STATEMENT OF WORK
Municipal Solid Waste Philpott Lake, 1058 Philpott Dam Road, Bassett, VA 24055
1. PERFORMANCE BASED SERVICES
The Contractor shall perform in accordance with all terms, conditions, specifications, and standards contained herein, and all current local, county, state of Virginia, and Federal regulations and laws. The Contractor will be responsible for dumping fees.
2. GENERAL DESCRIPTION: Contractor is responsible to provide labor, equipment, supplies, and maintenance on the equipment required to collect and remove municipal solid waste from Philpott Lake on a regular scheduled basis as specified within this contract. All waste shall be transported and disposed of in accordance with all applicable Federal, State and local laws and regulations.
2.1 CONTAINERS: The contractor shall furnish and maintain all equipment to include containers used for services within this contract.
2.2 SAFETY DATA SHEET (SDS) will be submitted to the COR or KO and approval obtained prior to use of any chemical on Philpott Lake grounds.
2.3 VEHICLE OPERATING CONDITION: Vehicles used in the collection of refuse shall be designed for the efficient handling of refuse, licensed and inspected to operate in the State of Virginia. They shall be equipped with a lift for handling and dumping of containers. The vehicle storage area shall have a covered body suitable for this type of service and be in compliance with State Law regarding waste transportation; disposal and dumping in approved landfills.
Vehicle shall be in good operating condition and shall not leak oil or hydraulic fluids. Any fluid spills or leaks must be immediately cleaned and removed by the contractor on the same day spillage occurs.
2.4 PROPER DISPOSAL OF WASTE: Contractor shall transport and dispose of all waste in accordance with applicable Federal, State and local Laws for landfills in the State of Virginia or any other State where the contractor may dispose of waste.
2.5 WASTE REMOVAL SCHEDULES: Contractor shall adhere to the schedules established for each container. Failure to maintain the schedules outlined under each container will result in the Government applying any and all remedies allowed by the contract.
2.6 DISPOSAL SCHEDULE: Contractor shall adhere to the schedule contained in the
Statement of Work (SOW).
Upon inspection, if the Quality Assurance (QA) Inspector notes that these containers are full, contact will be made with the Contractor to determine when service will be performed. If service is not performed within two working days of this contact a Quality Deficiency Report (QDR) may be generated.
3.0 QUALITY ASSURANCE SURVEILLANCE PLAN (QASP): The government shall inspect the Contractor’s service for contract compliance as described below.
a. The Government’s QA Inspector will inspect service for compliance with specifications and schedules.
b. The method of surveillance will be a random visual inspection by the Government QA Inspector.
c. All work must meet acceptable Federal, State, and local standards for waste transport and disposal in appropriate disposal sites.
The Government’s preferred method for correction of deficient services is re-performance at no additional cost to the Government. If the contractor is not able to re-perform within one working day, a penalty may be accessed on the next invoice as described in the Service Delivery Summary. If performance is a continual problem all remedies allowed by the contract’s Commercial Terms and Conditions Clause, 52.212-4 may be used including termination of the contract.
Non-performance or unacceptable performance will be documented via a written QDR by the QA Inspector. The QDR may be in any written form including electronic forms i.e. email and fax with a copy to the Contracting Officer. The Contractor is required to acknowledge receipt and respond in writing within one working day with a copy to the Contracting Officer.
The QDR will contain the following information and require an acknowledgement and response from the contractor within 1 working day.
3.1 QDR Required Information:

3. Contractor’s Name, address, email, phone/fax number
4. Quality Assurance Inspector’s Name, email, and phone/fax number
5. Date of inspection
6. Date of performance
7. Description of performance deficiency
8. Recommendation for either re-performance or invoice deduction.
3.2 The Contractor’s QDR response is required to have the following information:
1. Contract Number
2. Date of response
3. Contractor’s Name, address, email, phone/fax Number
4. Contractor’s acknowledgement that either re- performance was completed, will be completed, or that the appropriate deduction will be made on the next monthly invoice.
In a case where re-performance of a deficiency is not appropriate or attempted, a description will be required of the steps the Contractor will take to avoid similar deficiencies in the future.
4.0 SUPERVISION OF WORK: The Contractor shall provide all management, supervision, and labor to effectively fulfill the requirements of this contract. The Contractor will ensure that all contract work is satisfactorily supervised, either by his personal presence, by the on-site supervisor, or a combination of these alternatives. Neither US Army Corps of Engineers employees nor other Government employees are authorized to exercise either direct or indirect supervision over, or provide direction to, the Contractor’s employees. Contractor should refer all to the assigned COR/KO.
5.0 INSPECTION: The government shall inspect the contractors' work for contract compliance, during and after completion of work. The contractor shall not be paid for any work until an inspection has been performed by a Government inspector to assure work meets specifications contained in contract.
NOTE: Contractor shall not perform any work outside the SOW without prior approval from the Contracting Officer.
6.0 REGULATORY STATUS: The work performed by the Contractor and their subcontractors shall be in compliance with Section 404 of the Clean Water Act, all applicable USACE, other Federal, State, and Local regulations and guidelines. All work shall be conducted in a safe manner and comply with OSHA standards and EM 385-1-1, current version.

9.0 PAYMENT & INVOICING: The Contractor shall submit a monthly invoice for services rendered at each location. Payment will be monthly in arrears and should be received by the Office Administrator by email or US Postal Service. Invoices shall be submitted to:

STATEMENT OF WORK
I. PURPOSE:
The purpose of this Statement of Work is to provide all labor, supplies, materials, equipment, and supervision required to provide the US Army Corps of Engineers, Wilmington District (USACE, SAW), Philpott Lake to maintain, transport and dispose of non-hazardous Municipal Solid Waste (MSW). Waste will be delivered to area landfills in accordance with current local, state, and federal laws.
II. GENERAL DESCRIPTION:
The Contractor shall perform in accordance with all terms, conditions, specifications, and standards contained herein, and all current local, county, state of Virginia, and Federal regulations and laws. The Contractor will be responsible for dumping fees. Service will be for additional pickups on an “as-needed” basis.
III. SCOPE:
This SOW describes the requirements, services and expected outcomes for the contractor to provide successful performance. The Contractor is responsible to provide labor, equipment, supplies, and maintenance on the equipment required to collect and remove MSW from the facilities on a regular scheduled basis as specified within this contract. All waste shall be transported and disposed of in accordance with all applicable Federal, State and local laws and regulations.
IV. PERIOD & PLACE OF PERFORMANCE:
PERFORAMNCE: The Government intends to award a Firm Fixed Price (FFP) Contract with 1 Base Period and 4 Option Periods. The period of performance is the date of award for 12 continuous months for the Base and 12 continuous months for each Option period. Award terms for Option periods will be contingent upon Contractor’s performance in meeting the mission essential performance requirements for this effort.

HOURS OF OPERATION: The Contractor shall provide MSW disposal services between the hours of 7:00 a.m. to 4:30 p.m. on all scheduled workdays. Any variation for performing work outside these duty hours must be approved in advance by the COR.
V. SERVICES:
CONTAINERS:
Contractor to be responsible to furnish and maintain all equipment with the following outcomes:
• Containers shall remain at Philpott Lake in locations which will be selected by the
COR/KO,
• Be positioned and maintained in such a manner as to present a neat and orderly appearance that does not limit, block, or restrict access to any infrastructure.
• Must have an operable lid and be leakproof with a plug in the base.
• Remain in operable condition at all times. Any damaged equipment must be repaired or replaced within 48 hours of notice of damage to the Contractor.
• Be at minimum six (6) yard bins or equivalent in size.
MSW Load Estimates: Presented below are estimated quantities for the work proposed by the Government. Estimated quantities change with the seasons and visitor numbers. The cubic yardage of (MSW) estimated average quantities for the Philpott Lake locations is as follows:
GOOSE POINT PARK Estimates Quantity Cubic yards April-October 18 c.y. x 7 months ~ 1008 cubic yards
SALT BRANCH PARK Estimates Quantity Cubic yards April-October 18 c.y. x 7 months ~ 1008 cubic yards
HORSESHOE POINT PARK Estimates Quantity Cubic yards May-September 12 c.y. x 5 months ~ 480 cubic yards
MAINTENANCE COMPOUND Estimates Quantity Cubic yards April-October (once per week) 12 c.y. x 7 months November-March (every other week) 12 c.y. x 10 weeks ~ 456 cubic yards
ADDITIONAL PICK UPS (Option Line Items):
Service for additional pickups on an “as-needed” basis.
Additional containers may or may not be required during the year, however, the contractor must be able to supply and service the additional containers during the year if required by the
KO.VEHICLES:
• Contractor vehicles utilized shall be efficient for the services performed and shall be:
o For removal of MSW from Philpott Lake in a safe and efficient manner o Licensed and inspected to operate in the State of Virginia o Have a covered body suitable for this type of service and be in compliance with State Law regarding waste transportation; disposal and dumping in approved landfills.
• Transportation and disposal of all waste shall be in accordance with applicable Federal, State and local Laws for landfills in the State of Virginia or any other State where the contractor may dispose of waste.
Additional Contractor Information:
Contracting Officer’s Representative (COR). The COR is a representative of and appointed by the Contracting Officer (KO) and will participate in the oversight of this contract. Any matter alleging a change to the scope, prices, terms, or conditions of this contract shall be referred to the KO and not to the COR. The COR will represent the KO in the technical phases of the work but will not be authorized to change any of the terms and conditions.
VI. Security Requirements: The following information is provided on security related matters:
ATOPSEC #1: General security requirements and guidance: The security requirements described below apply to all contract personnel (including employees of the prime Contractor (“Contractor”) and all subcontractor employees) supporting the performance requirements of this contract. The Contractor is responsible for compliance with these security requirements.
Questions regarding security matters shall be addressed to the designated Government representative (e.g., Contracting Officer Representative (COR), Requiring Activity (RA) representative, or Contracting Officer (if a COR or other RA representative is not appointed)).
Contract personnel are critical to the overall security and safety of US Army Corps of Engineers (USACE) installations, facilities and activities, and security awareness training contributes to those efforts. The Department of Defense (DoD) and Army security training requirements specified below, if applicable, are performance requirements; all applicable contract personnel shall complete initial training within 30 days of contract award or the date new contract personnel begin performance on the contract. Within five business days from the completion of training, the Contractor shall provide written documentation (e.g., email or memorandum) to the Government representative. The documentation shall include the names of contract personnel trained and which training they completed; the Contractor shall maintain training records as part of their contract files and be prepared to provide copies of training certificates to the Government representative. Contractor personnel and vehicles are subject to search when entering federal installations. Additionally, all contract personnel shall comply with Force Protection Condition (FPCON) measures, Random Antiterrorism Measures (commonly referred to as “RAMs”), and Health Protection Condition (HPCON) measures. The Contractor is responsible for meeting performance requirements during elevated FPCON and/or HPCON levels in accordance with applicable RA plans and procedures --this includes identifying mission essential and non-mission essential personnel. In addition to the changes otherwise authorized by the changes clause of this contract, should the FPCON or HPCON levels at any individual facility or installation change, the Government may implement security changes that affect contract personnel. The Contractor shall ensure all contract personnel are aware of their security responsibilities, including any site-specific requirements identified in local policies or procedures.
ATOPSEC #2: Antiterrorism (AT) Level I training: All contract personnel requiring routine access to Army installations, facilities, and controlled access areas, or requiring network access shall complete initial and annual refresher AT Level I awareness training. Online AT Level I awareness training is available at https://jko.jten.mil/ (website subject to change).
ATOPSEC #3: Physical security and access control requirements: All contract personnel requiring physical access to a federal installation or facility shall comply with the access control procedures of that location. Contract personnel requiring unescorted access to meet contract performance requirements on a DoD installation in the US shall be vetted by the installation/facility Provost Marshal/Directorate of Emergency Services/Security Office using the National Crime Information Center-Interstate Identification Index (commonly referred to as “NCIC-III”) and Terrorist Screening Database (commonly referred to as “TSDB”). Contract personnel shall comply with all personal identity verification requirements specified in installation/facility policies and procedures. Contract personnel who do not meet requirements for unescorted access to USACE facilities shall coordinate escorted access with the Government representative, as needed. Contract personnel who receive keys, access cards, or lock combinations that provide access to government-owned property shall comply with key and lock control procedures of the RA.
ATOPSEC #6: Suspicious Activity Reporting training (e.g. iWATCH, CorpsWatch, or See Something, Say Something): All contract personnel shall receive initial and annual refresher training from the RA representative on the local suspicious activity reporting program. This locally developed training provides contract personnel with general information on suspicious behavior, and guidance on reporting suspicious activity to the project manager, security representative or law enforcement entity.
ATOPSEC #13: Escorting in classified and/or sensitive areas: In accordance with applicable regulations, all contract personnel who do not possess the appropriate security clearance or access privileges will be escorted in areas where they may be exposed to classified information or operations, sensitive information or activities, or restricted areas.
ATOPSEC #14: Pre-screen candidates using E-Verify Program: Contractors shall comply with the requirements set forth in FAR clause 52.222-54 Employment Eligibility Verification and FAR Subpart 22.18 in using the E-Verify Program at (https://www.e-verify.gov/) (website subject to change) to meet the contract employment eligibility requirements. Contractors are encouraged to cooperate with Federal and State agencies responsible for enforcing labor requirements to include eligibility for employment under United States immigration laws in accordance with FAR 22.102-1(i). An initial list of verified/ eligible candidates shall be provided to the COR no later than three business days after the initial contract award. When contracts are with individuals, the individuals will be required to complete a Form I-9, Employment Eligibility Verification, and submit it to the Contracting Officer to become part of the official contract file.
