5. Submittal Requirements
Factor A. Technical Capability: All subfactors under Technical factor are of equal importance and shall be evaluated on an acceptable or unacceptable basis. A rating of unacceptable for any factor or subfactor will result in technically unacceptable rating. Failure to provide documents addressed below will result in a rating of “Unacceptable”.
Subfactor 1: Prime Contactor’s Business Registration – The offeror shall submit a copy of both English and Korean version of the Prime Contractor’s valid and current Certificate of Business Registration (사업자 등록증명) for the business item category of “Repair for internet and computing technologies, networking and telecommunications, and radio (통신공사, 통신장비, 유지보수 사업자 등록증)” issued by the Republic of Korea (ROK) Government National Tax Service (NTS). The business registration of subcontractor cannot be substituted for the prime contractor’s certificate.
Subfactor 2: Personnel Experience of Contract Manager (CM) – The offeror shall submit a resume (이력서/경력증명서) of CM to present verifiable minimum of two (2) year working experience within the last five
(5) years from the closing date of this solicitation in Repair services for CCTV, internet and computing technologies, networking and telecommunications, and radio or similar type of experience. The offeror shall provide evidence of CM relevant experience as required below, but not limited to:

- Length of contract/project (yy/mm/dd – yy/mm/dd)
- Value of contract/project in KW for total amount
- Phone number of POC of Client/ Reference
Factor B. Past Performance: The past performance factor considers the offeror’s demonstrated recent and relevant record of performance in supplying services that meet the contract requirements. Past performance will be evaluated on an acceptable/unacceptable basis. Offerors are required to identify contracts, both commercial and government contracts for the same or similar service. The Government may ascertain past performance information on the offeror from sources other than the contracts/references provided. In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the offeror may not be evaluated favorably or unfavorably on past performance (see FAR 15.305 (a)(2)(iv)). Therefore, the offeror shall be determined to have unknown past performance. In the context of acceptability/unacceptability, “unknown” shall be considered “acceptable”.
Recent Past Performance is within the last five (5) years as of the closing date of the solicitation. Relevant past performance are those that are the “same or similar” services based on size, scope, complexity, and contract type.
Offerors’ recent and relevant past performance may consist Government and/or commercial contracts for the prime offeror and/or for each major subcontractor who performed during the past five (5) years from the closing dated of this RFP.
The offeror shall provide the following information for each past performance reference:
Contract Number:
Description of Performance:
Total Contract Amount:

The offeror’s past performance will be evaluated in accordance with FAR 15.305(a) (2) in the following manner:
Acceptable (A) – Based on the offeror’s performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort, or the offeror’s performance record is unknown. The offeror(s) has demonstrated satisfactory timeliness and quality of services within the last five (5) years.
Unacceptable (U) – Based on the offeror’s performance record, the Government has no reasonable expectation that the offeror will be able to successfully perform the required effort and satisfactory timeliness and quality of services within the last five (5) years.
Note: In addition, as part of the Responsibility Determination, the Contracting Officer will evaluate past performance to determine the offeror’s capability to perform the contract. Failure to submit data or lack of any performance history will not in itself be a reason for determination of non-responsibility. The Contracting Officer is not limited to the information provided. The Contracting Officer may use this data along with data obtained from other sources the Contracting Officer determines appropriate to obtain sufficient information on the offeror’s past performance to make a responsibility determination.
Factor C. Price Proposal: The offeror shall complete the pricing information for each Contract Line Number (CLIN) identified and Exhibit Line Item Number (SCLIN) that has quantity identified to include:
(a) Schedule of Services (CLINs/SubCLINs) of the RFP for all five (5) years;
(b) Prices shall be in local currency (Korean Won)
(c) Any escalation in option year pricing shall be identified
Pricing shall be included for all CLINs and Sub-CLINs (Prices shall be in Korean Won). Price analysis will be performed to determine the total evaluated price to support the selection of the lowest priced technically acceptable offeror. All fixed priced CLINs will be added to the total extended prices of requirements.
The offeror(s) shall round all unit prices to the nearest whole Korean Won (KRW) thereby eliminating the use of any decimal points.
(1) Completeness. The Offeror shall complete the pricing information for all CLINs, and Sub-CLINs identified for all five (5) years.
(2) Price Realism. Price Analysis in conjunction with Technical Analysis will be used to perform a price realism analysis to determine if the price is realistic for the work to be performed. Price proposals, which are unrealistically low, will be deemed reflective of a failure to comprehend the complexity and risk of the proposed contractual requirement and may be grounds for rejection of the proposal.
(3) Price Reasonableness. Price should also reflect fair market value and be reasonable when compared to the independent Government estimate, previous prices for same or similar services and/or when compared among other technically acceptable offers.
(4) Unbalanced Pricing. As part of the price evaluation, proposals will be reviewed to identify any unbalanced pricing. IAW FAR 15.404-1(g)(3), Unbalanced Pricing, a proposal may be rejected if the Contracting Officer determines the lack of balance poses an unacceptable risk to the Government.
Note 1: The Government will examine price proposals for artificially low unit prices. Offers found to be unreasonably high, unrealistically low (an indication of “buy-in”), or unbalanced, may be considered unacceptable and may be rejected on that basis.
Note 2: Price is not scored. The Government will review the price proposal to determine the extent to which it is reasonable, realistic, and consistent with the technical proposal. The lowest price for award purposes will be the combined total of the effective period five (5) years from the date of award. Price shall include all CLINs and Sub-CLINs as listed on the Price Schedule including all five (5) years. The Government intends to evaluate proposals and award a contract without discussions. Therefore, Offerors are instructed that submitted proposals should contain their best pricing.
Option Clause 52.217-8. The Offeror’s total price for the purpose of evaluation will include the 1st year, 2nd year, 3rd year, 4th year, 5th year, and one-half of the 5th year. Offerors are required only to price the five (5) years. Offerors shall not submit a price for the potential one-half year extension of services period.
End of FAR 52.212-1 Instruction to Offerors – Commercial Items (Apr 2014), Addendum
(End of provision)
52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014)
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered.
Award will be made to the responsible Offeror submitting the Best Value Lowest Priced, Technically Acceptable (LPTA) offer that satisfies all terms and condition of the solicitation.
The following ratings will be used in evaluating all non-price technical factors.
Acceptable Proposal clearly meets the minimum requirements of the solicitation.
Unacceptable Proposal does not clearly meet the minimum requirements of the solicitation.
• FACTOR A – TECHNICAL CAPABILITY –
Subfactor 1: Prime Contactor’s Business Registration – “Repair for internet and computing technologies, networking and telecommunications, and radio (통신공사, 통신장비, 유지보수 사업자 등록증)” issued by the Republic of Korea (ROK) Government National Tax Service (NTS).
Subfactor 2: Personnel Experience of Contract Manager (CM) Subfactor 3: Personnel Experience of Technicians
• FACTOR B – PAST PERFORMANCE
• FACTOR C – PRICE
Factor A. Technical Capability: All technical factors shall be evaluated on an acceptable or unacceptable basis. A rating of unacceptable for any factor will result in technically unacceptable rating. Failure to provide below requirements will result in a rating of “Unacceptable”.
- Prime Contactor’s Business Certificate of Registration: The prime contractor shall possess and submit the copies of both English and Korean versions of the following valid and current business certificates;
Subfactor 1: Prime Contactor’s Business Registration – Prime Contractor’s valid and current Certificate of Business Registration (사업자 등록증명) for the business item category of “Repair for internet and computing technologies, networking and telecommunications, and radio (통신공사, 통신장비, 유지보수 사업자 등록증)” issued by the Republic of Korea (ROK) Government National Tax Service (NTS).
Note: The business registration of subcontractor cannot be substituted for the prime contractor’s certificate.
Subfactor 2: Personnel Experience of Contract Manager (CM) – CM to present verifiable minimum of two (2) year working experience within the last five (5) years from the closing date of this solicitation in Repair services for CCTV, internet and computing technologies, networking and telecommunications, and radio or similar type of experience. The offeror shall provide evidence of CM relevant experience.
Subfactor 3: Personnel Experience of Technicians – A minimum of four (4) technicians to present verifiable minimum of one (1) year working experience within the last five (5) years from closing of this solicitation in Repair services for CCTV, internet and computing technologies, networking and telecommunications, and radio or similar type of experience. The offeror shall provide evidence of each proposed technician relevant experience.
Factor B. Past Performance: Past performance shall be evaluated on an acceptable/unacceptable basis.
The following ratings will be used in evaluating Past Performance:
Note: In the case of an Offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the Offeror may not be evaluated favorably or unfavorably on past performance (see FAR 15.305 (a) (2) (iv)).
Therefore, the Offeror shall be determined to have unknown past performance. In the context of acceptability/unacceptability, “unknown” shall be considered “acceptable.
Offerors are authorized to provide information on the problems encountered on the identified contracts and the Offeror’s corrective actions. The offeror shall have recent and relevant past performance in the same or similar projects related to this requirement. Recent past performance is within the last five (5) years from the solicitation closing dates. Relevant past performances those that are the same or similar services based on size, scope, complexity, and contract type. The offeror shall describe its past performance on contracts it has held which are of similar scope and magnitude to that which is detailed in the solicitation. The Government may ascertain past performance information on the Offeror from sources other than the references provided.
Past Performance of offerors will be evaluated based on the following processes:
(1) Review of the detailed explanation submitted by offerors, demonstrating the relevance of the references to the requirements of the solicitation.
(2) References will be contacted by phone to verify contents in detail explanation and to determine record of compliance with contract requirements, accuracy of reports, technical and quality awards/certificates.
(3) The Government reserves the right to obtain past performance information from any reasonable source available, including the Government database; Past Performance Information Retrieval System (PPIRS) website http://www.ppirs.gov in order to evaluate offerors’ past performance. Also CPARS, if applicable, will be used for evaluation of the past performance.
Note: As part of the Responsibility Determination, the Contracting Officer will evaluate past performance to determine the offeror’s capability to perform the contract. Failure to provide data or lack of any performance history will not in itself be a reason for determination of non-responsibility. The Contracting Officer is not limited to the information provided. The Contracting Officer may use this data along with data obtained from other sources the Contracting Officer determines appropriate to obtain sufficient information on the offeror’s past performance to make a responsibility determination
Factor C. Price: Price analysis will be conducted for each proposal to ensure completeness, realism, reasonableness and balance as follows:
Price analysis will be performed to determine the total evaluated price to support the selection of the lowest priced technically acceptable offeror. To determine total evaluated price, all fixed priced CLINs will be added to the total extended prices of Requirements.
The following applies to that evaluation:
Acceptable Based on the Offeror’s performance record, the Government has a reasonable expectation that the Offeror will successfully perform the required effort, or the Offeror’s performance record is unknown (See note below)
Unacceptable Based on the Offeror’s performance record, the Government has no reasonable expectation that the Offeror will be able to successfully perform the required effort http://www.ppirs.gov/
(1) Completeness. The Offeror shall complete the pricing information for all CLINs and Sub-CLINs identified for all five (5) years. Any underlying assumptions including proposed escalation rates between base and subsequent option periods shall be clearly explained.
(2) Price Realism. Price Analysis in conjunction with Technical Analysis will be used to perform a Price Realism Analysis to determine if the price is realistic for the work to be performed. The proposal will be evaluated using price analysis techniques to determine whether the proposal reflects a thorough understanding of the PWS, and whether the price proposed is realistic for the work to be performed and is consistent with approaches described in the technical proposal.
Price shall include all CLINs and Sub- CLINs as listed on the Price Schedule, including all five (5) years. The Government intends to evaluate proposals and award a contract without discussions. Therefore, Offerors are instructed that submitted proposals should contain their best pricing.
Option Clause 52.217-8. As part of price evaluation, the Government will evaluate its option to extend services (FAR Clause 52.217-8 - Option to Extend Services) by adding one-half of the Offeror’s final option period price to the Offeror’s total price. Thus, the Offeror’s total price for the purpose of evaluation will include the 1st year, 2nd year, 3rd year, 4th year, 5th year, and one-half of the 5th year. Offerors are required only to price the five (5) years.
Offerors shall not provide a price for the potential one-half year extension of services period.
(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
The Government reserves the right, based on the Government’s best interests, to make a determination to: 1) award without discussions; 2) make multiple awards for this requirement; 3) establish a competitive range in order to conduct discussions.
If an award cannot be made on initial offer and the Government determines discussions to be necessary, the competitive range will be established in considering technical, past performance and price evaluation factors to conduct discussions in accordance with FAR 15.306(a)(3)); and/or 4) make no award if, upon evaluation, none or the proposals are deemed likely to meet the requirements.
