1.4 PROJECT/SITE CONDITIONS
1.4.1 Physical Data
Data and information furnished or referred to below is for the Contractor's information. The Government shall not be responsible for any interpretation of or conclusion drawn from the data or information by the Contractor.
a. Site Conditions: The indications of physical conditions on the drawings and in the specifications are the result of site investigations and surveys. The conditions represented prevailed at the time the investigations and surveys were made. A pre-dredge survey may be performed by the Government prior to the start of Contractor dredging operations at the site. Before commencing work at the site, the Contractor shall verify the existing conditions indicated on the drawings and in the specifications. See CONTRACT CLAUSE entitled "SITE
INVESTIGATION AND CONDITIONS AFFECTING THE WORK".
b. Weather Conditions: The monthly normal mean temperature and the monthly normal mean precipitation for the site may be obtained by the Contractor from the nearest U.S. National Weather Service Office.
c. Conditions of Channel at Inner Harbor Channels and Anchorages:
Under most weather conditions, the inner harbor is calm to relatively calm with swells typically less than 1 foot. Inner harbor channels and anchorages were last dredged by the State between 2012 and 2013 and have experienced considerable shoaling since that time resulting in controling depths above Mean Lower Low Water (MLLW) in some locations.
d. Channel Traffic: The 8-foot channel is used primarily by a recreation fleet and commercial vessels, which may cause interference with contract operations. The Government will not undertake to keep the channel free from vessels or other obstructions, except to the extent of applicable regulations. The Contractor will be required to conduct the work in such a manner as to obstruct navigation as little as possible, and in the event the Contractor's plant so obstructs the
SECTION 01 11 00 Page 5 channel as to make difficult or endanger the passage of any vessels, the plant shall be promptly moved on the approach of any vessel to such an extent as may be necessary to afford a practicable passage.
e. Conditions at Entrance Channel to Harbor: The tidal currents at the entrance to the Harbor can be substantial (up to 5 knots during maximum flood and ebb tidal periods), creating a potentially dangerous condition. Under optimum weather conditions, the sea swell is typically 1-2 feet in a southerly direction. In normal weather, the sea swell can range from 2-4 feet.
1.5 SUPERINTENDENCE BY THE CONTRACTOR
a. At all times during the performance of the contract and until the work is completed and accepted, the Contractor shall directly superintend the work or assign and have on the worksite a competent project superintendent who is satisfactory to the Contracting Officer and has the authority to act for the Contractor.
b. The project superintendent shall maintain a physical presence at the site at all times and be responsible for all construction and related activities at the site, except as otherwise acceptable to the Contracting Officer.
c. Failure to comply with these requirements shall be deemed as cause for a non-compensatory stoppage and suspension of work until the deficiency is remedied.
1.6 COORDINATION AND DIRECTION DURING CONSTRUCTION
a. The Contractor shall not take or accept any direction or instructions issued by any person, employed by the Government or otherwise, other than the Contracting Officer that changes the terms and conditions of contract actions, the scope, or any change that impacts the cost, price, or schedule. Changes authorized by the Contracting Officer will be in the form of a written, official, signed modification to the contract action received by the Contractor before the Contractor will act upon those changes. The Contractor will comply with the changes clause of this contract when the Contractor believes direction has been given from persons other than the Government Contracting Officer that equate to a change by notifying the Contracting Officer as directed by the clause. Any direction given by any Government employee or any other person outside their authority must be reported to the Contracting Officer.
b. The Contracting Officer Representative (COR) is limited to the authorities stated in the COR appointment letter. If a COR is appointed under this contract, they will be appointed by written letter from the Contracting Officer to the Contractor and COR specific to this contract only. COR appointment letters from previous contracts are not valid for this contract. See the Contracting Officer’s Representative clause of this contract.

1.4 BIDDING SCHEDULE - PAYMENT ITEMS
Payment items for the work of this contract on which the contract progress payments will be based are listed in the BIDDING SCHEDULE and are described below. All costs for items of work, which are not specifically mentioned to be included in a particular Bidding Schedule payment item shall be included in the listed lump sum or unit price item most closely associated with the work involved.
Base Bid Items
a. Item No. 0001, "Mobilization and Demobilization."
Payment will be made for costs associated with mobilization and demobilization for mechanical dredging operations and disposal operations as defined in Special Contract Requirements clause "PAYMENT
FOR MOBILIZATION AND DEMOBILIZATION".
Unit of Measure: Job.
b. Item Number 0002, "Maintenance Dredging and Disposal, Inner Harbor;
Channels and Anchorages".
The contract price per cubic yard for Payment Item Number 0002 shall include all costs of removal to the specified depth, as indicated on the contract drawings, of all materials encountered from the Inner Harbor Channels and Anchorages (including the 8-foot deep Hampton Channel, the 8-foot deep Cross Channel, the 8-foot deep Hampton Anchorage, the 6-foot deep Hampton Anchorage, the 8-foot deep Seabrook Channel, and the 8-foot deep Seabrook Anchorage), and all costs associated with transferring the removed material via hydraulic pipeline, placing it at the designated beach locations, the Route 1A bridge abutment location, and/or the sheet pile wall location, and grading the fill to the lines and grades specified in the contract documents.
The total amount of material removed and placed and graded at the placement locations, and paid for under the contract for Item 0002, will be measured by the cubic yard in place by computing the volume between the bottom surface shown by soundings of the last pre-dredge survey made before dredging begins and the bottom surface shown by the soundings of a post-dredge survey made as soon as practicable after the removal of the material. Dredged material will be included that is within the limits of the side slopes and specified channel overdepth as
SECTION 01 22 00 Page 3 described in Section 35 20 25 DREDGING, Subpart "Overdepth and Side Slope," less any deductions that may be required for misplaced material described in Subpart "Disposal of Excavated Material."
The contract drawings listed in Special Contract Requirements clause, "Contract Drawings and Specifications" are believed to accurately represent conditions existing on the date of the survey shown on the drawings, but the depths and the specific areas to be dredged shown thereon may be verified and corrected by soundings taken by the Government before dredging begins. Determination of quantities removed and the deductions made to determine quantities after having once been made by the Contracting Officer, will not be reopened, except on evidence of collusion, fraud, or obvious error.
Monthly partial payments will be based on approximate quantities determined by Contractor quality control surveys. The pre-dredge survey made immediately before dredging, and the post-dredge survey made as soon as practicable after the removal of the material, will be performed by the Government at no cost to the Contractor.

3.1 GENERAL REQUIREMENTS
Prepare for approval a Project Schedule, as specified herein, pursuant to FAR Clause 52.236-15 Schedules for Construction Contracts. Show in the schedule the proposed sequence to perform the work and dates contemplated for starting and completing all schedule activities. The scheduling of the entire project is required. The scheduling of construction is the responsibility of the Contractor. Contractor management personnel must actively participate in its development. Subcontractors and suppliers working on the project must also contribute in developing and maintaining an accurate Project Schedule. Provide a schedule that is a forward planning as well as a project monitoring tool. Use the Critical Path Method (CPM) of network calculation to generate all Project Schedules.
Prepare each Project Schedule using the Precedence Diagram Method (PDM).
3.2 BASIS FOR PAYMENT AND COST LOADING
The schedule is the basis for determining contract earnings during each update period and therefore the amount of each progress payment. The aggregate value of all activities coded to a contract CLIN must equal the value of the CLIN.
SECTION 01 32 01 Page 4
3.2.1 Activity Cost Loading
Activity cost loading must be reasonable and without front-end loading.
Provide additional documentation to demonstrate reasonableness if requested by the Contracting Officer.
3.2.2 Withholdings / Payment Rejection
Failure to meet the requirements of this specification may result in the disapproval of the preliminary, initial or periodic schedule updates and subsequent rejection of payment requests until compliance is met.
In the event that the Contracting Officer directs schedule revisions and those revisions have not been included in subsequent Project Schedule revisions or updates, the Contracting Officer may withhold 10 percent of pay request amount from each payment period until such revisions to the project schedule have been made.
