The following have been modified:
ADDENDUM TO FAR 52.212-1
ADDENDUM 52.212-1 INSTRUCTIONS TO OFFERORS--COMMERCIAL ITEMS (JUN 2018)
OFFER SHALL BE VALID FOR 90 DAYS
1. GENERAL. The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and past performance considered. Source selection will be conducted in accordance with FAR 13.106.2.
a. The Government intends to award a Purchase Order without discussions with Offerors (except for clarifications as described in FAR 15.306(a)). Therefore, the initial offer should contain the Offerors best terms from a price standpoint. Offerors should not assume that they will be afforded the opportunity to clarify, discuss, or revise their offer. However, the Government reserves the right to request clarifications or enter discussions if determined by the Contracting Officer to be necessary. The Government may reject any or all responses if not in accordance with the Federal Acquisition Regulation.
b. The Government reserves the right to cancel this solicitation and make no award. By responding to this request for offer and submitting a offer per FAR 13, the Contractor understands that the government shall not be liable for any costs incurred by the Offeror in response to this request for offer.
c. All offers will be evaluated in accordance with (IAW) section 52.212-2, Evaluation Factors for Award.
2. OFFER SUBMISSION. The Offerors offer shall be in the form prescribed by this solicitation and shall contain a response to each of the areas identified below in paragraph 4. All responses shall be in English, legible and prepared in the following general format to be properly evaluated. Responses must be complete, self-sufficient, and respond directly to the requirements of this Request for Quote (RFQ).
a. Electronic submission. The Offeror shall provide a copy of its quotation as an electronic file. By submission of a offer on electronic media, the offeror shall ensure that the submission is readable, in the format specified in the solicitation. The offer shall be emailed to Tracey Howard at tracey.l.howard8.civ@mail.mil with a courtesy copy to SSG. Patrick Kennison, Contracting Officer a patrick.v.kennison.mil@mail.mil before 12:00 pm local Afghanistan time as identified in Block 8.
b. To be eligible and responsive for award, prime and all subcontractors must be registered at the time the offer is submitted and approved at time of award in Joint Contingency and Expeditionary Services (JCXS). U.S. companies must also be registered and approved in JCXS and System for Award Management (SAM) by the award date. In addition, all subcontractors at all tiers who will be contracted by the prime during the life of the contract shall also be registered and approved in JCXS and SAM by the award date. The contractor is required to submit a listing of all proposed subcontractors, at all tiers, to the contracting officer by the quotation date. If no subcontractors are expected to perform during the life of the contract, the prime must submit a negative response to the contracting officer before the award date. Failure to be registered in JCXS and SAM at the prime and subcontractor levels and failure to inform the contracting officer of the names of all subcontractors (or provide a negative reply) may deem the offeror non-responsive and ineligible for award.
A "subcontractor" means any supplier, distributor, vendor, or firm (company) that furnishes supplies or services to or for a prime contractor or for another subcontractor.
3. Questions/Amendments/Exceptions.
a. Solicitation Questions. Offerors may email questions regarding this solicitation to Tracey Howard, Contract Specialist at tracey.l.howard8.civ@mail.mil with a courtesy copy to SSG Patrick Kennison, Contracting Officer at patrick.v.kennison.mil@mail.mil.. The Government will answer all questions received by 12:00 pm local Afghanistan Time, 8/05/2018. All e-mailed questions shall be submitted with the subject line as (Enter Solicitation #)–Questions. The Government reserves the right not to respond to any questions received concerning this solicitation after the Solicitation Questions receipt date and time above. Accordingly, offerors are encouraged to carefully review all solicitation requirements and submit questions to the Government early in the solicitation process. Government responses to questions will be provided to all offerors.
b. Amendment. The Government reserves the right to revise or amend the specifications, drawings, or both, prior to and/or after the date set for receipt of quotations as necessary. Such revisions, if any, will be announced by an amendment(s) to this RFQ. All information related to this RFQ, including pertinent changes/amendments and information prior to the date set for receipt of quotation, will be emailed to the companies listed in the solicitation.
c. Exceptions. If the Offeror takes exception to any of the requirements specified in this solicitation, the Offeror shall clearly identify each exception and include a complete explanation of why the exception was taken and what benefit it provides to the Government. All exceptions to the solicitation requirements (Sections B through H) and supporting rationale shall be included in an addendum to the quotation clearly labeled "Exceptions." An addendum is only required if the offeror takes exception to any requirement in the solicitation. The Addendum does not have a page limitation, but shall only include information relevant to exceptions taken to the solicitation requirements. The Government will assume the offeror takes no exceptions to any solicitation requirement if the offeror does not submit an Addendum identifying exceptions. Offerors are advised that solicitation requirements are not necessarily negotiable and such exceptions may render a offeror’s offer unacceptable and ineligible for award.
4. FORMAT AND CONTENT OF QUOTATION. Each quotation shall be submitted as set forth below and all information shall be confined to the appropriate part to facilitate independent evaluation. Quotations which do not include the requested minimum information, will be deemed non-responsive to the solicitation and will be eliminated from further consideration for award at the Government’s discretion. Quotation sections shall be labeled by section (i.e., Volume I - Price and Volume II Past Performance).
Volume I - Price. Information and required documents. Offeror shall provide all price information necessary to provide a meaningful basis for Government's analysis and evaluation of price for the project set forth in Section B of this solicitation. Prices shall include all related costs, (i.e., labor, wages, transportation, etc...), if applicable. The Government reserves the right to request other than certified cost and pricing data as needed.
Schedule B – Complete in its entirety Standard Form (SF) 1449 blocks 30a through 30c; and Contract Line Items (CLINs) 0001 through 3004. Note: IAW FAR 4.102 Block 30a on the SF 1449 "Individuals. A contract with an individual shall be signed by that individual. A contract with an individual doing business as a firm shall be signed by that individual, and the signature shall be followed by the individual's type, stamped, or printed name and the words, "an individual doing business as (insert name of firm).
Amendment(s) – Offerors must acknowledge amendments by signing blocks 15A through 15C, of any amendments (SF 30) issued out during the solicitation. Amendments may also be acknowledged in block 19 of the SF 1449.
Volume II - Past Performance. The Past Performance evaluation will be accomplished by reviewing aspects of an Offeror's recent and relevant Past Performance, focusing on and targeting performance which is relevant to the effort {as it directly relates to the work being procured under this solicitation and as defined in 52.212-2}.
a. The offerors shall only submit past performance information that is considered recent and relevant. Recent is defined as a project or contract that was performed within the last three (3) years (as of the solicitation issue dated).
Relevant experience will be limited to performance of projects similar in size, scope, and complexity to those, which may be ordered under this contract. The offeror shall submit up to three (3) past performance contract references for itself. The offeror shall submit three (3) additional past performance contract references for any proposed subcontractor, or teaming contractor whose effort on this contract will significantly influence performance of the proposed effort. Offerors with history of cure notices, show cause notices, and letters of concern for the same issue will receive a rating of Unacceptable. A list of the most recent and relevant past and present contracts performed for the U.S. Government and/or any commercial customers within the last three (3) years of issuance of this solicitation must be submitted for evaluation. Furnish the following information for each contract referenced:
(1) Company
(2) Service performed
(3) Contracting Agency with Name, address, telephone number and email address of the Point of Contact
(4) Contract number
(5) Contract dollar value
(6) Period of performance
(7) Percentage of effort performed by Company
(8) Comments regarding compliance with contract terms and conditions
(9) Comments regarding any known performance deemed not acceptable to the customer or not IAW the contract terms and conditions
b. The offeror shall include documentation regarding their relevant past performance as it directly relates to the work being procured under this solicitation. The offeror SHALL NOT go back any farther than 3 years for the submitted data. The past performance data shall document a successful history of past contract performance.
c. The offeror shall submit, along with the information required in this paragraph, a consent letter, executed by each subcontractor, teaming partner, and/or joint venture partner, authorizing release of adverse past performance information to the offeror so the offeror can respond to such information. For each identified effort for a commercial customer, the offeror shall also submit a client authorization letter, authorizing release to the Government of requested information on the offeror’s performance.
d. In conducting the Past Performance evaluation, the Government reserves the right to use both th information provided in the offeror’s Past Performance Volume and information obtained from other sources, such as the Past Performance Information Retrieval System (PPIRS) or similar systems, Defense Contract Management Agency (DCMA) and commercial sources. Offerors are reminded that both independent data and data provided by offerors in their proposals may be used by the Government to evaluate offeror past performance. However, the burden of providing thorough, complete, and current past performance information as requested in this paragraph remains with the offerors. Proposals that do not contain the information requested by this paragraph risk rejection or a less than acceptable performance rating by the Government. All past performance comments received will be taken into account and could affect the overall rating. The overall past performance evaluation is a subjective decision based on the whole of all data received. In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the offeror may not be evaluated favorably or unfavorably on past performance (see FAR
15.305 (a)(2)(iv)). Therefore, the offeror shall be determined to have unknown past performance. In the context of acceptability/unacceptability, “unknown” shall be considered “acceptable.”
