About this file
This is a Questions and Responses document for Solicitation Number W912PM26QA031, Engineer Repair Yard Warehouse Roof Replacement, issued by the Department of the Army Corps of Engineers Engineering District Wilmington. The document addresses a single question regarding technical submission requirements, specifically confirming that offerors must submit a valid North Carolina general contractor's license from the North Carolina Licensing Board for General Contractors (NCLBGC) at the time of quote submission. The government confirmed this requirement and provided detailed background on North Carolina's licensing authority and regulations under N.C. General Statute 87, Article 1, which mandates licensure for general contractors on projects valued at $40,000 or more. The response includes information on reciprocity arrangements with other states, noting that North Carolina does not have full reciprocity but maintains examination waiver agreements with South Carolina, Tennessee, Louisiana, Georgia, Mississippi, Alabama, and Florida.
The underlying solicitation specifies that award will be made to the lowest priced, technically acceptable offer. To be considered technically acceptable, contractors must demonstrate: valid SAM registration with no exclusions, a valid North Carolina general contractor's license, a 10-year or longer workmanship warranty, minimum previous experience on two contracts/projects of similar scope, and a technical proposal demonstrating ability to meet all Statement of Work requirements. The deadline for questions and requests for information was Friday, May 8, 2026, at 2:00 PM ET, with all inquiries and quote submissions directed to Diana D. Curl and Rosalind M. Shoemaker via email.

| 1 | Please confirm the following is the Government’s intention – historically, this is not standard with federal contracts. |
| b) The Offeror is to submit a valid North Carolina general contractor's license from the North Carolina Licensing Board for General Contractors (NCLBGC) at the time of quote. | Confirmed: In 1925 the North Carolina General Assembly established the authority of the North Carolina Licensing Board for General Contractors, amending Chapter 318 of the Public Laws, designed for the purpose of safeguarding life, health and property and to promote public welfare. The licensing statutes which govern the North Carolina Licensing Board for General Contractors prescribe certain standards for persons, firms and corporations who enter into contracts for construction work in this state. The practice act providing specific regulatory authority over general contractors is found under N.C. General Statute 87, Article 1. Current laws in North Carolina define general contractors as persons, firms or corporations who bid upon, contract or construct construction projects involving the construction of any building, highway, public utilities, grading or any improvement or structure costing $40,000 or more. In the State of North Carolina, a general contractor must be licensed if the contract is valued at $40,000 or higher. (GS 87-1). According to the frequently asked questions located at: https://www.nclbgc.org/faq-contractors/, the North Carolina Licensing Board does not have full reciprocity with any other state. They currently have examination waiver agreements with South Carolina, Tennessee, Louisiana, Georgia, Mississippi, Alabama, and Florida. (See details regarding exam waivers located at: https://www.nclbgc.org/laws-regulations/). You will need to complete the new application in its entirety and the board you are licensed with in the other state must complete the Examination Waiver form included in the application. The application and waiver must be submitted together. When using the examination waiver from another state, the qualifier will have to pass the NC Business and Law exam. |
