About this file

This is a Question and Answer document from a Solicitation Amendment (W91CRB26RA025A00002) issued on 15 September 2026. The document addresses clarification regarding small business participation requirements for a 100% Small Business Set-Aside acquisition that incorporates FAR 52.219-33.

The amendment clarifies that the Nonmanufacturer Rule waiver does not apply to this procurement. Consequently, any eligible small business nonmanufacturer or distributor seeking to submit products manufactured by an Original Equipment Manufacturer (OEM) must ensure that the OEM itself qualifies as a U.S. small business manufacturer. While an authorization letter from the OEM is not required for proposal submission, offerors are obligated to provide the name and associated CAGE code of their supplier at the time of proposal submission to enable the government to conduct a Small Business verification status check on the supplier.

Solicitation Amendment W91CRB26RA025A00002

Question and answer/ Summary of Changes

15 September 2026

Question One (1)

Nonmanufacturer/Distributor Participation: As this requirement is a 100% Small Business Set-Aside and incorporates FAR 52.219-33, please confirm whether an eligible small business nonmanufacturer/distributor may submit products manufactured by an OEM. If so, please confirm whether the OEM must itself qualify as a U.S. small business manufacturer or whether an applicable Nonmanufacturer Rule waiver applies to this acquisition.

Answer One (1)

The Nonmanufacturer Rule waiver does not apply. Therefore, the Original Equipment Manufacturer (OEM) must qualify as a U.S. small business manufacturer.

While an authorization letter from OEM is not required, Offerors shall submit the name and associated CAGE of their supplier at time of proposal submission for a Small Business verification status check of the Offeror’s supplier.
