Section C - Descriptions and Specifications

PERFORMANCE WORK STATEMENT

1.0 INTRODUCTION: This Performance Work Statement (PWS) provides a description of the pest services required to support the United States Army Corps of Engineers (USACE) Engineer Research and Development Center (ERDC) Cold Regions Research and Engineering Laboratory.

2.0 Objectives: The Contractor shall furnish all labor, supervision, tools, materials, equipment, transportation and any other items and services necessary to perform pest control services for the facility at CRREL, located at 72 Lyme Road, Hanover, New Hampshire. Many services will be chiefly associated with the main occupied buildings, but all buildings and grounds are included in this contract. All services shall be performed in accordance with this Performance Work Statement (PWS) including appendices and/or attachments.

The Contractor shall plan, execute, and complete the work necessary to provide the specified services within required time frames, and shall be available on an as-needed or repetitive basis for other services as stated in this PWS. Contractor shall perform all administrative services, such as obtaining any required federal, state, local, or site authority permits, material procurement, quality control, and maintenance of accurate and complete records. The Contractor must be commercially licensed/registered in the State of New Hampshire for pest control services and shall use only licensed technicians to perform the services requiring licensing.

3.0 Major Requirements:

All workmanship shall meet the approved and accepted standards and procedures of the industry;

equipment manufacturers; all applicable site, local, state, and federal standards, regulations, and laws; and all applicable environmental, safety, building codes, laws, and regulations. All services required by this contract shall be documented at no extra charge to the Government.

A. Fly Spraying. Performed once per year as follows: Specific service to be performed is the spraying of exterior vertical wall surfaces extending from ground level to the roof of the listed buildings with the insecticide demand EZ or equal to prevent cluster fly migration to the interior of those buildings. The Contractor shall schedule the fly spraying with the COR and shall submit Safety Data Sheets (SDS) and all manufacturer catalog and safety information to the COR for approval at least 2 weeks prior to the scheduled start date of spraying operations.

The Contractor shall not substitute materials or methods unless such substitutions have been specifically approved in writing by the COR. No product may be used without the prior approval of the COR.

1) Timing. Because cluster fly spraying is most effective if done just before or as seasonal temperatures begin to fall, the work under the contract is expected be performed on a weekend in early September and must be scheduled through the COR. Deviation from this schedule must be approved in writing by the COR.

a. Additional Timing Requirements: Because the application of the spray for cluster flies requires drying time to be fully effective, the Contractor shall not schedule spraying if rain is predicted less than 24 hours after completion of spraying. In the case of a predicted rain event after the schedule has been approved, the Contractor shall reschedule to allow at least 24 hours drying time before any rain begins.

2) Buildings where spraying is required are as follows: Main Laboratory/Laboratory Addition, Technical Information Analysis Center, Ice Engineering Facility, Facilities Engineering, and Remote Sensing. The Contractor shall take extra care at walkways, entryways, and doors to ensure spray does not get on areas where humans may come into direct contact with it. Electrical equipment shall not be sprayed including motors, lights, receptacles, and any other equipment that may be exposed to spraying operations. Method of spraying around these areas shall be by a pin stream or similar method to prevent any overspray on these areas.

3) Approximate total building perimeter linear footage is 2700 L.F. Buildings heights are as follows:

4) The Contractor shall verify specific walls where spraying is required, the linear footage, wall height, and all other conditions existing on site that may be related to the successful completion of this contract. The Government is not responsible in any way for misrepresenting any part of this contract. The Contractor is responsible for verifying all estimated quantities provided by the Government.

a. In addition to the initial field verification, the Contractor Site Supervisor shall inspect the area to be sprayed immediately before beginning spraying operations to confirm that all windows and doors are closed and that there is no unauthorized personnel or property in the spraying areas. Any building found to have open windows or doors, or unauthorized personnel or property in or near the area to be sprayed shall be immediately reported to the COR. Spraying operations shall not begin in those areas until all doors and windows are confirmed closed and unauthorized personnel or property is moved.

5) The Contractor shall keep specific records of where fly spraying was completed and of any problems or special conditions encountered for this project and shall provide the documentation of the Cluster Fly spraying to the COR via email.

B. Recurring Pest Control. Performed once per month as follows: Specific monthly services are to place rodent trapping devices in all areas both interior and exterior where there is or has been past evidence of rodent activity, check/maintain traps monthly, dispose of trapped pests, and ensure traps are reset; treat the CRREL kitchen, vending, and cafeteria areas for ants or other crawling or flying insects and treat as necessary and appropriate to ensure insects are not present in those areas; check and maintain all fly trapping lights wherever located. Any additional area or areas on site both interior and exterior that need rodent traps or an insect treatment which are discovered by the contract technician/s during monthly services or by the Government between such services shall also be covered under monthly services.

1) Timing. Monthly services shall be scheduled with the COR and performed on the first week of every month unless arrangements are made with the COR to combine monthly services with another scheduled activity for a different time.

C. Call-in Pest Control. Performed as needed on a call-in basis as follows: Call-in will be through the COR. Call-in services may need to be performed at any time during the month.

Travel times are not billable. The following types of call-in pest services may occur anywhere on the CRREL site, both interior and exterior. Crawling or flying insect control. Large flying or miscellaneous rodent pest control and/or removal (including but not limited to birds, bats, squirrels, etc.). Larger pest removal (including but not limited to skunks, woodchucks, or other animals that may gain access to the site). These types of pests shall be trapped and removed from the site. The COR shall submit a Scope of Work describing the requirement.

1)The Contractor shall provide a cost proposal based upon the scope of work furnished by the COR.

Cost Proposals shall include:

a. A Description of the work to be accomplished and a detailed breakdown of required labor man-hours and Contractor-provided materials necessary to satisfy the requirement.

Labor shall be calculated using the Contractor’s composite labor rate as submitted on the applicable CLIN of the bid sheet. The invoice shall not include profit, overhead, travel, vehicle, or per-diem charges, these costs shall be included in the contractor’s Composite Labor Rate. The proposal shall include the corresponding labor rate agreed upon in the contract as well as the direct cost for supplies/parts/equipment.

b. The cost of work to be accomplished, with labor and materials separately listed.

c. A schedule of work, including a start and completion date.

d. The Contractor shall be prepared to provide documentation (i.e. quotes, catalog sheets, etc.) to support all direct material costs.

e. The Contractor shall not perform the service or procure any supplies/parts/equipment without prior approval. After approval of the proposal the contractor has 3 working days to start the task.

D. Record Keeping. The Contractor shall keep accurate and up-to-date records of all services performed on the CRREL site. Records shall be emailed to the COR every month with the invoice. Monthly records shall be provided to the COR within two (2) weeks of the last day of each month recording all contractor activity that occurred on site during the previous month.

Records a), b), and c) below shall be provided at the beginning of the base contract, at any time there is a change, and at the beginning of each option year.

1) Records shall include, but are not limited to, the following:

a) Name and contact information for the contract supervisor (main POC);

b) A list of all required permits; for services where no permits are required, the Contractor shall include a signed statement so stating;

c) SDS and manufacturer’s information for all chemicals, products, and materials used or proposed for use on site;

d) An on-going monthly record of all services performed during the month, including the date of performance, name/s of technician/s on site, cost, any special conditions noted, and Contractor recommendations where appropriate.

e) The COR will include a list with the on-site records of any pest problems reported to DPW and may also inform the contract main POC by email. The contract technician shall check in with the COR before performing monthly services to ensure resolution of all recorded problems.

E. Required Personnel

A. Site Supervision (SS). The Contractor shall designate a Site Supervisor with decision-making authority in charge of the work being performed. The SS must have at least two years’ experience as a site supervisor completing projects/work of similar scope and shall submit to the COR evidence of such experience. NOTE: The SS and SSHO may be the same person if qualified.

1) SS Responsibilities: The SS shall be responsible for all aspects of the services performed including, but not limited to, scheduling, safety, security, verifying site conditions, maintaining SDS and any other relevant records , spraying operations, environmental compliance, occupational health, and quality assurance. The SS shall be present on site at all times while fly spraying work is being performed by the Contractor. They shall keep the COR informed of work progress or if any problems or unusual conditions arise for any service. They shall ensure that service reports are provided to the COR for all service performed during the month within two weeks after the end of each month.

The SS may perform other functions for this contract if he/she is qualified to do so. Proof of qualifications for all functions must be provided to the COR.

2) SS Qualifications: The SS shall hold a commercial applicators license with the State of New Hampshire at the supervisory level.

3) The SS shall attend the pre-performance meeting with Government representatives prior to the start of any work on site.

B. Site Safety and Health Officer (SSHO). The Contractor shall designate one Competent Person as the Site Safety and Health Officer and their training, experience, and qualifications shall be in accordance with EM 385-1-1. The Contractor shall submit documentation of SSHO qualifications to the COR. A copy of EM 385-1-1 can be accessed on line or at DPW at

CRREL.

1) SSHO Responsibilities: The SSHO shall be present at the work site at all times while the Contractor performs fly spraying work under this contract, and shall perform management, surveillance, inspections, and safety enforcement for the Contractor. The SSHO may have other duties in addition to site safety and health as long as he/she is qualified to perform all such duties.

2) SSHO Qualifications: The SSHO shall have a minimum of two years’ experience in implementing safety and health programs of similar scope; shall have experience in personal protective equipment; and working knowledge of safety procedures as well as Federal and State occupational safety and health regulations. The Contractor shall have at least a 10 hour OSHA Safety Class certificate and shall provide documentation of the certificate to the COR.

3) The SSHO shall attend the pre-performance meeting with Government representatives prior to the start of any work on site.

4.0 GOVERNMENT FURNISHED PROPERTY AND SERVICES:

4.1. AVAILABILTY OF UTILITIES. Government will provide all electrical and water utilities required to complete this requirement.

5.0 CONTRACTING OFFICER’S REPRESENTATIVE (COR): The ERDC CERL COR for this task order will be appointed in accordance with DFARS 252.201-7000, and a copy of the designation letter will be provided to the Contractor. Although other Government personnel may clarify technical points or supply relevant information to the Contractor regarding this task order, only a Contracting Officer has the authority to revise any requirements in these specifications, including those resulting from verbal clarification. Only a warranted Contracting Officer (either a Procuring Contracting Officer (PCO), or an Administrative Contracting Officer (ACO)), acting within their delegated limits, has the authority to issue modifications or otherwise change the terms and conditions of this contract. If an individual other than the Contracting Officer attempts to make changes to the terms and conditions of this contract, you shall not proceed with the change and shall immediately notify the Contracting Officer.

The Government and the Contractor understand and agree that the services to be delivered under this contract by the Contractor to the Government are non-personal services and the parties recognize and agree that no employer-employee or master-servant relationship exists or will exist under the contract between the Government and the Contractor’s employees.

6.0 MEETINGS AND REVIEWS: The contractor shall attend the following:

A. Pre-Performance Meeting. The COR will arrange and conduct a pre-performance meeting on the CRREL site prior to beginning any work under this contract. The date, time, and place for this meeting shall be mutually agreed upon by the Contractor and the COR. It is mandatory that the Contractor's SS an SSHO personnel assigned to this contract attend the meeting; no personnel substitutions will be permitted. The purpose of the meeting is to review contract requirements, meet other Government personnel who may be associated with the contract, and coordinate work. Topics discussed will include job safety, scheduling, smoking policy, traffic control, quality control, environmental protection, record keeping, and any other topics or issues which the Government or the Contractor choose to bring up. The Contractor shall bring to this meeting all submittals required by the contract if they have not been previously submitted.

a. A mid-point progress review meeting to be held at ERDC-CRREL at Hanover, NH approximately 6 months after award of the base year and all option years.

7.0 TRAVEL REQUIREMENTS : The following travel is required at a minimum:

a. The contractor is required to travel to ERDC CRREL to meet the requirements of the

PWS.

b. The contractor is also required to travel to ERDC CRREL for any meetings or reviews.

8.0 REPORTS/DELIVERABLES : The Contractor shall submit the following reports/deliverables to the ERDC-CRRL COR, or to the required reporting system specified, within the time specified.

1) Record Keeping. The Contractor shall keep accurate and up-to-date records of all services performed on the CRREL site. Records shall be emailed to the COR every month with the invoice.

2) Payment: The Contractor shall bill only for work performed. Contractor shall refer to FAR Clause 52.212-4 Contract Terms and Conditions—Commercial Items, Section G, “Invoices.”

It is very important to identify the correct Contract Number (Block 2) to prevent a delay in receiving payment. Electronic invoicing is required.

3) Submittals for the COR shall be submitted prior to or at the pre-performance meeting. Work shall not commence until all Post Award submittals have been satisfactorily submitted and approved by the Government.

A. Safety Data Sheets (SDS) and Manufacturer’s Information. SDS and manufacturer’s information for all products/materials to be used on site. Copies shall be maintained on site by the Contractor’s site supervisor for reference by contractor personnel during all work on site.

NOTE: No materials, products or equipment containing Trichloroethylene or TCE residue may be used or brought on site.

B. Documentation. Documentation of qualifications for the site supervisor and the site safety and health officer.

C. Copies of Permits. Copies of any permits required by the Environmental Protection Agency (EPA) or other federal, state, local, or site authorities for completion of work under this contract; if no permits are required, Contractor shall provide a signed statement so stating.

D. Safety Plans. Accident Prevention Plan (APP), Environmental Protection Plan (EPP), and Fall Protection Program/Plan.

E. Personnel List. A personnel list as described under part 8 Security Requirements of this

PWS.

9.0 SCHEDULE:

9.1 REGULAR WORKING HOURS: The Contractor shall provide the required services required between the normal working hours of 8:00 AM to 5:00 PM weekdays.

9.2 LEGAL PUBLIC HOLIDAYS

The Government observes all federal holidays. When a designated legal holiday falls on a Sunday, the following Monday will be observed as a legal holiday. When a legal holiday falls on a Saturday, the preceding Friday is observed as a holiday.

10. PERIOD OF SERVICE: This contract includes a Base Period of 12 months with four 12 month Option Periods.

11.0 SAFTEY: Safety shall be in accordance with and shall address the requirements of applicable Federal, State, local, and site safety and health laws, rules, regulations, and requirements and the most recent edition of EM 385-1-1.

A. Accident Prevention Plan (APP). The Contractor shall prepare and submit for approval an Accident Prevention Plan specific to the activities being performed. It shall include any Activity Hazard Analysis for specific safety actions required. All work shall be conducted in accordance with the APP, EM 385-1-1, and all applicable Federal, State, and local safety and health requirements.

An example of the minimum requirements for an APP which may be used is included at the end of this PWS as Attachment 2.

B. Fall Protection Program (FPP). The Contractor shall have a Fall Protection Program as applicable under EM 385-1-1. Fall protection may be included as part of the APP as long as it is addressed completely or by a separate Fall Protection Plan.

C. Accident Reporting. All accidents and near misses shall be investigated by the Contractor.

All work-related recordable injuries, illnesses and property damage accidents (excluding on-the-road vehicle accidents), in which the property damage exceeds $5,000.00, shall be verbally reported to the COR within 24 hours of the incident. Serious accidents as described in EM 385-1-1, Section 01.D.02, shall be immediately reported to the COR. ENG Form 3394 (available through the COR) shall be completed and submitted to the COR within five working days of the incident.

12.0 ENVIRONMENTAL

The Contractor shall be in compliance with all Federal, State, and local environmental laws, regulations, and ordinances applicable to this contract. The Contractor shall prevent environmental pollution and damage that could occur as the result of this contract. Cleaning of equipment used shall NOT take place on site; storm drains in the area of spraying shall be protected from possible run-off. The contractor shall follow all manufacturers’ recommendations for chemical application as listed in the SDS.

A. Environmental Protection Plan. The Contractor shall submit an Environmental Protection Plan to the COR prior to any work on site. The purpose of the Environmental Protection Plan is to present a comprehensive overview of known or potential environmental issues which the Contractor must address during work under this contract. The Environmental Protection Plan shall be maintained on-site by the Contractor.

B. Laws, Regulations, and Ordinances. The Contractor is responsible for keeping informed of all changes in environmental laws, regulations, and ordinances. Violations or delays resulting from Contractor’s failure to comply with environmental laws, regulations and ordinances is the Contractor’s responsibility and shall not affect approved performance schedule. Where laws, regulations, or ordinances differ, the most stringent shall apply.

C. Containment/Cleanup. The Contractor shall have containment material in immediate location of work. Contractor shall immediately contain spills with corrective countermeasures, and once spill is contained, notify the COR. The Contractor shall stop spills from entering the environment. The Contractor is responsible for the proper cleanup and disposal off site of hazardous material spilled as a result of their work.

D. Hazardous Material Handling and Storage.

1) Hazard Communication Standard (29 CFR 1910.1200) Requirements: Contractor is responsible for providing HAZCOM training to their employees.

a) SDS’s: Contractor shall provide SDS’s sheets for any products or materials brought on site for use in the performance of this contract. No product may be used without the prior approval of the COR.

b) Labeling: Contractor shall ensure that all hazardous materials brought on site are properly labeled in accordance with 29CFR1910.1200.

2) All hazardous materials shall be stored so that they are secure and protected from contamination and can NOT cause anything to be contaminated by them.

3) NO products or materials containing TCE are allowed on the CRREL site. Any tools or equipment previously exposed to TCE shall not be used on site unless it can be shown that they do not have TCE residue of any kind including vapor emissions.

13.0 SECURITY:

(1) Overview: All contractor personnel are required to follow all security regulations as directed by the the Security Office, as written in this Work Statement, and as otherwise specified at the post award conference. General disruption by the contractor is limited to the immediate work site. The contractor is strictly responsible for the security of all products, materials, tools, and equipment used during the duration of this job.

The Contractor shall report any vandalism, suspicious activities or devices to the COR Security as soon as possible. The COR will notify the Contractor of any heightened security measures and will expect vigilant monitoring of equipment, grounds and security fencing while working. At a heightened security posture, there may be work areas that are restricted. The COR will notify the Contractor of these restricted areas, and work may be delayed or restricted or will be performed in these areas, and work may be delayed or restricted or will be performed in these areas under the direct supervision of U.S. Army Corps of Engineers personnel.

(2) Identification: All contractor employees must have a positive picture I.D. (such as a valid picture driver’s license) to enter on to the site and must be prepared to show it at any time. The Security Office may require each contractor employee to wear a badge issued by the Security Office and also to sign in and out when entering and leaving the work site. The contractor is responsible for all badges issued to his employees and shall ensure they are returned to the Security Office upon completion of the work, when leaving the site, or when otherwise directed.

(3) U.S. Citizens. Contractor personnel must be U. S. citizens. All Contractor personnel are required to sign in with Security to obtain and wear security identification badges. A picture ID is required. Contractor personnel shall follow all sign-in and security regulations as directed by the Security Office and the COR.

(4) No Weapons Allowed. All persons and vehicles entering a US Government facility are subject to inspection for firearms, explosives and dangerous weapons, per RA 190-22.

(5) N/A

(6) General Protection/Security Policy and Procedures. The Contractor and all associated subcontractor employees shall comply with applicable installation, access and local security policies and procedures. Policies and procedures will be provided by the local Security Office.

The Contractor workforce must comply with all personal identity verification requirements as directed by DoD, HQDA, and local policies. In addition to the changes otherwise authorized by the changes clause of this contract, should the Force Protection Condition (FPCON) at any individual facility or installation change, the Government may require changes in contractor security matters or processes.

(8) iWATCH Training. The Contractor and all associated subcontractors shall brief all employees on the USACE iWATCH program. This locally developed training will be used to inform employees of the types of behavior to watch for and instruct employees to report suspicious activity to the COR. This training shall be completed within 45 calendar days of contract award and within 45 days of new employees commencing performance on the contract.

The contractor shall provide certification of completion to the COR within 10 days of training completion. Training documents will be provided by the Security Office.

(9) Pre-screen Candidates Using the E-Verify Program: The Contractor must pre-screen Candidates using the E-verify Program (http://www.uscis.gov/e-verify ) website to meet the established employment requirements. The Vendor must ensure that the Candidate has two valid forms of Government issued identification prior to enrollment to ensure the correct information is entered into the E-verify system. An initial list of verified/eligible Candidates must be provided to the COR no later than 3 business days after the initial contract award. When contracts are with individuals, the individuals will be required to complete a Form I-9, Employment Eligibility Verification, with the designated Government representative. This Form will be provided to the Contracting Officer and shall become part of the official contract file.

(10) Vehicles: Contractor personnel shall wear seatbelts at all times when driving on premises.

Contractors shall obey a speed limit of 10 mph. No weapons are allowed within a vehicle on site. Contractor vehicles shall be equipped with back-up alarms.

14.0 QUALITY CONTROL: The Contractor shall maintain a quality control plan to manage the total work effort associated with all services required to assure fully adequate and timely completion of these services.

16.0 INSTRUCTIONS TO OFFERORS

This is a lowest price technically acceptable requirement. In order for the government to make a determination of the contractor’s capability of performing the services, the contractor shall submit a proposal in accordance with the following and award will be based on the proposal submitted by the contractor in accordance with the following submittal requirements.

A. RELEVANT EXPERIENCE:

I. Contractor should provide other similar projects the contractor has performed. (Limit of Five) The evaluation of experience is a subjective assessment of the Offeror’s experience on contracts of a similar nature, size, scope, and complexity, utilizing a comparable number of personnel with like skills. The Government will assess the Offeror’s experience and determine whether the contractor’s experience is similar in depth and breadth of experience and demonstrates their ability to execute contract requirements.

II. A current copy of the company’s commercial licenses/registration for the State of New

Hampshire. This includes current copies of pesticide applicators’ licenses for operational level applicators, and pesticide supervisory level license for the supervisor of the applicators.

B. PRICING: Contractors shall complete the SF1449 and the attached Bid Schedule (Attachment 01). The provided bid sheet includes estimated hours and estimated Services that may be used under this contract. NOTE: The quantities are estimated for price evaluation only and do not constitute the government to perform or award the estimated hours. The price proposal shall include a total cost derived from the provided bid schedule for the base year and all option years. This will be used to determine price.
