About this file

This document is a Justification and Approval (J&A) for procuring brand name security systems under a competitive construction contract set aside for small disadvantaged businesses. The U.S. Army Corps of Engineers will award a firm fixed price contract to renovate buildings 1025 and 1038 at Kirtland Air Force Base in New Mexico for $6.75 million and $6.1 million respectively. The contract requires Advantor intrusion detection systems, Monaco fire alarm panels, and Industrial and Commercial Security System access control and CCTV systems totaling $91,850 due to the need to maintain compatibility with existing base security infrastructure. Market research confirmed no equivalent alternatives exist. The solicitation was set aside for small disadvantaged businesses to increase competition, with four firms deemed capable of the work.

Department of the Army

JUSTIFICATION AND APPROVAL (J&A)

FOR OTHER THAN FULL AND OPEN COMPETITION

U.S. Army Corps of Engineers Albuquerque District

BRAND NAME JUSTIFICATION AND APPROVAL

1. Contracting Agency: The contracting agency responsible for this procurement action is the U.S. Army Corps of Engineers, South Pacific Division, Albuquerque District (CESPA), Albuquerque, New Mexico.

2. Description of Action: Requirement is for a new firm fixed-price construction contract which includes “brand name only” components for security systems, fire alarm, notification systems and controls systems. The contract will be awarded using expiring Facilities, Sustainment, Restoration and Modernization (FSRM) funding. Only a portion of the acquisition is for brand-name products. The estimated cost for the brand-name equipment is $91,850.

3. Description of the Supplies/Services: Two new construction projects, Design/Bid/Build FY23 AFRCO - FSU Building 1025 Section-D Renovation and FY23 AFRCO - FSU Building 1038 Renovation, Kirtland Air Force Base, Bernalillo County, New Mexico, include four “Brand Name” components below:

a. Intrusion Detection System (IDS) by Advantor Security Systems are required by the Major Command. The systems shall monitor all exterior entry doors to include electrical and mechanical room and interior entry into the Security Vestibule. The Building 1025 is an existing facility which already has a current IDS Control Panel from Advantor Security Systems to monitor the entire Building 1025. The renovation will require the contractor to provide and install an additional IDS, which will be tied to the existing IDS. The current government estimate of direct material cost of the brand name components listed above is $9,914.00.

b. Monaco MAAP-X Fire Alarm Panel: Currently, Kirtland AFB is updating all of the Fire Alarm Panels and systems to Monaco, which are required by the Major Command.

The fire department’s mission is to have a uniform/consistent system throughout the base.

The Monaco system has been vetted by the Base Fire Department (FD) and it satisfies all security requirements. The current government estimate of direct material cost of the brand name components listed above is $27,736.00.

c. Access/Entry Control by Industrial and Commercial Security System, Inc (ICSS): This is an integrated base wide access control system required by the installation to control and monitor access to facilities in classified areas that require positive access control. Building 1025 is an existing facility which already has a current access control system. If a different access control system is used in the proposed project renovation within the existing facility, it would not be compatible with the current system. Industrial and Commercial Security System’s access control system is their proprietary system. The current government estimate of direct material cost of the brand name components listed above is $8,704.00.

d. Closed-circuit television (CCTV) System by Industrial and Commercial Security System, Inc: This is an integrated base CCTV system required by the installation to see and monitor the personnel wanting to access facilities in classified areas that require positive access control. Building 1025 is an existing facility which already has a current CCTV system. If a different CCTV system is used in the proposed project renovation within the existing facility, it will not be compatible with the current system and control panel. Industrial and Commercial Security System’s CCTV is their proprietary system.

Only Industrial and Commercial Security Systems, Inc. is allowed to modify, install and test CCTVs. The current government estimate of direct material cost of the brand name components listed above is $45,496.00.

The estimated cost for the materials being purchased under this contract was developed using the Micro-Computer Aided Cost Estimating System (MCACES). The individual estimated unit costs contained in the MCACES data base for these materials are from a vendor or supplier market survey conducted by the contractor that developed MCACES software.

4. Authority Cited: 10 U.S.C. 2304(c)(1) and FAR 6.302-1. Only one responsible source and no other supplies or services will satisfy agency requirements.

5. Reason for Authority Cited: The procurement of the selected brand-name products are essential to this requirement and thereby preclude consideration of a product manufactured by another company. Kirtland AFB Base Civil Engineering (BCE) and the Base Fire Prevention Chief have set base standards for these systems for Kirtland AFB. Building 1025 is an existing facility which already has a current IDS, DSX and CCTV security access control and monitoring systems. If different security systems are used in the proposed project renovation within the existing facility, they will not be compatible with the current systems.

Currently Kirtland AFB is updating all the Fire Alarm Panels and systems to Monaco, which are required by the Major Command. The fire department’s mission is to have a uniform/consistent system throughout the base. The Monaco system has been vetted by the FD and it satisfies all the security requirements.

Having the specified manufacturer will eliminate the problems in the field, prevent certification failure and assure mission readiness. The maintenance and repair training for these systems is brand name specific. It is necessary to keep the systems the same in order to communicate with each other, for parts compatibility, and for storage and training purposes. With multiple brand names, the entire system would not function as required by Kirtland AFB.

The BCE spare parts inventory will remain manageable with all systems of the same brand name.

Also, for every brand name specified, a different software system is required, resulting in extra costs for the purchase of each system. Using Advantor, ICSS and Monaco alleviates communication and compatibility issues caused by using multiple brand name system and results in fully functioning base-wide alerting and reporting systems to meet local command and Special Access Program Facility (SAPF) (where applicable) Certifications. Using the name brand on all required security systems, access systems, and fire alarm systems is the most cost effective.

6. Efforts to Obtain Competition: The solicitation being issued will be a competitive IFB with a Small Disadvantaged Business set-aside construction contract. Market research has been conducted to select the most appropriate solicitation method for this effort. A sources sought was issued in JAN 2023. Nine firms responded. Overall, four firms provided enough information to satisfy the capability requirements as identified in the synopsis. Based on this evaluation, adequate competition does exist to justify restricting this acquisition to small businesses. The brand name components represent a small portion of the overall construction project contract amount. The current working estimates for the B-1025 and B-1038 construction contracts are $6,750,824 & $6,101,385.27, respectively. Approximately $91,850 is for the brand-name equipment. The prime construction contractor will be responsible for the procurement of the products listed in this J&A and can obtain competition through various suppliers if applicable.

Use of alternative products and systems would be counterproductive in that they are not fully compatible with the base standards, and would increase future cost of maintenance, use of energy, training, and human labor hours. Any savings gained during procurement would be offset by use of other control systems.

7. Actions to Increase Competition: This competitive IFB SDB set-aside action is a one-time requirement that does not include subsequent opportunities for competition. No further actions are anticipated beyond this requirement. This Justification and Approval (J&A) supports a discrete requirement that will end when the project is completed. Therefore, no opportunity to increase competition for the requirement is covered by this J&A.

8. Market Research: There are no known alternative systems that are fully compatible with these systems based on lessons learned and expert judgment by subject matter experts and experience of the Air Force. Use of alternative products and systems would be counterproductive in that they are not fully compatible with the base standards and the existing facility systems.

9. Interested Sources: A Notice of Intent was published on the Governmentwide Point of Entry (GPE) for 15 business days to allow proposers to show clear and convincing evidence that competition would be advantageous to the Government. No responses were received by the suspension date therefore the brand name or equal application will be made without further notice.
