About this file

This document is an amendment to a solicitation for maintenance dredging of the Kennebec River in Maine. The U.S. Army Corps of Engineers Engineering District New England issued the solicitation to dredge the river and transport dredged materials to two designated disposal sites using a previously established haul route. The amendment provides responses to contractor questions regarding automatic identification system requirements, notification procedures to lobster fishermen, and waiver of 30-day notice periods given the expedited procurement timeline. Eligible contractors must publish a public notice approximately four weeks before dredging commencement to notify the public of the project.

SUMMARY OF CHANGES

SECTION SF 30 - BLOCK 14 CONTINUATION PAGE

The following have been added by full text:

RFIs

1. Specifications Section 01 54 50, page 3, paragraph 1.5 (AUTOMATIC IDENTIFICATION SYSTEM REQUIREMENTS) states; “All dredge and plant equipment shall be registered with the AUTOMATIC IDENTIFICATION SYSTEM (AIS) in order to ensure that the entire footprint of the Contract's working vessels and scows are available on marine trafficker's electronic chart displays.”

Q: Does this only apply to vessels exceeding 26’ in length, excluding sheer? Does it apply to survey vessels and crew boats?

GOVERNMENT RESPONSE: The specifications require the hopper dredge plant to be equipped with an Automatic Identification System. All other vessels operated by the contractor should be furnished with safety equipment in accordance with all Federal, State, Regional, and local laws and regulations.

2. In the State of Maine DEP Department Order (specifications pdf page 139 of 246), it includes the following requirements (Order page 10 of 14):

b. Clearly mark or designate the dredging area, the disposal area, and the transportation route;

c. No less than 30 days prior, provide written notice specifying the haul route and time periods of dredging operations to all members of Lobster Zone Council E for timely notice to move gear in the Haul route and or dredge envelope.

d. No less than 30 days prior, publish in a newspaper of general circulation in the area adjacent to the route the approved transportation route of the dredge spoils;

e. No less than 30 days prior, publish in a newspaper of general circulation in the area adjacent to the route a procedure that the applicant will use to respond to inquiries regarding the loss of fishing gear during the dredging operation.

Further, it states; “The applicant submitted a map that outlines the proposed transportation routes to the Bluff Head Disposal Area and the Jack Knife Ledge Disposal Area which was reviewed by DMR.”

Questions:

a) Is there an approved transportation (haul) route that has been previously established for the Popham Beach dredging? If so, please provide a map depicting the approved haul route.

GOVERNMENT RESPONSE: The previously established haul route for Popham Beach dredged material placement can be found at the end of Section 35 20 23.

b) For item b above, is there a specific (approved) method required for marking the dredging areas, the disposal area, and the transportation routes?

W912WJ22B0019

GOVERNMENT RESPONSE: The US Navy is the applicant for this permit and is required to comply with the requirements. The dredging work is being performed within the limits of a congressionally authorized FNP and delineation of the dredging areas is not required. The contractor will be required to remain in the designated haul route for the transportation of dredged material from the channel at Popham Beach to the Jackknife Ledge placement site

c) For items c-e above, there will not be a 30-day period available to accomplish these notifications, due to the expedited procurement and short dredging window. Will these 30-day requirements be waived for this procurement?

GOVERNMENT RESPONSE: The US Navy is the applicant for this permit and is required to comply with the requirements. The contractor is only responsible for publishing the Public Notice per Section 01 11 00 of the specifications. The contractor shall notify the public of this dredging project approximately four weeks before commencement of dredging operations at the site. This will require the contractor to publish the Public Notice shortly after the contract is awarded.
