About this file

This document is a process flowchart for Progressive Design-Build (PDB) projects utilizing Other Transaction (OT) agreements under 10 U.S.C. § 2808a for military construction (MILCON) projects executed by the U.S. Army Corps of Engineers.

The PDB with OT process comprises eight pre-agreement phases followed by two separate OT agreement phases. Pre-agreement activities include project requirements definition, Request for Qualifications (RFQ), Statement of Qualifications (SOQs) submission, down-selection of qualified firms, pitch presentations, qualifications-based selection (QBS), negotiation of Phase 1 services, and award of the Phase 1 OT Agreement. Agreement Phase 1 uses MILCON Design Funds and encompasses design and preconstruction services, progressing through kickoff and alignment, schematic design, budget lock, design development, preconstruction readiness activities (including BCOES reviews, permitting, early submittals, and site readiness), and culminates in a government decision gateway to authorize Phase 2. The process utilizes open-book cost estimates and pricing schedules during Phase 1, with a switch to firm-fixed price pricing. Agreement Phase 2, funded by MILCON Construction Funds, covers final design and construction documents (overlapping with construction), long-lead item procurement, construction execution in work packages, and project closeout through beneficial occupancy and turnover. Key process features include early alignment of government and industry goals, open-book collaboration driving transparency, iterative and flexible strategy evolution, off-ramp decision points providing government exit protection at key milestones, overlapped design and construction execution, and tailored oversight with periodic reporting on cost, schedule, performance, and risk management.
