PERFORMANCE WORK STATEMENT

FOR

MND FORMAT COST ESTIMATE – EAST CAMPUS FITNESS CENTER

OSAN AIR BASE, KOREA

10 January 2022

1. DESCRIPTION OF SERVICES: The contractor shall provide all personnel, equipment, tools, other items, and non-personal services necessary to provide Ministry of National Defense (MND) Cost Estimating Format Services for the Republic of Korea (ROK) In-Kind program constructions contracts for the following project using EMS software. This shall include off-shore material lists and cost validating vendor quotes.

2. BACKGROUND:

2.1. The Government seeks to obtain cost estimating contractors to perform cost estimating work in the ROK, MND format for ROK In-Kind Program construction contracts.

2.2. MND format cost estimate is subject to overarching and unique submittal using Korean Estimating Management System, Version 7(EMS 7) software or the latest version.

2.3. MND format cost estimate with EMS files shall include complete backup documentations to submit for ROK MND's review.

2.4. XML file which is produced by the latest EMS software shall be reviewed and accepted by Korea Public Procurement Service using PCCS (Public Construction Cost-estimation System;

http://pccs.g2b.go.kr) prior to submitting ROK MND’s review.

3. SPECIFIC TASKS: The tasks shall be completed within 21 calendar days after the issue of solicitation.

3.1. The contractor shall produce an MND format cost estimate using the latest version or Korean EMS Version 7 software. EMS software: Company: Korea Software (고려전산): “EMS7” (current as of March 2017) (www.koreasoft.co.kr, +82-02- 529-6071).

3.2. The contractor shall provide the detailed breakdowns of the MND format cost estimate matching with the necessary value requirements from specifications and drawings.

3.2.1. The detailed breakdowns of the MND format cost estimate shall be in Korean only.

3.2.2. The MND format cost estimate shall include complete backup documentation such as quotes, quantity take-off, and catalog cuts.

3.2.3. The Quantities in the MND format cost estimate shall match up to material/quantity take-off from the specifications and drawings.

3.2.4. The MND format cost estimate shall include offshore material cost estimate, such as systems with components which are locally not available products in meeting the design specification requirements. Also it shall include quantities, unit prices, and total cost for each in Korean Won.

3.2.5. The EMS files shall include complete backup documentation to submit ROK MND's review and XML files which produced by EMS7 software shall be reviewed and accepted by http://pccs.g2b.go.kr/

3.2.6. Each summary sheet shall delineate the cost of materials, labor, equipment, miscellaneous expenses, overhead, profit, V.A.T., and inspector’s cost.

3.2.7. During the entire construction stage, RFI from MND-DIA related with cost shall be responded in timely manner.

4. DELIVERABLES: The contractor shall submit separate MND format cost estimates for the project in both hard copy and electronic formats to include all supporting documentation and information (e.g.

quantity calculation sheets, vendor quotations, etc.). The contractor’s Final Submittals will be reviewed and validated by FED Cost Engineering (EDC).

5. PERFORMANCE REQUIREMENTS SUMMARY (PRS): The contractor service requirements are summarized into performance objectives that relate directly to mission essential items. The performance threshold briefly describes the minimum acceptable levels of service required for each requirement.

These thresholds are critical to mission success.

7. GOVERNMENT FURNISHED DATA/MATERIAL: The Government will furnish a completed design documents such as specifications and drawings in PDF files.

8. QUALITY CONTROL: The Contractor is responsible for the completeness and accuracy of the Work and for compliance with all parts of this contract. The U.S. Army Corps of Engineers is relying upon the professional quality of the Work performed by Contractor. Contractor shall correct all deficiencies identified by the Contracting Officer or Contractor’s own QC review relating to completeness or accuracy of the Work and compliance with the contract and/or laws or regulations.

9. REQUIRED TRAINING AND COMPLIANCE:

9.1. All required training of contractor employees (including subcontractor employees) described herein shall be completed except as otherwise noted. All compliance requirements described in this PWS shall apply equally to contractor and subcontractor employees. The contractor (and each subcontractor) shall maintain all records of their employees’ completion of the required training and other compliance requirements specified herein, for the entire term of the contract, which shall be subject to the Contracting Officer’s (or designated representative’s) periodic inspection, the training and frequency of which shall be at the Contracting Officers sole discretion. All contractor and subcontractor costs for training and compliance, including changes in training and compliance requirements, shall be included in the contractor’s price for its services, and not separately reimbursed. Contractor employees found not to be in compliance with the training or compliance requirements described herein shall be given a reasonable amount of time to remediate their non-compliance; but may be ordered to be removed from the project at no cost to the Government, if they fail to remediate within the required time. The contractor’s (including subcontractors at any tier) failure to effectively manage and enforce its employee training and compliance program may be reflected in the contractor’s interim and final performance rating for the contract.

9.2. Theater Specific Training. All invited contractor and subcontractor employees shall complete the theater specific training identified in Para. 2-2 of USFK Regulation 350-2 Theater Specific Required Training for Arriving DOD Personnel and Units Assigned to, Rotating to, or In Temporary Duty Status to Korea, 9 February 2016 (or as updated or revised). Theater specific required training may be accessed through the USFK website at: www.usfk.mil under “Newcomers,” “Training.” The training must be completed prior to arrival in Korea for contractor or subcontractor personnel on permanent assignment and is valid for the entire period of employee performance in Korea; but must be re-completed once every 36 months if the employee’s tour of employee extends longer than that period. Contractor and subcontractor employees present in Korea on a Temporary Duty (TDY) basis must be complete the training requirements of Para. 2-2 annually and the training must be current within the last 12 months of http://www.usfk.mil/ their presence in Korea.

10. REQUIRED TRAINING AND COMPLIANCE: (N/A).

11. DATA RIGHTS: The Government has unlimited rights to all documents/material produced under this contract. All documents and materials produced under this contract shall be Government owned and are the property of the Government with all rights and privileges of ownership/copyright belonging exclusively to the Government. These documents and materials may not be used or sold by the contractor without written permission from the Contracting Officer. All materials supplied to the Government shall be the sole property of the Government and may not be used for any other purpose.

This right does not abrogate any other Government rights.

12. ORGANIZATIONAL CONFLICT OF INTEREST: Organizational conflict of interest (“OCI”) means that because of other activities or relationships with other persons, a person is unable or potentially unable to render impartial assistance or advice to the Government, or the person’s objectivity in performing the contract work is or might be otherwise impaired, or a person has an unfair competitive advantage. The services rendered under this contract are for the purposes of defense of claims in pending litigation against the Government. The parties to this matter are:

The Contractor shall ensure that it does not have a current OCI with any of the project above listed entities. If an OCI is discovered or arises during the term of this contract, Contractor shall immediately inform Government counsel.

13. ANTITERRORISM/OPERATIONS SECURITY REQUIREMENTS

13.1. For Contracts Requiring Performance or Delivery in a Foreign Country. All non-local contracting personnel will comply with theater clearance requirements and allows the combatant commander to exercise oversight to ensure the contractor’s compliance with combatant commander and subordinate task force command.

13.2. Access and general protection/security policy and procedures. All contractors and all associated sub-contractor’s employees shall comply with applicable installation, facility and area commander installation/facility access and local security policies and procedures (provided by government representative). The contractor shall also provide all information required for background checks to meet installation/facility access requirements to be accomplished by installation Provost Marshal Office, Director of Emergency Services or Security Office.

Contractor workforce must comply with all personal identity verification requirements (FAR clause 52.204-9, Personal Identity Verification of Contractor Personnel) as directed by DOD, HQDA and/or local policy. In addition to the changes otherwise authorized by the changes clause of this contract, should the Force Protection Condition (FPCON) at any installation or facility change, the Government may require changes in contractor security matters or processes.

13.3. For Contracts Requiring Performance or Delivery in a Foreign Country.
