About this file

This is Amendment 0002 to a firm fixed price supply contract solicitation (W91CRB-26-R-5002) issued by the U.S. Army at Aberdeen Proving Ground, Maryland. The amendment provides vendor responses to 17 questions submitted during the competitive bidding process for Night Vision Device (NVD) equipment.

Key technical specifications confirmed include: Figure of Merit (FOM) minimum of 2000 and maximum of 2200 for NVD image intensifiers; white phosphor requirement (green phosphor not acceptable); automatic gain adjustment for the image intensifier; f/1.2 aperture ratio; automatic brightness control; and maximum weight of 360g excluding battery, eyecup, and objective cover. The solicitation is not a small business set-aside. The Government maintains firm requirements on no partial shipments allowed, full CLIN delivery quantities required, delivery timelines as stated, and no extended delivery windows. For European service requirements, the Government allows contractors to provide names and surnames of two qualified warranty service specialists after contract award. Regarding specialized tools, the requirement is specifically for AN/PVS-14 type system tools, not AN/AVS-6&9 tools. On cybersecurity requirements, the Government confirms it cannot modify CMMC Level 2 certification requirements and references DFARS 252.204-7021 regarding subcontractor compliance obligations, including that subcontractors processing, storing, or transmitting FCI or CUI information must maintain appropriate CMMC certification levels. The buyer is REM D. NGO, CCAP-MDD/(520)671-3442, and vendors must acknowledge receipt of all amendments as part of their submission.

1. The purpose of this Amendment 0002 is to provide answers to questions submitted by vendors. Question numbering is sequential and continues from the previous amendment. For the prior question(s) and answer(s), please refer to the preceding amendment. Vendors are required to acknowledge receipt of all amendments as part of their submission.

QUESTION 2: "Is this solicitation a Small Business Set Aside?"

ANSWER: No, it is not a Small Business Set Aside.

QUESTION 3: "Confirming the FOM to be 2000-2200?"

ANSWER: This is to confirm that the NVD image intensifier's Figure of Merit (FOM) shall be a minimum of 2000 and a maximum of 2200.

QUESTION 4: "Is there an opportunity for batched deliveries or extended delivery windows?"

ANSWER: No, partial shipments are NOT allowed, and delivery timelines are as stated.

QUESTION 5:

"Regarding your solicitation requirement No. 9, on page 2, whereby it states, "Partial shipments are NOT allowed. Vendor must deliver each CLIN in full quantity.":

Due to the extremely high volume of global night vision demands, image tube deliveries have been greatly extended to all customers. As such, requiring each CLIN to be delivered in FULL will require the awardee to shoulder an unfair burden of carrying the cost of millions of dollars in cost of goods until all quantity 3535 can be built and prepared for shipment. This will likely take 12+ months to allow for tube production. As such, we request the Government change this requirement to allow for partial deliveries either in monthly batches or, at the very least, something more manageable such as partial deliveries in batches of no less than quantity 500 systems per batch."

ANSWER: Partial shipments are NOT allowed

QUESTION 6:

"The Statement of Work, on pages 3 and 4 states, "The NVD manufacturer (supplier) shall have an authorized service center in the

European Union. This service center shall also be able to provide warranty repairs for the equipment".. continuing and concluding with, "The contractor shall have at least 2 (two) qualified specialists trained by the manufacturer and holding the right to perform the warranty service of the offered equipment and shall provide a certificate endorsed by the person responsible of a supplier indicating the specialists responsible for the warranty service with their names and surnames provided."

We as the manufacturer have multiple European service centers but request the ability to provide the names and surnames of the two qualified specialists after contract award. Will the Government make such allowance that names and surnames of 2 (two) quality specialists be provided after contract award?"

ANSWER: The Government allows that the names and surnames of two quality specialists be provided after contract award.

QUESTION 7:

"Regarding your solicitation requirement No. 5, on page 2, in paragraphs 1 and 2, whereby it states, "Offerors SHALL also meet the

Cybersecurity Maturity Model Certification (CMMC) level cited in DFARS provision 252.204-25 and clause 252.204-21. In accordance with

DFARS provision 252.204-7025(d), "The Offeror shall provide, in the proposal, the CMMC unique identifier(s) (CMMC UIDs) issued by SPRS for each contractor information system that will process, store, or transmit FCI or CUI during performance of a contract, task order, or delivery order resulting from this solicitation". Failure to provide the UID and confirmation of CMMC level 2 for this requirement with proposal submission will result in ineligibility for award.":

Will the Government consider a proposed language change to this solicitation surrounding Level 2 Cyber Security Model Certification

(CMMC) to be Self level rather than C3PAO level given the first phase of the CMMC implementation began on November 20, 2025, and both time and costs are required by bidders to obtain third-party assessment which is a requirement of the C3PAO level? Per the Chief

Information Officer U.S. Department of War Website: CIO - About CMMC, CMMC assessment requirements will be implemented using a four-phase plan over three years. The phases add CMMC Level requirements incrementally, starting with self-assessments in Phase 1, and ending with full implementation of program requirements in Phase 4. This phased approach allows time to train assessors and for companies to understand and implement CMMC assessment requirements.

Such proposed language could be as follows:

Any resulting contract is anticipated to have a security classification level of Unclassified. Any resulting contract is also anticipated to involve the exchange of sensitive information requiring the contractor to satisfy a Cybersecurity Maturity Model

Certification (CMMC) Level 2 (Self) assessment with the possibility of processing, handling, exchanging information that will require

CMMC Level 2 (C3PAO) assessment after 10 November 2026. Any resulting contract shall be compliant with the specialty metals restriction of the Berry Amendment (10 U.S.C. 2533a and 2533b) in accordance with DFARS clauses 252.225-7008 and 252.225-7009."

ANSWER: The Government cannot change the CMMC requirements detailed within this solicitation.

QUESTION 8: "Regarding requirement 3.1.1.14, "The NVD shall have an adjustable image intensifier". Is this requirement referring to manual or automatic gain adjustment?"

ANSWER: Automatic

QUESTION 9: "Regarding requirement 3.1.1.20, "The NVD's weight shall not exceed 360g". Could you please clarify the configuration, meaning does this measurement include or not battery, eyecup and objective cover etc.?"

ANSWER: The measurement does NOT include battery, eyecup and objective cover etc.

QUESTION 10: "Regarding your Solicitation No. W91CRB-26-R-5002 for Night Vision Equipment, under CLIN 0005 on form 1449 (3.1.5 of SOW), it calls for Specialized Tool Sets for the AN/AVS-6&9, which is a different NVD system and it has different set of tools than those required for the AN/PVS-14 Type system (NVD solicited). There is a specific and different Specialized Tool Set for the AN/PVS-14 type system. Therefore, please advise or confirm that the end user is rightly look for the specialized tool set of the AN/AVS-6&9, which may not be 100% complete or compatible to service the required AN/PVS-14 type systems."

ANSWER: The Government requires the AN/PVS 14 specialized tool set.

QUESTION 11: "Phosphor Requirement:

Given current supply constraints for white phosphor tubes, will the Government consider green phosphor as an acceptable equivalent for this requirement?"

ANSWER: The requirement is for white phosphor.

QUESTION 12: "Delivery Timeline (if White Phosphor is Required):

In the event that white phosphor is a strict requirement, would the Government consider an extended delivery timeline through 2028 to accommodate production and supply limitations?"

ANSWER: No, delivery timelines are as stated.

QUESTION 13: "Would the USG be open to expanding the FOM requirement to allow units with a 1400 - 2200 FOM rating? This would significantly improve delivery time."

ANSWER: No, FOM restrictions are as stated.

QUESTION 14: "On SOW's 3.1.1.7 It is stated that "The NVD s focal length and aperture ratio shall be at least Fl.2". It is our understanding that the correct number for PVS-14 shall be at least f#(f number) 1.2. Can you please confirm or explain otherwise?"

ANSWER: Correct focal length is f/1.2 aperture.

QUESTION 15: "On SOW's 3.1.1.12 It is stated that "The NVD shall have automatic brightness adjustment". It is our understanding that this refers to ABC Automatic Brightness Control. Can you please confirm or explain otherwise?"

ANSWER: It refers to Automatic Brightness Control (ABC).

QUESTION 16: "On SOW's 3.1.1.14 It is stated that "The NVD shall have an adjustable image intensifier". It is our understanding that this refers to Manual Gain Control (MGC). Can you please confirm or explain otherwise?"

Name of Offeror or Contractor:

PIIN/SIIN MOD/AMD

ANSWER: It refers to Manual Gain Control (MGC).

QUESTION 17: "The prime contractor is a reseller of the subcontractor's PVS-14

From page 2 of the original solicitation:

In accordance with DFARS provision 252.204-7025(d), "The Offeror shall provide, in the proposal, the CMMC unique identifier(s) (CMMC

UIDs) issued by SPRS for each contractor information system that will process, store, or transmit FCI or CUI during performance of a contract, task order, or delivery order resulting from this solicitation". Failure to provide the UID and confirmation of CMMC level 2 for this requirement with proposal submission will result in ineligibility for award.

The subcontractor does not have any type of CMMC Level 2 certification. The prime contractor does not believe there is a requirement for the sub-contractor to process, store, or transmit FCI or CUI information. The prime contractor can control the information. If the sub-contractor needed to view this type of information, the prime contractor could arrange for that, but the contractor would not transmit anything to the sub-contractor which would require the sub-contractor to process and store."

ANSWER: See DFAR: "252.204-7021 Contractor Compliance With the Cybersecurity Maturity Model Certification Level Requirements.

(f) Subcontracts. The Contractor shall

(1) Insert the substance of this clause, including this paragraph ( f) and excluding paragraph (e)(1), in subcontracts and other contractual instruments, including those for the acquisition of commercial products and commercial services, excluding commercially available off-the-shelf items , if the subcontract or other contractual instrument will contain a requirement to process, store, or transmit FCI or CUI; and

(2) Prior to awarding a subcontract or other contractual instrument, ensure that the subcontractor has a current CMMC certificate or current CMMC status at the CMMC level that is appropriate for the information that is being flowed down to the subcontractor based on the requirements at 32 CFR 170.23.

2. All other terms and conditions remain unchanged and in full force and effect.
