SECTION 00 01 10 - TABLE OF CONTENTS

The following have been modified:

BID SCHEDULE NOTES

1) Bidders are required to bid on all items listed on the BID SCHEDULE in addition to inserting a total quoted bid in the appropriate space provided. Failure to do so will be considered good cause to disqualify the bid.

2) All quantities shown on the BID SCHEDULE are estimated quantities. Prefilled and bidder-filled estimated quantities are used for bidding purposes only. Task orders will be issued on an as needed basis which will use the unit prices provided on the bid schedule as binding rates. Quantities for task orders will be estimated and subject to a Not-to-Exceed price. Task orders may be modified as necessary to increase or decrease the quantities required under the task order, subject to availability of funds.

3) Bids are being solicited on a unit price basis. However, bidders shall insert in the spaces provided in the SCHEDULE both the "unit price" and the "estimated amount" resulting from applying the said unit price to the estimated quantity shown.

4) All unit prices shown will be subject to verification by the Government. All bids will be reviewed for mistakes, and if unit prices and estimated amounts do not agree, the unit prices will control. Bid modifications, if any, should take this into account.

5) Unit prices provided in the Bid Schedule will become binding upon award for the life of the contract and must be used on each subsequent task order. Adherence to these rates will be reviewed through submittal of supporting documentation with each task order proposal, including the sample task order.

6) The wage determinations issued in the solicitation are provided in order to assist in calculating unit prices.

Binding wage determinations will be issued on a task order basis. The successful bidder may request an equitable adjustment on the basis of increased wage rates after award of each new task order.

7) The sample task order is for bidding purposes only. Bidders shall use unit prices from the Base Year in order to complete the sample task order. No task order will be awarded from the sample task order;

however, the Sample Task Order Total will be added to the Base Year through Option Year 4 Totals for a Grand Total. The Grand Total will be used in order to determine the lowest evaluated price and apparent low bidder. Refer to the Bid Schedule Notes indicated in the Descriptions above for more information regarding each line item.

8) The dredge and attendant plant used to complete the bid schedule shall be listed on the Equipment Schedule (see Specifications, Appendix C), and shall be complete with full operating personnel and operating status for the contract period or any extension thereof. Refer to Definitive Responsibility Criteria below. No award will be made to an offeror that does not meet all of the required criteria.

9) CLINs 0001, 0009, 0017, 0025, 0033, 0041: Mobilization and Demobilization from Home Port - Price includes all work and equipment on a per-job basis required to get the dredge and attendant plant (Section 35-20-23 Part 3) ready to leave home port and also the price associated with demobilizing the attendant plant and dredge when it returns to home port after last dredge site. For progress payment purposes, these line items will be split 60% for mobilization and 40% for demobilization.

10) CLINs 0002, 0010, 0018, 0026, 0034, 0042: Dredge and Floating Plant Effective Time Operation - Estimated quantity of hours to dredge 1,200,000 of material is based on the effective time rate of cubic yards per hour of the proposed dredge and attendant plant, as described on the first page of the bid schedule. Effective time is defined in Specification 35 20 23 Dredging at Paragraph 7.1.2. These CLINs include all work and equipment required to operate the dredge and attendant plant during effective time on a per-hour basis. They do not include effective time for operating the onshore disposal equipment. In order to calculate the production rate, refer to Specifications Appendices B and C, based on an estimated 1,200,000 cubic yards of dredge material to be moved.

11) CLINs 0003, 0011, 0019, 0027, 0035, 0043: Dredge and Floating Plant Non-Effective Time Operation - Non-effective estimated quantities of hours are is assumed for bidding purposes to be 30% of the Effective Time estimated hours. The unit price for non-effective time shall be 70% of the unit price for effective time (to the nearest cent), which is binding on the bidder. For a definition of Non-Effective Time, see Specification 35 20 23 Dredging at Paragraph 7.1.3. These CLINs include all work and equipment required to operate the dredge and attendant plant during non-effective time on a per-hour basis. They do not include non-effective time for operating the onshore disposal equipment.

12) CLINs 0004, 0012, 0020, 0028, 0036, 0044: Dredge and Floating Plant Mileage for Mobilization and Demobilization - Home port site location will need to be established to determine the mileage from home port to first dredge site and last dredge site back to home port. A chart is provided for calculating this mileage on the first page of the bid schedule. The price per mile includes all labor, fuel, etc. for mobilizing and demobilizing and attendant plant (Section 35-20-23 Part 3) at the beginning and end of each task order under this contract, on a per-river mile basis. It should not include the labor for an entire dredge crew. For bidding purposes, the first dredge site location will be Ohio River Mile 975 and the last dredge site will be Ohio River Mile 532,

13) CLINs 0005, 0013, 0021, 0029, 0037, 0045: Transit Mileage - These CLINs assume 800 miles of transit during the sample task order and during each year of performance. These CLINs include all fuel, and labor, to transit the dredge, floating plant, 3200’floating pontoon pipeline, and all other required equipment, labor and materials on a per-river mile basis.

14) CLINs 0006, 0014, 0022, 0030, 0038, 0046: Onshore Disposal Equipment Mobilization and Demobilization - Price includes all work and equipment a per-job basis required to get the onshore disposal equipment ready to use, or to break it down and stow it as part of the floating plant, at a particular disposal site (See Section 35 20 23 Part 4). For progress payment purposes, these line items will be split 60% for mobilization and 40% for demobilization.

15) CLINs 0007, 0015, 0023, 0031, 0039, 0047: Onshore Disposal Equipment Effective Time Operation - Estimated quantity of hours for anticipated Effective Time Operation of Onshore Disposal Equipment has been pre-filled by the Government for these CLINs. Effective time is defined in Specification 35 20 23 Dredging at Paragraph 7.1.2. These CLINs include all work and equipment required to operate the onshore disposal equipment during effective time on a per-hour basis.

16) CLINs 0008, 0016, 0024, 0032, 0040, 0048: Onshore Disposal Equipment Non-Effective Time Operation - Estimated quantity of hours for anticipated Non-Effective Time Operation of Onshore Disposal Equipment has been pre-filled by the Government for these CLINs. Non-effective time is defined in Specification 35 20 23 Dredging at Paragraph 7.1.3. These CLINs include all work and equipment required to operate the onshore disposal equipment during non-effective time on a per-hour basis.

17) ***Amendment0002***Home Port shall be defined as one location on the river where your dredge equipment will enter the water. This Home Port location shall remain constant throughout the life of the contract. Any costs associated with getting your dredge and attendant plant to your Home Port location, shall be included in your Mobilization and Demobilization line item costs to include: 0001, 0009, 0017, 0025, and 0033.***Amendment0002***

SECTION 00 70 00 - CONDITIONS OF THE CONTRACT

The following have been added by full text:

252.236-7004 PAYMENT FOR MOBILIZATION AND DEMOBILIZATION (DEC 1991)

(a) The Government will pay all costs for the mobilization and demobilization of all of the Contractor's plant and equipment at the contract lump sum price for this item.

(1) 60 percent of the lump sum price upon completion of the contractor's mobilization at the work site.

(2) The remaining 40 percent upon completion of demobilization.

(b) The Contracting Officer may require the Contractor to furnish cost data to justify this portion of the bid if the Contracting Officer believes that the percentages in paragraphs (a) (1) and (2) of this clause do not bear a reasonable relation to the cost of the work in this contract.

(1) Failure to justify such price to the satisfaction of the Contracting Officer will result in payment, as determined by the Contracting Officer, of --

(i) Actual mobilization costs at completion of mobilization;

(ii) Actual demobilization costs at completion of demobilization; and

(iii) The remainder of this item in the final payment under this contract.

(2) The Contracting Officer's determination of the actual costs in paragraph (b)(1) of this clause is not subject to appeal.

Section 00120 - Solicitation Contract Form

EVALUATION FACTORS

BID EVALUATION FACTORS.

The following criteria are for bidding purposes:

a. The dredge will remove an estimated 1,200,000 cubic yards (917,500 cubic meters) of sediments from the Ohio River channel and associated tributaries. The sediments consist of primarily medium to coarse-grained sands with a d50 of 0.03 inch (0.8 mm).

Laboratory analysis of the sediment samples taken from the project area indicate an average sediment dry unit weight of 126 lb/ft3 (2.019 g/cc). This measurement indicates 34.50 percent voids, based on the assumption of a 165 lb/ft3 (2.65 g/cc) particle density for sand. In the saturated state, such as sediments on the bottom of the project area, the void space is filled with fresh water, resulting in a saturated sediment density of approximately 141 lb/ft3 (2.257 g/cc).

The dredge efficiencies for this project are given in Table I and depend on the dredge configuration.

The production calculation is to be based on the capability of the dredge plant to pump a 78 lb/ft3 (1.25 g/cc) slurry at the point in the dredging cycle in which the cutterhead is engaging sufficient bank height for loading the pipeline with slurry. The dredge production will be calculated in volumetric production (cubic yards), with the calculations based on the saturated sediment density. The carrier water has an assumed water density of 62.4 lb/ft3 (1.0g/cc). The pump head reduction coefficient (K) is assumed to be 0.24. The dredge production is calculated by the following equation:

The dredge must be capable of picking up and transporting the sediment to disposal within the limitations imposed by conditions of pump cavitation and available horsepower. Calculations used to support the bid production shall be in accordance with this section and Appendix B, EVALUATION OF THE DREDGE PUMP at the end of Section 35 20 23 DREDGING.

b. The dredge will operate an equivalent of 18 hours each calendar day at the effective bid price.

c. The dredge will dredge to a depth of 33 feet (10.0 meters) below the water surface with a terminal elevation of 10 feet (3 meters) above the shore or water surface. Total pipeline length shall include the discharge line on the dredge, plus 2400 feet (731.5 meters) of pontoon discharge line, two (2) swivel elbows and all other associated connection fittings.

d. The information obtained from equipment schedule, production calculations, and pump and system curves for the dredge and plant.

The comparative total cost of each bid received will be computed by adding the following cost elements:

(1) The lump sum cost of mobilization and demobilization of the dredge and attendant plant.

(2) The cost of operating the dredge and attendant plant.

a. Estimating effective pay time, to the nearest hour, will be determined by dividing 1,200,000 cubic yards (917,500 cubic meters) of sediment dredge production for conditions stated above and the Contractor’s corresponding guaranteed production rate.

b. Estimated non-effective pay time will be assumed to be 0.3 times (a) above.

c. The cost of operating the dredge and attendant plant will be computed by adding the products of:

1. Estimated effective pay time multiplied by the appropriate bid price per hour.

2. Estimated non-effective pay time multiplied by the appropriate bid price per hour.

(3) The cost of Mileage for Mobilization and Demobilization of dredge and attendant plant

a. The cost for travel by the dredge, from home port to first dredge site and from last dredge site to home port will be computed by multiplying mileage from home port to ORM 975 by appropriate bid price per mile and mileage from ORM 532 to home port by appropriate bid price.(A chart is provided for calculating this mileage on the first page of the bid schedule).

b. The cost of travel for the dredge while on Transit mileage between dredge sites, will be computed by multiplying an assumed total distance of 800 mile by the appropriate bid price per mile.

(4) The cost of operating On-Shore Disposal Equipment will be computed by adding the products of:

a. The lump sum cost of mobilization and demobilization of the On-Shore Disposal Equipment.

b. The estimated effective pay time multiplied by the appropriate bid price per hour.

c. Estimated non-effective pay time multiplied by the appropriated bid price per hour.

1.3 COMMENCEMENT, PROSECUTION AND COMPLETION OF WORK

1.3.1 Commencement, Prosecution, and Completion of Work (Apr 1984) FAR 52.211-10

The Contractor shall be required to

a) commence to assigned work site under this contract within 15 calendar days after the date the Contractor receives the notice to proceed, then proceed travel to the first assigned work site,

b) proceed to dredge site indicated in the notice to proceed prosecute the work diligently, and

c) prosecute the work in a manner to complete all dredging operations within the schedule determined by the Contracting Officer. All work shall be completed within the dates of 15 May to 15 November after receiving notice to report. Upon termination or completion of the contract period, the dredge plant will be released to the Contractor.

1.3.2 Delivery, Inspection, Acceptance/Rejection

The Contractor shall deliver the dredge and attendant plant base equipment ready for operation at the work site, as directed by the Contracting Officer or Representative (COR), the work site shall be reached within 15 calendar days after the date of receipt by the Contractor of the Notice to Proceed.

The plant at this time shall not include any additional equipment as specified in Section 35 20 23 DREDGING, Part 4, unless specifically requested in writing by the Contracting Officer. Upon arrival of the dredge plant at the delivery site, the Contracting Officer's authorized

DOCUMENT 00 80 00.00 06 Page 10 representative will inspect the plant. The Contractor will be notified of acceptance or rejection of the plant within twenty-four hours after delivery. If accepted, the dredge will be given an immediate assignment. If the Contracting Officer determines, during the pre-work inspection at the delivery site or at any time thereafter, that the dredge and/or attendant plant fails to meet the contract specifications, the dredge plant may be rejected, and the contract terminated under Contract Clause: Default.

1.3.3 Additional Plant

The additional plant as specified in Section 35 20 23 DREDGING, Part 4, shall be delivered within fourteen calendar days after the receipt of the written notification from the Contracting Officer outlining the required delivery site and type of equipment requested.

1.3.4 Contract Option for Additional Contract Period(s)

The Contacting Officer may exercise the option to extend the contract for the calendar year 2021 thru 2024 dredging seasons. If the Government intends to exercise the options(s), the Contracting Officer will issue a written notice within 30 calendar days prior to completion of the current contract period. If an option is executed, all specifications and contract requirements will remain the same as the original contract period. Payments will be made using the applicable unit prices for the contract period in which the dredging operations are performed. These contract prices are indicated in Section 00010 within the bid schedule.

1.3.5 Suspended Operations

The Contracting Officer reserves the right to suspend operations whenever river or other conditions make dredging operations impractical or uneconomical. If at the convenience of the Contractor the dredge plant is removed from the site where the suspension occurred during the period of suspension, the Contractor will be required to return the dredge plant to operations within five calendar days as specified in Section 35 20 23 DREDGING, Part 7. Such periods of suspension when ordered by the Contracting Officer will not be counted as part of the contract work period.

1.3.6 Termination

The Contracting Officer may terminate the contract in the event of late delivery of the dredge plant or any time after a contract work period of one calendar day by giving three calendar days written notice to the Contractor.

1.8 CONTRACT DOCUMENTS

a) The Government will provide the Contractor, without charge, one set contract documents except publications incorporated into the technical provisions by reference, in electronic or paper media as

b) The Contractor shall--

1) Check all documents furnished immediately upon receipt;

2) compare all documents and verify the figures before laying out the work;

5) reproduce and print contract documents as needed.

c) In general--

1) Large scale drawings shall govern small scale drawings; and

1.12 PHYSICAL DATA (APR 1984) FAR 52.236-4.

Data and information furnished or referred to below is for the Contractor's information. The Government shall not be responsible for any interpretation of or conclusion drawn from the data or information by the Contractor.

1.12.1 Potential Dredge Material

The material to be dredged may consist of sand, gravel, loose rock, silt, mud, clay, stumps, roots, logs, riprap, driftwood, sunken objects, pilling, stone dikes, broken concrete/asphalt, and miscellaneous other debris. The dredge shall be equipped with suitable pump impellers and cutterheads to efficiently handle these varying materials.

1.12.1.1 In-situ Core Samples

a) Sand and Gravel

Laboratory analysis of the sand and gravel samples taken from the project area indicate an average sediment dry unit weight of 108 lbs. /cubic foot (cf). This measurement indicates a 34.50% voids ratio, based on a 165.4 lbs. /cf particle density. In the saturated state, the voids are filled with fresh water resulting in a saturated insitu sediment density of approximately 129.85 lbs/cf.

b) Clay

Analysis of samples for clay and silt indicates a dry unit weight of 78.4 lbs/cf. This measurement indicates 54.99% voids ratio, based on 170.4 lbs/cf. In the saturated state, the void space is filled with fresh water resulting in a saturated in-situ sediment density of 112.1 lbs./cf for clay.

1.12.2 Water Current

The current may vary from zero to five knots depending on site and river conditions.

1.12.3 Production Calculation

The production calculation is to be based on the capability of the dredge plant to pump a 78 lbs. /cf slurry for sand/gravel and 68.7 lbs.

/cf for clay/silt at the point in the dredging cycle in which the cutterhead is engaging sufficient bank height for loading the pipeline with slurry. The dredge production will be calculated in volumetric production (cubic feet) with the calculations based on the saturated in-situ sediment density. The carrier water has an assumed water density of 62.4 lbs/cf. The pump head reduction coefficient (K) is assumed to be 0.24. Dredge production is calculated using a dredge efficiency factor based upon design, a constant average bank height efficiency factor, and the Production Equation all outlined in Section 00120 Evaluation Factors for Award.

1.12.4 Weather Conditions

The Contractor shall make his own investigations as to weather conditions at the site. Data may be obtained from various National Weather Service offices located in or near principal cities, such as

1.12.5 Transportation Facilities

Roads and railroads in the general area are shown on the drawings.

Access ways shall be investigated by the Contractor to satisfy themselves as to their existence and allowable use.

1.12.6 Work Conditions

The work required may consist of performing operations in such areas as restricted channels, lock approaches, harbors, and other similar areas that could hinder efficiency.

1.13 UTILITIES

The Contractor shall provide at least project channel dimensions over all utility crossings (pipelines, structures, etc.). The Contractor shall submit for approval by the Contracting Officer a detailed plan of operation at each pipeline or utility crossing where construction surveys indicate project channel does not exist. Where dredging to the required dimensions might endanger any structure, the Contracting Officer may require the required excavation in the vicinity of such structure. The plan shall contain emergency measures to be taken in the event of an accident. The Contractor, when operating within fifty meters of any utility or other type structure, shall notify the owner at least three calendar days prior to performing work. The Government will not be responsible for any damage to structures or utilities due to the Contractor's deviation from the approved plan.

Any unidentified pipelines or structures which may be found within the limits of work shall not be disturbed nor shall dredging or the disposal of dredged material be performed at these locations unless, and until, approved by the Contracting Officer.

1.14 NOT USED

1.15 LAYOUT OF WORK

1.15.1 General

a) The Contractor shall be responsible for executing the work to the lines and grades that may be established or indicated by the Contracting Officer.

b) The Government Inspector will inspect dredge layouts, location marks, buoys, gages, and references established by the Contractor in order to insure positional and vertical compliance with layout drawings furnished prior to dredging the site. The presence or absence of the Dredge Inspector shall not relieve the Contractor of responsibility for proper execution of work.

c) The Contractor shall maintain all equipment, location marks, buoys, gages, and position references to properly control the dredging alignment to Class 1 standards as outlined in EM 1110-2-1003, "Hydrographic Surveying". If such equipment, location marks, buoys, gages, or position references are displaced, destroyed, or otherwise become inoperable, the Contractor shall re-establish the relative control measures as directed by the Government Inspector. Government. Any expense incurred by the Government in replacing required control will be deducted from amounts due or to become due the Contractor.

1.15.2 Contracting Officer's Field Representation

A Contracting Officer's Representative (COR), or a Government Inspector will visit the dredge daily or as needed to check on the progress of the work, compliance with requirements, and to consult with the Contractor's Superintendent. Access must be available to such a government representative at any time during the rental period.

1.15.3 Requirements of the Contractor

a) The Contractor shall:

1) Furnish upon request of the Government Inspector, the personnel and survey launch specified in Section 35 20 23, DREDGING, Paragraph 3.3 (2), for the purpose of survey, pre-dredge layout inspection, transportation, inspection of work/plant/disposal site, positioning of buoys, and any other items of work related to the contract.

2) Furnish upon request of the Government Inspector, or other

Government employee, suitable transportation between the Contractor's landing flat and any item of the dredge plant.

3) Furnish to the Government Inspector or other Government employee on board the dredge all required records, reports, charts, logs, etc.

1.17 PERFORMANCE OF WORK BY THE CONTRACTOR

a) Per "PERFORMANCE OF WORK BY THE CONTRACTOR" (APR 1984), FAR 52.236-1: The Contractor shall perform on the site, and with its own organization, work equivalent to at least 60 percent of the total amount of work to be performed under the contract. This percentage may be reduced by a supplemental agreement to this contract if, during performing the work, the Contractor requests a reduction and the Contracting Officer determines that the reduction would be to the advantage of the Government.

b) For purposes of this paragraph, "WORK BY THE CONTRACTOR" is defined as prime Contractor direct contract labor (including testing and layout personnel), exclusive of other general condition or field overhead personnel, material, equipment, or subcontractors. The "TOTAL AMOUNT OF WORK" is defined as total direct contract labor (including testing and layout personnel), exclusive of other general condition or field overhead personnel, material, or equipment.

c) Within 7 calendar days after the award of any subcontract, either by himself or a subcontractor, the Contractor shall deliver to the Contracting Officer a completed SF1413 "Statement and Acknowledgment."

The form shall include the subcontractor's acknowledgement of the inclusion in his subcontract of the clauses of this contract entitled "Davis-Bacon Act," "Contract Work Hours and Safety Standards Act-Overtime Compensation," "Apprentices and Trainees," "Compliance with Copeland Regulations," "Withholding of Funds," "Subcontracts," "Contract Termination-Debarment," and "Payrolls and Basic Records." a) Payment for Mobilization and Demobilization of the dredge plant and supporting equipment shall be made by lump sum payment. The lump sum is for preparation of equipment and overhead costs incurred prior to work as per Section 00 80 00.00 06 SPECIAL CLAUSES. Mobilization payment shall be included in the first daily pay estimate at the initial work site.

Demobilization shall be included in the last daily pay estimate at the final work site upon suspension of work. Payment for travel from home port to initial work site and final work site to home port shall be paid from the mileage rate for Mobilization and Demobilization payment rate.
