About this file

This document is a comprehensive Q&A spreadsheet related to a Foreign Military Sales (FMS) solicitation for Information Technology Equipment for the Royal Hashemite Kingdom of Jordan's Armed Forces. The solicitation (W91CRB25C5071) is for procuring various IT hardware including 8 C8300 Routers, 100 C8200 Routers, 100 C9200 Switches, 100 Networking Modules, 200 Desktop Computers, 200 Monitors, 100 Laptop Computers, 100 DVD ROMs, 150 Enterprise Laser Printers, 50 Multifunctional Printers, and 50 Scanners. The procurement is classified under NAICS code 541519 and is a Total Small Business Set-Aside, with the U.S. Army Communications Electronic Command (CECOM) Security Assistance Management Directorate managing the effort to improve Jordan's C4ISR capabilities.

Key contractual details include a solicitation extended to October 27th, with inspection and acceptance occurring at the contractor's CONUS location, followed by government shipment to Jordan. The equipment requires 36-month OEM warranties, with TAA compliance specifically required for Cisco networking items. The government emphasizes that this is a hardware-only procurement with no installation services, and vendors must prepare equipment for DCMA inspection and government transportation. Unique requirements include the possibility of adding Arabic keyboard stickers to laptops and ensuring equipment is manufactured close to the contract award date, though the 30-day manufacturing requirement was ultimately removed based on vendor feedback.

PWS/SAM.govSECTIONQUESTION/COMMENTRESPONSE
PWSRegarding the subject Jordan FMS solicitation, would the government consider an alternate OEM than what is identified in the PWS, so long as the salient characteristics of the products meet or exceed what is requested?Permissable substitutions are defined in the updated PWS.
SAM.govWhat country is the equipment being installed? Jordan or elsewhere?Equipment will be received and accepted in the US. The equipment will be used and installed in Jordan.
PWSThe requirement states the equipment must have a date of manufacture no more than 30 calendar days prior to the contract award date. Since we don't control when companies like Cisco manufacture I'm not sure how we can guarantee this. Is the 30 calendar dats an absolute requirement or is it meant to ensure we're bidding the newest and latest gear available?Removed. PWS has been updated.
SAM.govThe SOW appears to ask for a 3 year warranty however the SAM solicitation only asks for a 1 year warranty. Can you confirm the warranty period?3-years of OEM warranty is correct. Solicitation has been updated.
Can the inspection location be at an OCONUS facility? No. Inspection location is defined in the PWS.
PWSSection 1.6.1Will AT and OPSEC certificates be required by contractor personnel?Removed. PWS has been updated.
PWSSection 3.2What is the frequency for the regularly scheduled teleconferences with the USG?Meetings will ocure every 2 weeks until equipment shipping. No more than 30 minutes per meeting.
PWSSection 4What work is expected to take place at host nation sites which will require security pass applications and access authorizations?None. All performance in CONUS.
Can the contractor use Government shipping (TAC /JCP GT&E ) for warranty repair? No. OEM Warranty is to be handled by the equipment OEM in Jordan. No equipment should be sent back to the US.
Can the Government confirm the Contractor is responsible for shipping from Jordan and back to Jordan (both ways) during the warranty timeframe.Yes. Warranty is to be handled by the equipment OEM in Jordan. No equipment should be sent back to the US.
PWSTable 1IT Equipment lists the requirement for 100 Cisco C9200 Switches (para. 3.3.3) and 200 Desktop Computers (para. 3.3.5). However, in the corresponding detailed requirement sections, paragraph 3.3.3 specifies 150 Cisco C9200 Switches, and paragraph 3.3.5 specifies 300 Desktop Computers.Equipment quantities are now consistent in both the solicitation and the PWS.
Many items listed in the PWS for the Cisco builds are no longer available. You can potentially correct and repost, or save this document for when you are reviewing the received responses as many potential bidders will not be able to quote what is posted in the opportunity. If you care to discuss the highlighted items in the document, feel free to reach out. If you wish I could also provide the direct local Cisco Account Team members that can review with you if that is more appropriate. The PWS has been updated.
CLASSIFICATIONNAICS Code, 51781 - All Other TelecommunicationsThe government classified this under a NAICS for Telecommunications Services, which doesn't align with what is being purchased, namely IT computer and networking hardware. We feel NAICS 334111, Electronic Computer Manufacturing would more appropriately match the requirement. Also, please note if this NAICS is used, it would require the waiver of the Non-Manufacturer rule. The NAICS code has been updated in the solicitation to 541519. The Federal Supply Classification (PSC) has been updated to 7021.
CLASSIFICATIONTotal Small Business Set-Aside (FAR 19.5)As a small business, financing and cash flow are always major challenges. Would the government consider progress / milestone payments for various phases of the project? Establish progress/ milestone payments to ease cash flow burden on small businesses. There are no plans for financing.
1.5 TRANSPORTATION/INSPECTION and ACCEPTANCEThe final contract from the ACC will define the final transportation logistical requirements, in accordance with the specifics for the designated freight forwarder.Based on this statement, please confirm the government is not expecting the bidders to quote transportation at this time? Also, will the government be arranging a carrier to pick up the shipment from the contractor's facility or shipping to a government facility? The preference is FOB Origin / Ex Works, where the government arranges for a carrier to pick up from our facility.Confirmed, the government is not expecting for the vendor to bid/quote shipping. Please refer to the solicitation for shipping guidance.

All hardware should be consolidated at the vendor's CONUS loction for DCMA inspection and acceptance.

3.1 Contractor Acquired Equipment/MaterialAll equipment must be factory-new with a date of manufacture no more than 30 calendar days prior to the contract award date.We have no control over an OEMs production and shipping process, so it is impossible to guarantee items will be manufactured no more than 30 calendar days prior to contract award. Please remove this requirement.Removed. PWS has been updated.
3.3.1 C8300 Router

3.3.2 C8200 Router

3.3.3 C9200 Switch

Routers and Switches shall be Trade Agreements Act (TAA) compliant, in accordance with Federal Acquisition Regulation (FAR) 52.225-5.Please confirm these and only these items called out in the PWS must be TAA compliant and this does not apply to the rest of the hardware requested? Please confirm application of TAA.Confirmed. Only the Cisco items must be TAA complient.
4 CONTRACTOR RESPONSIBILITIES WITH THE HOST NATION (END-USER)The contractor shall coordinate with the US Government in advance all contractor, subcontractor, and vendor interactions with the end user (host nation).Does the government anticipate the need for the contractor, its subcontractors, and suppliers, to perform any on-site activities, either at a location in the US, or in Jordan? If so will SOFA or TESA status be required for access? Also will there be any security from the US in the host nation country provided? Please clarify the level of on-site activity, if any?No, it is not part of the scope.

Please clarify if enterprise agreements with OEMs flow through this contract.US Government is the owner of the Equipment. Equipment will be transferred to Jordan upon reciept and title transfer.
1.6 SecurityThere are no U.S. Government security requirements for this effort and a DD 254 will not be required. However, the contractor shall be responsible for safeguarding Jordanian sensitive materials and information during the performance of this task. What type sensitive Jordanian materials and information will be required to be held or managed? What level security clearances are needed if any? Will a SCIF and or safe be required for safeguarding material? Is a secure facility required to store the equipment prior to shipping to govt location? Please clarify who is responsible for security requirements? There are no security requirements. PWS has been updated.
1.5 TRANSPORTATION/INSPECTION and ACCEPTANCE

and Shipping Instructions Inspection and Acceptance shall be at Origin by a delegated US Government Representative for all equipment and materials procured in CONUS and delivered under this contract. Origin is defined as the contractor’s facilities in CONUS. Since acceptance occurs at the contractor's facility and no partial shipments are allowed, will the contractor be able to submit a final invoice once the inspection /acceptance is completed? Please clarify when ownership of the product transfers from the contractor to the government? Transfer of Ownership happens once the Government takes possesion of materials from contractor's facility. A final invoice can be submitted at this time.

No partial shipments will be permitted.

Can the NAICS code 541519E "Informaiton Technology Value Added Resellers" be added to the acceptable list of NAICS code to respond to the RFQ?NAICS has been updated.
Are non-TAA solutions acceptable for the Dell portion of the hardware procurement?Yes.
Are non-TAA solutions acceptable for the HP portion of the hardware procurement?Yes.
Can the operational manuals for the products be provided in digital form?Yes.
Warranty section includes the following statement "The contractor shall meet a 30-day turn-around time for repair." If all products have sufficient 36-month service contracts for repair, replacement and troubleshooting, is that sufficient to meet the requirement/statement? After 8 months the period of performance is over, but coverage would extend beyond the PoP, so the service reliability would be the responsibility of the OEM (Cisco, Dell or HP).Correct. Once equipment is accepted, the 3-year OEM warranty will handle responsibility.
Due to a lack of partial shipment, will a percentage of the contract be paid within 15 business days of the award? There are no plans for financing.
Will the full shipment delivery be to a destination CONUS based?Yes. Vendor's CONUS location for inspection and acceptance. Government will perform shipment to Jordan.
Can this requirement be removed? It would be nearly impossible for the winning bidder to accommodate new manufacturing from the OEMs as on HP from out research for 2 of their 3 products required are made to order from a direct procurement. "All equipment must be factory-new with a date of manufacture no more than 30 calendar days prior to the contract award. Equipment with a fabrication or build date older that this timeframe will be considered non-compliant and subject to rejection."Removed. PWS has been updated.
Is there any potential this RFQ can be extended to Friday October 24th?Extended to 27 October.
The current equipment list includes UK-standard power cables (BS 1363), which suggests deployment in Jordan. If this opportunity is intended for a different country, please advise. In such cases, we are unable to include services directly, and you would need to engage the SmartNet team to explore service quoting options appropriate for the correct country. No, only intended for Jordan.
Local technical support and transfer of the ownership: Do you have any clarifications for this? Transferring especially TAA gear to foreign government will require quite some approval if we can get it approved. This contract is a hardware buy for items on an FMS LOA. The LOA acts as the approval to send equipment to country. The Government will be the exporter on record, since we will be responsible for shipping the equipment.
HP teams says that items will need to be send back to US Army in USA for warranty work. Transfer of ownership and local technical support cannot be confirmed from our perspective at the moment. It would be a great help if you confirm this based on your conversations with Cisco, HP, Dell or provide us with your account managers for the project so we can get this in writing from them. I have been told if this was an US Army bases overseas, it would not be a problem at all as the owner is US Army but it is just used overseas. It is the vendors responcibility to provide a hardware solution that can be warrantied in Jordan. Please refer to the OEM Global Limited Warranty and Technical Support details.
I also wanted to note that small businesses like mine cannot handle the financial charges of sorting the gear until delivery of the gear is completed. Vendors will not show flexibility and they will request a payment from the date that ship the gear to our storage area. We are anticipating that from the first delivery to collecting the payment will require at least 120 days of financing on the business side which will increase your cost and it will be an expense item for the business providing the delivery. The KO will consider authorizing some form of financing. Most likely it would be FAR 52.232-30 Commercial Installation Payments or FAR 52.232-16 Progress Payments.
We have an option to directly ship from vendor to the account which may eliminate the need for DCMA inspection/audits and also if requested we can do the same globally. We can also partner up with a local Jordan company to handle local operations. For FMS, the equipment must be inspected/accepted in the USA. The vendor must use the SIR network with DCMA Transportation. The vendor must box up equipment and label equipment properly. The vendor will work with DCMA to have the Government pick up materials from the vendor’s dock. Vendor will not ship equipment.
Since the project is going to be happening around the holiday time frame, will you be starting the project in November or Mid January? The project will commence following contract award.
Finally, I wanted to request information on design , deployment and operation of the items purchased under this RFP. Will you need assistance on USA or Jordan side? If so, is there any RFP or procurement announcement that we should be aware of?We have sent a combined synopsis and solicitation. There will not be another solicitation. This is a hardware buy only (No OCONUS work, no installation). Vendor needs to source equipment and do what is needed to get it ready for shipment.
The NIM-8MFT-T1/E1 models being selected require a PVDM selection if not intended for clear-channel data only. Please advise which of the below you want for these NIMs.You are requesting the PWR-C5-650WAC/2 on the C9200L-24T-4G-A, but according to Cisco the only option available is PWR-C5-125WAC/2. Please verify and confirm if this specification is correct, confirm if 600W secondary power supply is required and alo update part numbers if any alternative Cisco Switch is preferred. The Bill of Materials in the PWS has been updated.
Final Delivery Point: After the contractor complies with the DCMA shipping instructions at origin, is the government's responsibility for transportation considered complete, thereby establishing a delivery term equivalent to F.O.B. Origin? The contractor has responsibilities to use the SIR network, prepare material for shipment (Boxing and marking) and getting a Quality inspector from DCMA to inspect/accept material.
Contractor's Shipping Costs: Are the contractor's responsibilities and associated costs limited to the preparation and tender of the shipment at their dock (including packaging, marking, and staging), or is the contractor responsible for any line-haul or international freight costs to the final destination in Jordan? No shipping costs should be put onto the contract. Once the contractor has boxed/marked equipment and had DCMA inspection, they will consult with DCMA Transportation to pick up the equipment from their dock. From that point, a government carrier will do the shipping to country.
Could you please confirm whether the foreign government will have full access to local OEM supporty and warranty coverage.Jordan has access to OEM support and warranty coverage. It is the vendor's responcibility to provide a hardware solution that can be warrantied locally in Jordan.
Could you please confirm there are no restrictions on transferring ownership or registering the hardware locally under the FMS arrangement. To the best of the Government's understanding, confirmend. Transfers of equipment ownership occurs in FMS cases.
Section 3.4 of the PWS, "Transferable OEM Commercial Warranties," requires a minimum 36-month warranty for all materials. We interpret this to include the Cisco routers (C8300, C8200), switches (C9200), and the Network Module (Digital Optical Monitoring, DOM).Correct. All items, to include the C8300, C8200, C9200 & DOM, require 36-month warranty.
Could the Government please confirm that our understanding is correct: The requirement is for a 36-month, Cisco "CX Level 1" support package (or its equivalent) for all Cisco networking equipment listed in the PWS?Correct. All items, to include the C8300, C8200, C9200 & DOM, require 36-month warranty.
HP confirms that the specified laptop model is not manufactured with an integrated Arabic keyboard. To meet the end-user's needs, we have proposed applying high-quality, durable Arabic keyboard stickers.Providing "high-quality, durable Arabic keyboard stickers" for the laptop is acceptable.
Option A: Our HP-certified technicians at our warehouse facility open the computer packaging and professionally apply the Arabic keyboard stickers before shipment. This ensures the units are delivered ready to use.Option A is not preferred.
Option B: We include the sealed, original laptop units and package the unused Arabic keyboard stickers separately for end-user application.Option B is prefered.
