2 EVALUATION-COMMERCIAL ITEMS (OCT 2014)

(1) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

Award will be made to the responsible Offeror submitting the Lowest Price, Technically Acceptable (LPTA) offer that satisfies all terms and conditions of the solicitation. Offers will be evaluated for acceptability, but not ranked using the non-price factors/subfactors. All non-price factors and subfactors will be rated as either “acceptable” or “unacceptable”. In order to be considered for award, there must be an “acceptable” rating in every non-price factor/subfactor. In other words, a rating of “unacceptable” for any factor or subfactor will result in the entire offer being rated “unacceptable”.

The following ratings will be used in evaluating all non-price factors and subfactors except Past Performance:

Technical Acceptable/Un-acceptable Ratings

Rating Description

Acceptable Proposal clearly meets the minimum requirements of the solicitation.

Un-acceptable Proposal does not clearly meet the minimum requirements of the solicitation.

FACTOR 1, Technical:

Subfactor 1. Prime Contractor’s Business Registration Certificate: The offeror shall be evaluated on submitted valid copy of business registration certificate for Information and Communication Construction Business (정보통신

공사업 등록증) or Electrical Engineering (전기공사업 등록증) issued by ROK Government. The Business Registration Certificate of a subcontractor cannot substitute for the prime contractor’s.

Subfactor 2. Prime Contractor’s Prior Experience: The offeror shall be evaluated on submitted evidence of at least two (2) years of experience within the last seven (7) years in Maintenance and Repair service of ESS specifically for ACS, CCTV and intercom systems within the last seven (7) years from the issuance date of this solicitation. The offeror(s) shall provide the evidence of prior experiences as below. The experience of a subcontractor cannot substitute for the prime contractor’s experience.

- The title of the contract/project.

- A Description of work completed.

- Name of contract/project

- Length of contract/project (year/month/date - year/month/date)

- Value of contract/project in KW for total amount

- Complete name of point of contact (including e-mail and phone number) at Client/RA

Subfactor 3. Contract Manger (CM) Experience: The offeror shall be evaluated on submitted resume of CM with a minimum two (2) years of experience as a CM for maintenance and repair of ESS within the last seven (7) years from the issuance date of this solicitation. Resume must clearly identify in the following format:

- Position title held

- A clear description of qualifying work experience

- Employer name, phone number, name of validating personnel and email address of validating personnel

- Length of work experience (year/month/date – year/month/date)

Subfactor 4: Prime Contractor's Information Technology(IT) Solution Qualification verification: The offeror shall be evaluated on submitted evidence of research laboratory/design/problem-solving ability as a documented letters. The evidence documents of a subcontractor cannot be substituted for the prime contractor's.

- A letter of agreement demonstrating its access to development level support from the Original Equipment Manufacturer (OEM) for to get a ATO due to DHA/Local Information Assurance(IA) compliance

- A certification of approved laboratory facility from the government, either in Korea or U.S.

- Solution design documents about deployment plan for servers, backup plan, High availability, integration between third-party solution, existing and new devices such as HID(AERO/Mercury)

- A letter of acknowledgement of understanding of PWS

Subfactor 5: Prime Contractor's Information Technology(IT) Manpower Qualification verification: The offeror shall be evaluated on submitted a certification of the related solution training from the manufacturer about the assigned engineer for this project. The training certificate of a subcontractor manpower's cannot be substituted for the prime contractor's.

- A certification of training / class

- A certification of Employment

FACTOR 2, Past Performance:

Past performance shall be evaluated on an acceptable/unacceptable basis. Offerors are authorized to provide information on the problems encountered on the identified contracts and the Offeror’s corrective actions. The Government may ascertain past performance information on the Offeror from sources other than the references provided.

The offeror shall have recent and relevant past performance in performing maintenance of ESS or similar types of services. Recent past performance is within the last seven (7) years as of the closing date of the solicitation.

The past performance will be evaluated for all offeror’s proposals by the Contract Specialist/Contracting Officer in the following manner:

(i) Reference will be contacted by phone or e-mail to verify contents in detail explanation and to determine record of compliance with contract requirements, accuracy of reports, technical and quality awards/certificates.

(ii) The Government reserves the right to obtain past performance information from any reasonable source available, including Government database in order to evaluate past performance.

Past Performance Evaluation Ratings

Rating Description

Acceptable

Based on the offeror’s performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort, or the offeror’s performance record is unknown. (See note below)

Unacceptable

Based on the offeror’s performance record, the Government has no reasonable expectation that the offeror will be able to successfully perform the required effort.

NOTE: In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the offeror may not be evaluated favorably or unfavorably on past performance (see FAR 15.305(a)(2)(iv)).

Therefore, the offeror shall be determined to have unknown past performance. In the context of acceptability/unacceptability, “unknown” shall be considered “acceptable”

Factor 3, Price: Proposed price will be reviewed to ensure completeness, reasonableness, and balance. The pricing proposals will be evaluated in accordance with FAR 15.404. Regarding balance, a proposal may be rejected if the Contracting Officer determines the lack of balance poses an unacceptable risk to the Government.

Price is not scored. The Government will review the price proposal to determine the extent to which it is adequate, complete, and reasonable to assess the offeror's understanding of the solicitation. The lowest price for award purposes will be the combined total of the effective period of five (5) years from the date of award. Price must include all CLINs as listed on the Price Schedule. The Government intends to evaluate proposals and award a contract without discussions. Therefore, Offerors are instructed that submitted proposals should contain their best pricing.

FAR Clause 52.217-8 Option to Extend Services. As part of price evaluation, the Government will evaluate its option to extend services (FAR Clause 52.217-8, Option to Extend Services) by adding one-half of the Offeror’s final option period prices to the Offeror’s total price. Thus, the Offeror’s total price for the purpose of evaluation will include the base period, 1st option, 2nd option, 3rd option, 4th option, and one-half of the 4th option. Offerors are required only to price the base and four (4) options. Offerors shall not submit a price for the potential one-half year extension of services period.
