COMPLAINTS

If you have complaints about this procurement, it is preferable that you first attempt to resolve those concerns with the responsible contracting officer. However, you can also protest to Headquarters, AMC. The HQ, AMC-Level Protest Program is intended to encourage interested parties to seek resolution of their concerns within AMC as an Alternative Dispute Resolution forum, rather than filing a protest with the General Accounting Office or other external forum. The AMC protest decision goal is to resolve protests within 20 working days from filing. To be timely, protests must be filed within the periods specified in FAR 33.103. The access will be for a period of four (4) hours "at no cost or obligation to the Government".. The determination of which contractor that will be chosen is after the initial screening of all quotes received. The Contracting Officer’s approach will be based on the Lowest Priced Technical Acceptable (LPTA) source selection process in accordance with Federal Acquisition Regulation FAR Part 13.106-2 Evaluation of Quotations or Offers. If contacted the quoter shall provide the Contracting Officer with a user name and password for use of by three (3) evaluators. The access will be requested no later than 48 hours after receipt of all quotes. The request will be sent via e-mail. If the quoter does not respond within 24 hours, then the Contracting Officer will move on to the next lowest priced quoter. Once the information is received it will be provided to the technical evaluation chairperson. He/she shall follow the checklist in Attachment 1 of this RFQ only. If a quoter is deemed unacceptable in any area then the quote is deemed Technically Unacceptable. Quoters are reminded that both independent data and data provided by Quoters in their proposals may be used by the Government to evaluate offeror past performance. However, the burden of providing thorough, complete, and current past performance information as requested in this paragraph remains with the Quoters. Quotes that do not contain the information requested by this paragraph risk rejection or a less than acceptable performance rating by the Government. All past performance comments received will be taken into account and could affect the overall rating. The overall past performance evaluation is a subjective decision based on the whole of all data received. In the case of an quoter without a record of relevant past performance or for whom information on past performance is not available or sparse that no meaningful past performance rating can be reasonably assigned, the quoter may not be evaluated favorably or unfavorably on past performance (see FAR 15.305(a)(2)(iv)).

VIII. NOTE: In accordance with FAR 13.004, the following information regarding quotations is provided: A quotation is not an offer and, consequently, cannot be accepted by the Government to form a binding contract. Therefore, issuance by the Government of an order in response to a supplier’s quotation does not establish a contract. The order is an offer by the Government to the supplier to buy certain supplies or services upon specified terms and conditions. A contract is established when the supplier accepts the quote.

IX. If the Government issues an order resulting from a quotation, the Government may (by written notice to the supplier, at any time before acceptance occurs) withdraw, amend, or cancel its quote.

X. Except when it is determined in accordance with FAR 17.206(b) not to be in the

Government's best interests, the Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement.

Evaluation of options will not obligate the Government to exercise the option(s). As part of price evaluation, the government will evaluate its option to extend.

XI. (See 13.302-4 for procedures on termination or cancellation of purchase orders.)

In accordance with the solicitation requirements, the successful Quoter shall provide a point of contact of sufficient authority to authorize changes at the performance location. In order for this and other specifications to be met, the Government must maintain privities of contract directly with the service provider. QUOTES FROM THIRD PARTIES WILL BE

CONSIDERED NON-RESPONSIVE AND WILL BE EXCLUDED FROM

CONSIDERATION FOR AWARD.

NOTE: Quoters are cautioned that due to security protocol and firewall infrastructure regulations, some electronic Microsoft based application attachments with embedded pictures, and other formatting may be cause for the security protocol and firewall infrastructure regulations under US Southern Command’s email server it is the contractor’s responsibility to verify and certify the Government received a quoter’s submission timely.

SECTION M - EVALUATION FACTORS FOR AWARD

52.212-2 EVALUATION--COMMERCIAL PRODUCTS AND COMMERCIAL SERVICES (NOV 2021)

(a) The Government will award a contract resulting from this solicitation to the responsible quoter whose quote conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate quotes:

The basis for award is Lowest Price Technically Acceptable (LPTA). The apparent successful quoters shall have satisfactory past performance. This procurement is being conducted under FAR Part 12 and 13.5 procedures. All quotes shall provide three (3) current and relevant references. Failure to comply will result in not being considered for award.

A current reference is an order within the last 36 months. A relevant reference is an order of approximately the same size, scope and complexity. If an offeror does not submit any or less than (3) references, the offeror shall affirmatively state it only has a certain number of references or state it has none at all. Such quoters shall be assigned a past performance rating of "Neutral" if the quoters affirmatively states it has no references.

Quoters who fail to provide (3) references or affirmatively address a lack of references shall be considered technically unacceptable as regarding past performance and will not receive a "Neutral" rating.

Technical Acceptability is defined as meeting all specifications in the Statement of Work solicitation. You must address each specification and each deliverable. Quotes shall be ranked in order of lowest price to highest price.

The lowest-priced quote shall be evaluated first. If the lowest-priced quote is technically acceptable, no other quotes will be evaluated.

(b) Options. The Government will evaluate quotes for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that a quote is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

As part of price evaluation, the Government will evaluate its option to extend services (FAR Clause 52.217-8 - Option to Extend Services) by adding one-half of the Quoter’s 4th option period prices to the Quoter’s total price.

Thus, the Quoter’s total price for the purpose of evaluation will include the base period, option period 1, option period 2, option period 3, option period 4, and one-half of the 4th option period. Quoters are required only to price the base, 1st, 2nd, 3rd, and 4th option periods. Quoters shall not submit a price for the potential one-half year extension of services period.

(c) A written notice of award or acceptance of a quote, mailed or otherwise furnished to the successful quoter within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party.

Before the offer's specified expiration time, the Government may accept an quote (or part of a quote), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
