Contract Specialist (CS) at jason.e.stirnaman2.civ@army.mil and the Contracting Officer (KO) at kenneth.l.mitchell.civ@army.mil

EVALUATION CRITERIA

http://fedgov.dnb.com/webform mailto:kenneth.l.mitchell.civ@army.mil

Award of this contract will be made on a best value trade off basis in accordance with Federal Acquisition

Regulation (FAR) Part 15.3, Source Selection, as supplemented by the Defense Federal Acquisition Regulation

Supplement (DFARS) and the Army Federal Acquisition Regulation Supplement (AFARS). The Government will select the best overall proposal based upon an integrated assessment of three (3) evaluation factors: Technical

Capability, Past Performance and Price.

FACTORS TO BE EVALUATED

The following factors shall be used to evaluate offers: Factor 1 - Technical Capability, Factor II - Past Performance, and Factor III - Price. The non-price factors, Technical Capability and Past Performance, when combined, are significantly more important than Price. Among the non-price factors, Technical Capability is significantly more important than Past Performance.. Within Factor I, Technical Capability, there are two sub-factors: Sub-factor I -

Technical Approach and Sub-factor II - Key Personnel. These Technical Capability sub-factors are of equal importance. To receive consideration for award, a rating of no less than “Acceptable” must be achieved for Factor I, Technical Capability. Within Factor II, Past Performance, a rating of no less than “Satisfactory/Neutral Confidence” must be achieved for Factor II.

As a basis for award, trade-offs between price and non-price factors are permitted. Therefore, the Government reserves the right to award to other than the lowest price. However, the degree of importance of price as a factor in determining award could become greater depending on the equality of the proposals evaluated in the non-price factors. The greater the equality of proposals within the non-price factors, the more important price becomes in selecting the best value to the Government. The Government will evaluate proposed prices for reasonableness using cost and/or pricing analysis techniques. The Government intends to award one contract as a result of this solicitation.

FACTOR I. TECHNICAL CAPABILITY

Sub-factor I. Technical Approach:

The Government will evaluate the extent to which the Offeror’s methods and approach have satisfied the requirements specified in the RFP. The proposal will be evaluated to determine the extent to which each requirement has been addressed; the extent to which the proposed approach is workable and the end results achievable; and the extent to which the Offeror is expected to be able to successfully complete the tasks of the PWS.

Specifically, the evaluation will focus on the extent to which the offeror proposes a complete, feasible approach to managing, staffing, resourcing, and scheduling tasks:

a. The Quality Control Plan addresses monitoring, inspecting, and correcting deficiencies in a manner that is appropriately tailored to the work in the PWS Section 1.6.1 at Arlington National Cemetery

b. The Work Plan that includes a staffing plan and equipment lists demonstrating the capability of performing the work outlined under each task as it pertains to staffing, allocating resources, and key personnel. Further, the equipment list shall describe all equipment to be utilized to perform tasks identified in the PWS Section

5 and Technical Exhibits 3, 3A, 3B, 3C, 3D, and 7B. The work plan shall also describe in narrative annual, seasonal, and daily considerations inherent to working at Arlington National Cemetery.

c. The extent to which the offeror’s team’s previous work experience (within the past five years) is similar in size, scope, character (cemetery or work that demonstrates high level of care such as work around monuments), and complexity.

Sub-factor II: Key Personnel:

The Government will evaluate the extent to which the Key Personnel matrix clearly identifies the names of each individual proposed for each Key Personnel position identified in the PWS and the degree to which the offeror’s proposed key personnel meet or exceed the requirements of the PWS; whether binding commitment letters are provided by key personnel; and the degree to which the offeror’s proposed key personnel meet or exceed the requirements of the PWS Seciton 1.6.10.

Combined Technical/Risk Rating Method

A Combined Technical/Risk rating methodology will be used. A single rating for each Technical Capability sub-factor will be assigned. From those ratings, an overall Technical Capability Factor rating will be determined. The

Combined Technical/Risk Ratings, excerpted below focus on the strengths, weaknesses, risk and uncertainties of the offeror’s proposal. The color rating depicts how well the offeror’s proposal meets the requirements. This rating scale will be used to evaluate Factor I – Technical Capability.

Color

Rating

Adjectival

Rating

Description

Blue Outstanding Proposal indicates an exceptional approach and understanding of the requirements and contains multiple strengths.

Purple Good Proposal indicates a thorough approach and understanding of the requirements and contains at least one strength.

Green Acceptable Proposal indicates an adequate approach and understanding of the requirements.

Yellow Marginal Proposal has not demonstrated an adequate approach and understanding of the requirements.

Red Unacceptable Proposal does not meet requirements of the solicitation and, thus, contains one or more deficiencies and is unawardable.

FACTOR II – PAST PERFORMANCE:

The Government will evaluate past performance of similar, recent and relevant questionnaires, assessing how well the contractor performed and how relevant the submissions are with respect to the current requirement. Recency is defined as performance within three years of the due date of the proposals. Relevancy is defined as having similar dollar value, scope, and complexity. Offerors are advised that the Government may use past performance information obtained from centralized past performance databases and sources other than those identified by the offeror and the information obtained may be used for both the responsibility determination and the best value decision. Questionnaires should demonstrate relevant contracts which are entered into with Government agencies or private sectors. For contractors with no relevant past performance, the Government may take into account information regarding the past performance of predecessor companies, key personnel with relevant past performance, or subcontractors that will perform key aspects of the requirement. If the offeror has no relevant past performance, this must be stated in the offeror’s proposal submission. The offeror’s proposal will then be listed as

“past performance unknown,” and its Past Performance factor will be given a neutral confidence rating.

Past Performance Relevancy Rating Method

Past Performance will be evaluated to assess the offeror’s relevancy of recent efforts accomplished to determine the probability of meeting the solicitation requirements. The currency, relevancy, source and context of the information, as well as general trends in the contractor’s performance will be considered. Each recent contract considered will be evaluated individually for relevancy and assigned an adjectival relevancy rating as described below.

Adjectival Rating Description

Very Relevant Present/past performance effort involved essentially the same scope and magnitude of effort and complexities this solicitation requires.

Relevant Present/past performance effort involved similar scope and magnitude of effort and complexities this solicitation requires.

Somewhat Relevant Present/past performance effort involved some of the scope and magnitude of effort and complexities this solicitation requires.

Not Relevant Present/past performance effort involved little or none of the scope and magnitude of effort and complexities this solicitation requires.

Performance Confidence Assessments Rating Method

All recent contracts evaluated as Very Relevant, Relevant, and Somewhat Relevant for which past performance information is provided will be considered; and based on all of the recent, relevant past performance information, a performance confidence rating will be assigned for each offeror, as described below.

Adjectival Rating Description

Substantial Confidence Based on the offeror’s recent/relevant performance record, the

Government has a high expectation that the offeror will successfully perform the required effort.

Satisfactory Confidence Based on the offeror’s recent/relevant performance record, the

Government has a reasonable expectation that the offeror will successfully perform the required effort.

Neutral Confidence No recent/relevant performance record is available or the offeror’s performance record is so sparse that no meaningful confidence assessment rating can be reasonably assigned.

The offeror may not be evaluated favorably or unfavorably on the factor of past performance.

Limited Confidence Based on the offeror’s recent/relevant performance record, the

Government has a low expectation that the offeror will successfully perform the required effort.

No Confidence Based on the offeror’s recent/relevant performance record, the

Government has no expectation that the offeror will be able to successfully perform the required effort.

FACTOR III - PRICE:

The total price will be computed by adding the total for all base period CLINs and all options CLINs. The total prices for CLINs X0001 and X0002 will be computed from the totals in the price model Excel spreadsheet.

Additionally, the Government will evaluate the Option to Extend Services under FAR clause 52.217-8 "Option to Extend Services" by adding one-half of the Offeror's final option period total evaluated price to the Offeror's total price. Thus, the Offeror's Total Evaluated Price (TEP) will include the base period and all applicable option periods. The TEP will be assessed in accordance with the guidelines in FAR 15.404 to determine that the price is fair, reasonable, and balanced.

MINIMUM AND MAXIMUM AMOUNTS

Minimum and Maximum Amounts, Indefinite Delivery, Indefinite Quantity (IDIQ)

The total amount of all orders placed against this contract, awarded from this solicitation, shall not exceed the dollar sum of the awardee’s total evaluated price plus a 25% reserve amount to account for emerging requirements over a five (5) year period of performance (12-month base period and four, 12-month option periods). The guaranteed minimum amount is $2,500.00. The minimum guarantee shall be satisfied by issuance of a task order concurrent with award of the contract. The contract maximum represents the total requirement for the life of the contract (including options, if exercised).

SURVEILLANCE SERVICES OR EQUIPMENT (AUG 2020)

(a) Definitions. As used in this clause--

Backhaul means intermediate links between the core network, or backbone network, and the small subnetworks at the edge of the network (e.g., connecting cell phones/towers to the core telephone network). Backhaul can be wireless (e.g., microwave) or wired (e.g., fiber optic, coaxial cable, Ethernet).

Covered foreign country means The People's Republic of China.

Covered telecommunications equipment or services means--

(1) Telecommunications equipment produced by Huawei Technologies Company or ZTE Corporation (or any subsidiary or affiliate of such entities);

(2) For the purpose of public safety, security of Government facilities, physical security surveillance of critical infrastructure, and other national security purposes, video surveillance and telecommunications equipment produced by Hytera Communications Corporation, Hangzhou Hikvision Digital Technology Company, or Dahua Technology

Company (or any subsidiary or affiliate of such entities);

(3) Telecommunications or video surveillance services provided by such entities or using such equipment; or

(4) Telecommunications or video surveillance equipment or services produced or provided by an entity that the

Secretary of Defense, in consultation with the Director of National Intelligence or the Director of the Federal Bureau of Investigation, reasonably believes to be an entity owned or controlled by, or otherwise connected to, the government of a covered foreign country.

Critical technology means--

(1) Defense articles or defense services included on the United States Munitions List set forth in the International

Traffic in Arms Regulations under subchapter M of chapter I of title 22, Code of Federal Regulations;

(2) Items included on the Commerce Control List set forth in Supplement No. 1 to part 774 of the Export

Administration Regulations under subchapter C of chapter VII of title 15, Code of Federal Regulations, and controlled--

(i) Pursuant to multilateral regimes, including for reasons relating to national security, chemical and biological weapons proliferation, nuclear nonproliferation, or missile technology; or

(ii) For reasons relating to regional stability or surreptitious listening;

(3) Specially designed and prepared nuclear equipment, parts and components, materials, software, and technology covered by part 810 of title 10, Code of Federal Regulations (relating to assistance to foreign atomic energy activities);

(4) Nuclear facilities, equipment, and material covered by part 110 of title 10, Code of Federal Regulations (relating to export and import of nuclear equipment and material);

(5) Select agents and toxins covered by part 331 of title 7, Code of Federal Regulations, part 121 of title 9 of such

Code, or part 73 of title 42 of such Code; or

(6) Emerging and foundational technologies controlled pursuant to section 1758 of the Export Control Reform Act of 2018 (50 U.S.C. 4817).

Interconnection arrangements means arrangements governing the physical connection of two or more networks to allow the use of another's network to hand off traffic where it is ultimately delivered (e.g., connection of a customer of telephone provider A to a customer of telephone company B) or sharing data and other information resources.

Reasonable inquiry means an inquiry designed to uncover any information in the entity's possession about the identity of the producer or provider of covered telecommunications equipment or services used by the entity that excludes the need to include an internal or third-party audit.

Roaming means cellular communications services (e.g., voice, video, data) received from a visited network when unable to connect to the facilities of the home network either because signal coverage is too weak or because traffic is too high.

Substantial or essential component means any component necessary for the proper function or performance of a piece of equipment, system, or service.

(b) Prohibition.

(1) Section 889(a)(1)(A) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L.

115-232) prohibits the head of an executive agency on or after August 13, 2019, from procuring or obtaining, or extending or renewing a contract to procure or obtain, any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. The Contractor is prohibited from providing to the Government any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system, unless an exception at paragraph (c) of this clause applies or the covered telecommunication equipment or services are covered by a waiver described in FAR

4.2104.

(2) Section 889(a)(1)(B) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L.

115-232) prohibits the head of an executive agency on or after August 13, 2020, from entering into a contract, or extending or renewing a contract, with an entity that uses any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system, unless an exception at paragraph (c) of this clause applies or the covered telecommunication equipment or services are covered by a waiver described in FAR 4.2104. This prohibition applies to the use of covered telecommunications equipment or services, regardless of whether that use is in performance of work under a Federal contract.

(c) Exceptions. This clause does not prohibit contractors from providing--

(1) A service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or

(2) Telecommunications equipment that cannot route or redirect user data traffic or permit visibility into any user data or packets that such equipment transmits or otherwise handles.

(d) Reporting requirement.

(1) In the event the Contractor identifies covered telecommunications equipment or services used as a substantial or essential component of any system, or as critical technology as part of any system, during contract performance, or the Contractor is notified of such by a subcontractor at any tier or by any other source, the Contractor shall report the information in paragraph (d)(2) of this clause to the Contracting Officer, unless elsewhere in this contract are established procedures for reporting the information; in the case of the Department of Defense, the Contractor shall report to the website at https://dibnet.dod.mil. (ii) Within 10 business days of submitting the information in paragraph (d)(2)(i) of this clause: Any further available information about mitigation actions undertaken or recommended. In addition, the Contractor shall describe the efforts it undertook to prevent use or submission of covered telecommunications equipment or services, and any additional efforts that will be incorporated to prevent future use or submission of covered telecommunications equipment or services.

(e) Subcontracts. The Contractor shall insert the substance of this clause, including this paragraph (e) and excluding paragraph (b)(2), in all subcontracts and other contractual instruments, including subcontracts for the acquisition of commercial items.

(End of clause)

52.211-16 VARIATION IN QUANTITY (APR 1984)

(a) A variation in the quantity of any item called for by this contract will not be accepted unless the variation has been caused by conditions of loading, shipping, or packing, or allowances in manufacturing processes, and then only to the extent, if any, specified in paragraph (b) below.

(b) The permissible variation shall be limited to:

(e) Multiple offers. Offerors are encouraged to submit multiple offers presenting alternative terms and conditions, including alternative line items (provided that the alternative line items are consistent with subpart 4.10 of the
