About this file
This is an amendment (0003) to solicitation W91QEX25Q0005 that provides government responses to contractor questions regarding the lease of two electric forklifts for warehouse operations at the Logistics Readiness Center in Miami. The amendment clarifies that while the original requirement specified a 3,000-lb and 6,000-lb forklift capacity, the government will accept higher capacity forklifts (4,500-lb instead of 3,000-lb, and 5,500-lb instead of 6,000-lb) as long as the physical size remains small enough to maneuver in warehouse spaces and the price doesn't increase significantly. The maximum height requirement is 16 feet, and propane forklifts are not acceptable.
Key details addressed include: subcontracting is allowed but the prime contractor maintains responsibility for maintenance and coordination; only one battery charger is required for both forklifts; the period of performance includes a 12-month base period and four 12-month option periods starting February 5, 2025; and the current incumbent is US Military Corp under contract W91QEX-20-P-0007 valued at $115,380.00. The amendment also corrects an erroneous technical volume requirement regarding web-based site access that was included in Amendment 0002. Questions were due by November 29, 2024, at 9:00 AM EST.

GOVERNMENT RESPONSES
Contractor Question 1. With regards in the subject solicitation, may I clarify if sub-contracting is allowed?
Government Response 1. The Government has no privity on subcontractors. The responsibility to provide maintenance on a timely manner, coordinating the quarterly maintenance and load test of each forklift is the responsibility of the prime contractor.
Contractor Question 2. While sourcing the specified equipment, I have encountered challenges obtaining a 3,000-lb capacity forklift. Vendors have proposed substituting it with a 5,000-lb capacity forklift, which aligns with the remaining operational requirements outlined in the solicitation.
Before proceeding with my response, I would like to confirm if this substitution would be acceptable to the government. This adjustment ensures timely delivery while meeting the required safety and operational standards.
Government Response 2. The reason for a 3,000-lb capacity forklift is to be able to access small spaces within our warehouse and load/unload small delivery trucks. The size of the forklift is the issue, not the capacity. If the contractor can provide a small forklift with a higher capacity without increasing the cost, the Government will accept it.
Contractor Question 3. I have a question about the requirements listed in the solicitation. On page 50 of the solicitation document in paragraph (c) Technical Volume, it states the Govt requires unfettered access for four hours to an offeror’s web-based site. I wanted to confirm that this is a requirement for this solicitation.
Government Response 3. Addendum to 52.212-1 (see Amendment 0002) has been corrected.
Contractor Question 4. I would like to confirm whether it is permissible to source the two forklifts required under the solicitation from different companies, provided all equipment and services meet the specifications and compliance requirements outlined in the Statement of Work.
Government Response 4. The Government has no privity on subcontractors. The responsibility to provide maintenance on a timely manner, coordinating the quarterly maintenance and load test of each forklift is the responsibility of the prime contractor.
Contractor Question 5. To confirm the Start date-DELIVERY DATE will be 05-FEB-2025
Government Response 5. As specified in the solicitation, the start date/delivery date for this requirement is 5 February 2025.
Contractor Question 6. I have a question on if there are any damages to the forklifts that result from negligence on the renter's part. I see in page 12 section 4.3 that "All maintenance, repairs, parts, and labor shall be inclusive of the rental agreement price". Is there a separate billing section that covers any accidents or damage to the equipment by the renter?
Government Response 6. No, there is not a separate billing section that covers any accidents or damage to the equipment by the renter. The contractor will repair the forklift and bill the Government separately from the monthly rental. The Government will modify the purchase order to add for the damages.
Contractor Question 7. Is it okay if I provide a 4000lb electric soft cushion tire forklift instead of a 3000lb? The net capacity exceeds what is necessary and the price is the same.
Government Response 7. Yes, it is okay to provide a 4,000-lb forklift electric soft cushion tire forklift instead of a 3,000-lb forklift as long and the sizes are similar.
Contractor Question 8. The solicitation mentions one charger must be supplied. Do you want one, or two chargers? One for each forklift.
Government Response 8. No, the Government requires one charger to charge both forklifts
Contractor Question 9. The solicitation states this is for 12-month rental for 2 forklifts and charge, but the number of CLINS leads me to believe it is 12 months over course of 5 years. Is that the case? Any assistance would be greatly appreciated.
Government Response 9. This requirement is for two (2) forklifts with a 12-month base period and four (4) 12-month option periods.
Contractor Question 10. May I please have the previous incumbent and award information?
Government Response 10. The requirement was awarded under W91QEX-20-P-0007, US Military Corp, $115,380.00.
Contractor Question 11. Is there an incumbent for this contract? If so, what is the contract number and value?
Government Response 11. Yes, there is an incumbent for this requirement. The requirement was awarded under W91QEX-20-P-0007, US Military Corp, $115,380.00.
Contractor Question 12. Can you clarify these submission requirements?
- "(c) Technical Volume: The Government plans to evaluate the quoters technical capabilities to meet the agency needs as per the Performance Work Statement by requesting unfettered access to their respective web-based site. The access will be for a period of four (4) hours "at no cost or obligation to the Government...."
- "(d)Minimum Experience: The contractor shall have a minimum of 5 years experience training and consulting media monitoring service. The customer service personnel shall be an expert in the field with extensive, practical knowledge and experience with the company’s web-based interface used to monitor the media."
These requirements appear to relate to a different type of procurement and do not align with the scope of this solicitation, which involves forklift rentals and maintenance services. Could you please confirm whether these requirements are applicable to this solicitation?
Government Response 12. Addendum to 52.212-1 (see Amendment 0002) has been corrected.
Contractor Question 13. I had a couple of questions regarding the addendum posted on November 21st. I am seeing some things that don't seem to line up with the PWS.
Contractor Question 13.1. Do any of these highlighted verbiage relate to the forklift rental/lease?
Government Response13.1. Addendum to 52.212-1 (see Amendment 0002) has been corrected.
Contractor Question 13.2. Also, I see the NAICS code in the verbiage does not match what is in sam.gov.
Government Response 13.2. Addendum to 52.212-1 (see Amendment 0002) has been corrected.
Contractor Question 13.3. Just want to confirm the submission is Antonio and Catherine on December 17th and not Catherine and Sonia.
Government Response 13.3. Addendum to 52.212-1 (see Amendment 0002) has been corrected.
Contractor Question 13.4. … is there a previous incumbent? If so, please provide the award#, vendor name and award amount.
Government Response 13.4. Yes, there is an incumbent. The requirement was awarded under W91QEX-20-P-0007, US Military Corp, $115,380.00.
Contractor Question 13.5. I see this is a base+ four option years. Do you have a tentative start date?
Government Response 13.5. Addendum to 52.212-1 (see Amendment 0002) has been corrected.
Contractor Question 14. Can you please clarify the questions below?
Contractor Question 14.1. We are quoting (15) total pieces of equipment?
Government Response 14.1. No, the requirement is for two (2) forklifts for a period of one 12-month base period and four (4) 12-month option periods.
Contractor Question 14.2. We have 6,000lb propane forklifts or 5,000lb electric forklifts. Is propane acceptable?
Government Response 14.2. No, propane is not acceptable.
Contractor Question 14.3. Is there a ceiling or a doorway the forklift has to go through? What is the height?
Government Response 14.3. Yes, the forklifts have to fit through the loading dock doors width.
The ceiling height is over 20 feet.
Contractor Question 14.4. What is the maximum height you need to reach with each forklift?
Government Response 14.4. The maximum height for each forklift is 16 feet.
Contractor Question 15. With regards on the above subject, may I ask the following clarifications:
Will you accept a 5500 lbs forklift in lieu of the 6000 lbs request? Are larger sizes exceptable in lieu of the request (i.e.. 4500 lbs instead of 3000 lbs)
Government Response 15. Yes, we can accept a 5500 lbs forklift and a 4500 lbs forklift as long as the price does not change considerably.
