The following items are applicable to this modification:
a. The purpose of this amendment is to make changes and to provide responses to vendors’ questions as shown below.
1. To change the last sentence of sub-paragraph 6.3.1. of Addendum to FAR 52.212-1 as follows: The definition of Fully Burdened Labor Rate is fully loaded hourly rate that includes all salary, overhead costs, general administrative expenses, and profit. In addition, the sub-paragraph 3.2.1 of the Performance Work Statement (PWS) has been changed to read as follows: The detailed breakdown of the MND formatted cost estimate shall be written in English or Korean language.
2. To make changes to Attachment D of the solicitation.
3. To extend the closing date and time of the solicitation to 12 December 2022 at 1:00 p.m.
4. To answer vendors’ questions as shown below:
i. Question 1: Do we require to submit the fee proposal for Attachment E (Osan East Campus Fitness
Center)? We would like to clarify it due to the Attachment E cited as a sample project in the solicitation.
Response: Offerors are required to submit completed Attachments A and D with their proposal as specified in the solicitation. Please refer to paragraph 6 titled “Proposal Submittal” within Addendum to FAR 52.212-1 of the solicitation. Attachment A is the Price Table that offeror shall submit its prices for the base contract.
Attachment D is the Price Table of the Sample Task Order that the Offeror shall submit as part of its technical proposal. For Attachment D, requirement is outlined in Attachment C with the PWS and Attachment E with the drawings.
ii. Question 2: Last week, I submitted a revalidation of SAM certification due to expired SAM registration. The re-validation process is expected to take long (at least a month). Please advise.
Response: In accordance with FAR 52.204-7, all Offerors shall be registered in SAM at the time of proposal submission and continue to be registered. Please see FAR clause 52.204-7 for more detailed information.
iii. Question 3: Can additional Labor Rates be proposed beyond those listed in RFP Attachment A – Price Table?
Response: No, the Offerors are required to propose fully burdened rates for the labor categories identified in Attachment A of the solicitation.
iv. Question 4: Please confirm whether travel and per diem are to be included in the fully burdened labor rates or if they are to be priced separately as suggested in RFP Attachment D – Price Table for Sample Task Order?
Response: The format of Attachment D is more of a breakdown, but the Attachment A centers on Fully Burdened Labor Rate for each labor category when considering labor section of the attachment.
Typically, there should be no per diem incurred into the costs of providing the services outlined in each project. Depending on each project, travel expenses may occur due to number of meetings held at the Government installation(s).
The definition of Fully Burdened Labor Rate mentioned in sub-paragraph 6.3.1 of Addendum to FAR 52.212-1 has been changed as shown in the following: The definition of Fully Burdened Labor Rate is fully loaded hourly rate that includes all salary, overhead costs, general administrative expenses, and profit.

The Republic of Korea (ROK)-United States (U.S.) Status of Forces Agreement (SOFA), precludes the U.S. Government from granting Invited Contractor or Technical Representative Status to any offeror, awarded a contract under this requirement. All offerors submitting a proposal, including U.S. sources, must already have, or obtain the requisite business licenses directly from the ROK Government, and conduct business in accordance with all applicable ROK laws, including but not limited to, rules and policies regarding labor, taxation, and immigration. Any contractor not already doing business in Korea, must submit adequate verification in its initial proposal that it has the requisite business licenses directly from the ROK Government to perform the contract and the capacity to conduct business in accordance with all applicable ROK laws, including but not limited to, rules and policies regarding labor, taxation, and immigration. If an initial proposal does not fully demonstrate this authorization and capacity, it may not be further considered for award. Whether an offeror demonstrates this authorization and capacity shall be determined by the Contracting Officer.
