BRP WW 8 – WQC Dredging or Disposal of Dredged Material New Bedford Hurricane Barrier Maintenance Project
At: New Bedford Hurricane Barrier
Buzzards Bay Watershed
Wetlands File №: NE 061-0737 ACoE Application №: Not Applicable
Dear Mr. Randall:
The Massachusetts Department of Environmental Protection (the “Department”) has reviewed your application for a BRP WW 8 – WQC Dredging or Disposal of Dredged Material referenced above. In accordance with the provisions of Section 401 of the Federal Clean Water Act as amended (33 U.S.C. §1251 et seq.), MGL c.21, §§ 26-53, and 314 CMR 9.00, the Department has determined there is reasonable assurance the project or activity will be conducted in a manner which will not violate applicable water quality standards (314 CMR 4.00) and other applicable requirements of state law.
The waters of the project site are designated in the Massachusetts Surface Water Quality Standards as SB upstream of the hurricane barrier and SA in the area outside the hurricane barrier (314 CMR 4.06).1 Both classifications are designated as habitat for fish, other aquatic life, and wildlife and are suitable for primary and secondary contact recreation. Class SA waters are suitable for shellfish harvesting without depuration while SB waters may be suitable for shellfish harvesting with depuration.
The consumption of fish and shellfish from the inner harbor and portions of the outer harbor has been prohibited since 1979 due to PCB contamination from the New Bedford Harbor Superfund Site. Anti-degradation provisions of these Standards require that "existing uses and the level of water quality necessary to protect the existing uses shall be maintained and protected.”
Project Site: New Bedford Harbor is located at the mouth of the Acushnet River between the cities of New Bedford and Fairhaven, Massachusetts. The New Bedford Hurricane Barrier extends across the mouth of the harbor from a point just north of Fort Phoenix in Fairhaven, to Clarks Cove in New Bedford. The hurricane barrier consists of two earthen fill dikes with stone slope protection and a central gated opening for navigation.
The gates are closed during potential high-water events to protect upstream portions of New Bedford, Fairhaven, and Acushnet from flooding. The gate system is composed of two steel sector gates that pivot on trunnions and travel on tracks laid in a concrete sill which runs across the channel. The gates are normally stored in a retracted position inside reinforced concrete abutments located on either side of the navigation opening.
Starting in December 2021, the US Army Corps of Engineers (USACE) will be performing routine maintenance on the hurricane barrier.
Proposed Project: USACE is proposing to mechanically remove approximately 1,000 cubic yards (cy) of mixed sand and fine-grained material that has accumulated in the New Bedford Hurricane Barrier sector gate pockets (500 CY in the New Bedford gate and 500 CY in the Fairhaven) since they were last maintained in 2012.2
Work is anticipated to be performed while the gates are dewatered for maintenance between December 2021 and June 2022. Stop-logs will be inserted in each gate pocket, each gate pocket will then be dewatered, and the accumulated material will be excavated with a small mechanical dredge. Workers with shovels may be used to shovel material into the dredge bucket in areas where sediment is sparse. The gate pockets are enclosed structures and provide no habitat for aquatic resources. Material will be transferred to a scow alongside the hurricane barrier. The proposed, and most feasible, disposal alternative involves placement of the sediment in the Confined Aquatic Disposal (CAD) cell in inner New Bedford Harbor. It is anticipated that each gate pocket will produce enough material for one disposal event, for a total of 2 events.
1 314 CMR 4.06 Table 25 – Buzzards Bay Coastal Drainage Area.
2 The sector gate pockets were last maintained in 2012 when approximately 935 cubic yards of mixed sand and fine-grained material was excavated and placed into New Bedford Harbor CAD Cell 2. As an active superfund site, New Bedford Harbor has established Confined Aquatic Disposal sites under the State Enhanced Remedy as the most feasible option for onsite disposal of contaminated sediments.
The volume, physical, and chemical characteristics of the sediment are compatible with the sediment in the CAD area. The utilization of the CAD cell disposal site also provides an alternative designed to protect the public health and minimize environmental impacts in a cost-effective manner.
The project is considered a routine operation and maintenance action which is exempt from NEPA, and the requirements for an Environmental Assessment. The project is not considered individually or cumulatively to have significant effect on the quality of human environment.3
Sediment Sampling Data: A total of five sediment samples collected from the three stations within the Fairhaven gate pocket and the two stations within the New Bedford gate pocket. Since samples were exceeded 10 percent (range: 5.3-41.9%) by weight of “fines” passing the #200 sieve, sediment samples were further analyzed for disposal characterization following the requirements set forth in the “Regional Implementation Manual for the Evaluation of Dredged Material Proposed for Disposal in New England Waters", dated 6 May 2004. Based on the sediment chemistry tests, CAD cell disposal represented the most feasible and appropriate sediment disposal site.4
Due Diligence: Based on communications with local officials and a review of the Massachusetts Office of Energy and Environmental Affairs database of waste sites and reportable releases, the site was determined to be subject to multiple releases of petroleum products, and reports of unknown sheens on the water in the inner harbor, since the project was last dredged in 2011.
Dredged Material Disposal or Reuse: Dredged material dewatering will not be necessary since the dredged material will be disposed of in the CAD cell. EPA reviewed the sediment chemistry data for the project and determined that the material was acceptable to be placed in the New Bedford Harbor CAD cells.5
Rare Species and Wildlife Habitat: Based upon the information provided, the NHESP determined that there are no state-listed species concerns associated with the proposed sediment removal from the hurricane barrier and disposal at CAD cell 2 within New Bedford Harbor.6 It was also determined that the project would not
3 33 CFR 230.9(b) – Categorical Exclusions from NEPA include actions of USACE carried out on authorized projects such as routine operation and maintenance actions. Although the action is categorically exempt from NEPA, the action is required to comply with other Federal law. As such, the USACE provided a 404(b)(1) Feasibility Report pursuant to the Clean Water Act to evaluate project environmental impacts.
4 As noted in EPA email of 14 December 2020 and referenced in the USACE Memorandum for the Record, approved by Jay Mackay and Lawrence Oliver, dated 20 July 2021.
5 Ditto.

Time of Year Restriction (TOY) for In-Water Work: DMF concurred with proposed project schedule and did not impose a TOY for the proposed sediment removal from the gate pockets and disposal into an existing CAD cell.8
CZM Consistency: CZM has no objection to the removal and disposal of the sediment into the existing CAD cell.9
Section 61 Findings: As the Applicant, the USACE did not prepare an Environmental Notice (ENF) or Environmental Impact Report (EIR) in accordance with M.G.L. .c 30, §§ 61 to 62H including (MEPA) claiming sovereign immunity.10
Public Notice: The public notice of the Combined 401 WQC/C. 91 application was published in the New Bedford Standard Times, Bristol County, on March 25, 2021. The Department did not receive any comments during the 21-day public comment period, which ended on April 15, 2021.
Therefore, based on information currently in the record, the Department grants a 401 Water Quality Certification for this project subject to the following conditions to maintain water quality, to minimize impact on waters and wetlands, and to ensure compliance with appropriate state law. The Department further certifies in accordance with 314 CMR 9.00 that there is reasonable assurance the project or activity will be conducted in a manner which will not violate applicable water quality standards (314 CMR 4.00) and other applicable requirements of state law.
Finally, the Department has determined that upon satisfying the conditions and mitigation requirements of this approval, the project provides a level of water quality necessary to protect existing uses and accordingly finds that the project to be implemented satisfies the Surface Water Quality Standards at 314 CMR 4.00.
1. Pursuant to 314 CMR 9.01(3) and 314 CMR 4.04, the Contractor shall take all steps necessary to assure that the proposed activities will be conducted in a manner that will avoid violations of the anti-degradation provisions of the Massachusetts Surface Water Quality Standards, that protect all waters, including wetlands. This condition is
